It has been decided to hold a meeting of the Forum of BSNL Unions/Associations at 16.00 hours on 9th October 2013 at BSNLMS office.
The issues to be discussed include implementation of the decisions of the 3rd August National Convention like holding of Conventions at Circle/SSA levels, actions for the “Revival of BSNL” etc.
All General Secretaries are requested to be present since important decisions are to be taken.

6.6% IDA increase from 1st October 2013

It is reported that BSNL employees will get an increase of 6.6% IDA with effect from 01-10-2013.Accordingly the total IDA from October 2013 will be 78.9 + 6.6 = 85.5%. The order is expected soon. Pensioners will also be eligible for 6.6% IDR increase.
It is only a few days back that the Central government issued orders for 10% DA increase for CG employees w.e.f. July 2013. While the PSU employees get increase of IDA every three months, for the CG Employees, it is once in six months.

Coms. V.A.N.Namboodiri, President, BSNLEU and K.G.Jayaraj, General Secretary, AIBDPA met Smt. Annie Moraes, Member (Finance), DOT and discussed about implementation of the 78.2% IDR fixation for pensioners. The union representatives requested that the orders be issued without further delay. Member(F) stated that the matter is being forwarded to the Department of Pension and Pension Grievances and after getting it back will sent to Department of Expenditure. After these clearances the order will be issued. Maximum effort is being taken for issue of order early she stated.
The union representatives also wanted that the anomaly in pension for those retired in the first ten months of formation of BSNL be settled early as agreed in the SCOVA meeting. She assured early settlement.

The union leaders also met DDG (Estt.) Shri Khanna and discussed the pending issues connected with the Pensioners.

Today, Com.V.A.N.Namboodiri, Convener, Forum of BSNL Unions/Associations along with Com.K.G.Jayaraj, General Secretary, AIBDPA met Shri N.Ravi Shankar, Administrator, USO Fund and requested for early disbursement of Rs. 1,250 crore to BSNL which has been recommended / approved for the present financial year, in continuation of the Rs.1,500 crore paid for the last financial year. Administrator stated that certain inquiries have been sought from BSNL, which is to be furnished to the National Institute of Communication Finance (NICF) before the final clearance of the subsidy. The union leaders pointed out about the weak financial position of the BSNL and sought for early release of the subsidy.

BSNL will be completing 13 years of its existence on 1st October 2013. It was formed on 1st October 2000 as part of the neo-liberal policy of the Government with the intention of gradually disinvesting and privatising the same. The Telecom Unions under the banner of National Action Committee led by AITEU. Class III (N) organised two successful strikes and other agitational programmes against corporatisation. Then recognised Federations, NFTE and FNTO went on strike in the last moment but made an agreement with the DOT accepting corporatisation.Thus BSNL was formed on 1st October 2000.

What happened during the last 13 years are well known to all. The company was running well and improving its position. The government and the private sector which thought that BSNL will crumble down on its own were disappointed. When they realised that BSNL is strengthening they started the operation to weaken and destabilise it. Government support on financial viability was stopped, the procurement process was destabilised and along with the same, many actions were taken to favour the private companies and against the interest of the incumbent operator, BSNL. The government decided to disinvest BSNL, but the Joint Forum by going on strike defeated the same. On the strong opposition from JF, VRS could not be implemented. But the anti-PSU policy of the government and the lethargic working of the ITS led management resulted in continued loss for the company for the last four years. The Forum of BSNL Unions/Associations is making all out efforts to pressurise the government and BSNL Management to take pro-BSNL decisions and implementation of the same. It called upon the workers to improve the customer services. The National Convention on Revival of BSNL held at New Delhi on 3rd August adopted a Declaration with proposals and suggestions for strengthening the company and for a better service to the customer. This process is continuing.

And now the 13th anniversary of the formation is coming. Let us continue our work to improve the service and pressurise the management and the Government for taking suitable decisions for strengthening the company. The Forum meeting which is going to be held on 9th October will take suitable decisions in the matter.

The Holidays are near – Where is the Bonus for BSNL employees?

BSNL employees have been deprived of the Bonus for the last few years, on the plea by the management that since the company is in loss, employees are not eligible for Bonus. This is untenable.
The recognised union, BSNLEU, has pointed out that the present Bonus (PLI) Formula, which states that workers are not eligible for Bonus if the company is in loss, is an arbitrary decision with out consulting or discussing with the union/s.

BSNLEU and United Forum has already issued strike notice which includes the Bonus Demand also. BSNL Management should discuss and take a favourable decision. Bonus should be paid to the BSNL employees with out further delay. The Holidays season is already starting.

Global Corruption Index – India at 69th out of 197 Nations.

The Global Corruption Index has put India at 69th position out of 197 countries. Now the increasing corruption in India is known to other countries also. The last three four years have seen unended corruptions of thousands and lakhs of crore corruption cases like 2G, Coal Gate, Antrix-Dewas, Common Wealth Games, Adarsh Housing Colony, Railway Scam and many more in which the Central Government itself is directly involved. Not only corruption, but criminality by destroying the evidences, just like in the Coal Gate Scam etc. are being revealed. Those who raises the Corruption issues are victimised.

Certainly, India is in the middle of a lot of scams and corruption. It is almost become part of the establishment. Corporates, Industrialists, big business are all part of it.

There is no other way but to fight this menace continuously and with determination to make an end to it.

Unions oppose Airport Privatisation

The Employees Unions in Airport Authority of India (AAI), has decided to organise agitational programme against the proposal of the government to hand over the airports at Kolkata, Chennai, Ahmedabad, Lucknow, Jaipur and Guwahati to the private companies. These airports have been recently modernised by the AAI by spending huge amounts and are the airports from which the AAI is getting profits. New Delhi, Mumbai, Bangalore and Hyderabad, big and profitable airports have already been privatised. If the above six airports are also privatised, then AAI will be left with small airports which are mostly loss making. The union has suggested that if the government wants to privatise, then they can privatise these small airports.
Against the proposed privatisation, the unions are organising four days Relay Hunger Strike from 22nd October 2013.
We support the demand of the AAI employees and their unions and demand the government to desist from the proposed privatisation of airports, which is completely against the interest of the nation.

I am giving below an e-mail received from Com. C.K.Gundanna, Circle Secretary BSNLEU and circle President Non-Permanent Workers Union (BSNLCCWF). Under the leadership of Com.Gundanna as President and Com. Mahantesh as Circle secretary of BSNLCCWF, they organised many agitations of the casual/contract workers and achieved many gains. Now they have been able to get reinstatement of 4 comrades who were retrenched for TU activities. Congratulations to all our Karnataka Comrades!

The BSNL Non Permanent Workers Union of Karnataka Circle is opening one more district level branch on Sunday the 29th September 2013 at Hubli-Dharwar.
The first conference of BSNL NPWU Dharwad district will be inaugurated by Com. Gundanna ,Cir.Sec., BSNLEU.
Com. Mahantesh,Gen.Sec., BSNL NPWU, Com.Praveen Badiger, Circle Org.Sec., BSNL NPWU, B.I.Iligera,Dist.Sec., CITU,Com. Mahesh Pattar,Dist,.Gen.Sec., CITU, Com.Harish Doddamani,Dist.President BSNLEU,Com.Uday Jerimalli, Dist.Sec., BSNLEU, will be present during the inaugual function.
Com. R H Aai, Hon.President,CITU Dharwar Dist., and EX – Senior leader of AIIEA will be presiding over the inaugural function.

(2) On 2nd & 3rd October 2013, a State level trade union class has been organised for BSNL NPWU at Raichur. The BSNLEU Circle and Raichur Dist., is taking full responsibility of organising the T U Class in association with C I T U Karnataka State.
The T U class will be inaugurated by Com. Animesh Mitra, Dy.G.S., BSNLEU on 2nd Oct. .at Com. P.Mukundan memorial Auditorium at Raichur.

(3) On 3rd October, 2013, the BSNLEU North Karnataka Dist, Units, comprising of Dist.Unions of Bidar,Gulburga,Raichur and Bellary will have a seperate meeting of BSNLEU, which will be addressed by Com. Animesh Mitra,Dy.GS., Com. M C Balakrishna,All India Org.Sec., Com.Gundannack Cir.Sec., and Com.Prasanna Kumar,Gen.Sec., CITU Karnataka State

Four Contract workers including Dist.Sec., of BSNL NPWU, Com. Kallappa were removed from service about six months ago, without any reason. Com. Namboodiri addressed this issue to our PGM HR and A also, during a day long Circle level dharana by BSNL NPWU workers in front of CGM Office on 28th August 2013. A case was also pending in labour court pleading re instatement of all the four workers. After our Dharna, the CGM office conducted an enquiry by sending the AGM Genl to Bidar and that report was also in favour of the four workers who got removed. On 25th September, the Bidar Dist., BSNL NPWU workers went on day long dharana in front of TDM Bidar Office,which was totally supported and addressed by dist level leaders of BSNLEU and the CITU. A good coverage was given to the actual facts and also about the dharana conducted at Bidar by local print media. Finally, the TDM agreed to reinstate all the four contract (House keeping) workers w e f 30th September 2013. This is the greatest achievement of our Circle level Dharna on 28th August followed by Dist.level dharana on 25th Sept, 2013.

Councils in BSNL for Negotiation

For the first time in Bharat Sanchar Nigam Limited (BSNL), two unions are recognised for the purpose of representing the non-executive employees numbering about two lakh. This is because the verification has been conducted on the basis of New Recognition Rules adopted for the membership verification this time which was held on 16-04-2013. Accordingly BSNLEU with 48.6% and NFTE with 30.28% support were approved as Representative Unions. The five membership verifications starting from 2002 was held under the Code of Discipline, through which the union which gets the maximum number of support alone was recognised. Thus in the first verification held in 2002, NFTE got 35% and was recognised. In the next four verifications, from the second to the fifth, conducted in 2004, 2007, 2009 and 2011 BSNLEU got majority and was recognised.
The Negotiating Machinery in BSNL is constituted generally on the same line as the Joint Consultative Machinery (JCM) existing in Central Government Departments, including DOT. But certain variations are there. In DOT, the JCM was at three levels, National, Circle and SSA. It is the same with the Councils in BSNL also. In DOT, the number of Staff Side is 14 and it was divided between NFTE and FNTO at the ratio of 10:4. In BSNL, till now, all the 14 seats ( in 2009 after agitation, the seats were increased to 15, though the demand was for 20 considering the large number of workers, cadres, pan India presence etc) were for the recognised union only. In the New Recognition Rules, the total seats have been reduced to 14 and are allotted at 9:5 on the basis of the votes received by both the unions. 7% is the criteria for getting a seat in the Council. Even a union which is not recognised is eligible for a seat, if it gets 7% or more of the total votes. FNTO which got 6.89% and missed the seat by a fraction approached the court but did not get relief, since their votes were less than 7%. But certain TU facilities are allowed to both FNTO and BTEU BSNL both of which got more than 2%. All other unions got less than 2 % and no facilities except deduction of subscription of members from the salary by the BSNL Management.
In the JCM Departmental Council of DOT, the Chairman was Secretary, DOT and all the Members like Finance, Services, Technology etc. were members of the Official Side. However, in BSNL, the CMD BSNL is not the Chairman. It is allotted to Director (HR). Director (Finance) is a member, but other Directors are not members of the National Council. There are more than 40 circles, including that of non-territorial circles like STR, STP etc. The CGM of the concerned circle is the Chairman of the council. In the SSA levels, GM will be the Chairman. In all these Circle and SSA councils, the number of the staff side members is the same as National Council, ie 14 and allotted at 9:5 ratio between BSNLEU and NFTE.
In the New Recognition Rules, there is a difference compared to earlier rules. Till this time, the Leader and Secretary Staff Side were elected by the Staff Side. That is so in the DOT period also. But without consultation with the Union/s, the Management has brought a change, which is arbitrary. According to the above, the Management has directed that the Secretary will be from BSNLEU and leader from NFTE . Such directions are meaningless. Whether it is the Parliament or any institution, the Leader/ Secretary is being elected by the concerned members. The undemocratic content in the New Recognition Rules should be changed.
Another point which has to be noted is that, in all committees to be formed with Staff Side, the proportionate representation is to be ensured as in the National Council, ie. 9:5 ( 2:1). IN the DOT period it was 10:4. The system is to be continued.
The Staff Side is now stronger with support of about 80% of the staff, compared to about 50% earlier (some times more than50% and sometimes less than 50%). This strength has to be used effectively. The Management also has to understand that the voice of the staff side has to be seriously heard and addressed to.
One weakness or rather draw-back of the management is its mindset that the unions need not be taken in to confidence on the issues of development, planning, implementation etc. Here, the management is completely wrong. By consulting the workers on these crucial issues and considering their suggestions will give good dividend. But unfortunately the experience is that the field officers are not even holding the meetings of the Works Committee, which has been mutually decided and orders issued by the management. There is immediate requirement that this unhealthy mindset should be changed, which will highly benefit the organisation and the services.
Another point has been raised that whether persons from unions other than the recognised unions can be nominated to the Councils. In all the earlier Councils, such nominations have been given and accepted. There need not be any doubt about the same. The recognised unions not only represent their union members, but represent all the workers in the BSNL. There cannot be any doubt on this issue.
The regularity of the meetings is to be ensured. Within a period of 2 years, considering that the council meetings are to be held once in three months, eight meetings can be held. Though at least 7 if not 8 meetings were held in the past, in the recent years the management has been violating this important point by holding three or four meetings only. This should change. Now that the verification period is increased to three years, at least 11 or 10 meetings could be held. Standing Committee meetings should be held every two months as per decision.
There should be seriousness and maximum effort on both sides to clinch the issues and take decisions. Prolonging the issues for years in the name of procedure etc. will demotivate the workers and create friction, which has to be avoided. ot
The first meeting is yet to be held. There has been delay in formation of the councils due to court case. Now that the court case is over, the formation as also holding of meetings should start early. The Staff Side has to meet and finalise the items and submit to the Official side, so that notice for the council meeting can be issued. This is required for the councils at all levels.
Let all of us make conscious effort to make the Councils a success and the staff issues settled.
