Councils in BSNL for Negotiation

For the first time in Bharat Sanchar Nigam Limited (BSNL), two unions are recognised for the purpose of representing the non-executive employees numbering about two lakh. This is because the verification has been conducted on the basis of New Recognition Rules adopted for the membership verification this time which was held on 16-04-2013. Accordingly BSNLEU with 48.6% and NFTE with 30.28% support were approved as Representative Unions. The five membership verifications starting from 2002 was held under the Code of Discipline, through which the union which gets the maximum number of support alone was recognised. Thus in the first verification held in 2002, NFTE got 35% and was recognised. In the next four verifications, from the second to the fifth, conducted in 2004, 2007, 2009 and 2011 BSNLEU got majority and was recognised.
The Negotiating Machinery in BSNL is constituted generally on the same line as the Joint Consultative Machinery (JCM) existing in Central Government Departments, including DOT. But certain variations are there. In DOT, the JCM was at three levels, National, Circle and SSA. It is the same with the Councils in BSNL also. In DOT, the number of Staff Side is 14 and it was divided between NFTE and FNTO at the ratio of 10:4. In BSNL, till now, all the 14 seats ( in 2009 after agitation, the seats were increased to 15, though the demand was for 20 considering the large number of workers, cadres, pan India presence etc) were for the recognised union only. In the New Recognition Rules, the total seats have been reduced to 14 and are allotted at 9:5 on the basis of the votes received by both the unions. 7% is the criteria for getting a seat in the Council. Even a union which is not recognised is eligible for a seat, if it gets 7% or more of the total votes. FNTO which got 6.89% and missed the seat by a fraction approached the court but did not get relief, since their votes were less than 7%. But certain TU facilities are allowed to both FNTO and BTEU BSNL both of which got more than 2%. All other unions got less than 2 % and no facilities except deduction of subscription of members from the salary by the BSNL Management.
In the JCM Departmental Council of DOT, the Chairman was Secretary, DOT and all the Members like Finance, Services, Technology etc. were members of the Official Side. However, in BSNL, the CMD BSNL is not the Chairman. It is allotted to Director (HR). Director (Finance) is a member, but other Directors are not members of the National Council. There are more than 40 circles, including that of non-territorial circles like STR, STP etc. The CGM of the concerned circle is the Chairman of the council. In the SSA levels, GM will be the Chairman. In all these Circle and SSA councils, the number of the staff side members is the same as National Council, ie 14 and allotted at 9:5 ratio between BSNLEU and NFTE.
In the New Recognition Rules, there is a difference compared to earlier rules. Till this time, the Leader and Secretary Staff Side were elected by the Staff Side. That is so in the DOT period also. But without consultation with the Union/s, the Management has brought a change, which is arbitrary. According to the above, the Management has directed that the Secretary will be from BSNLEU and leader from NFTE . Such directions are meaningless. Whether it is the Parliament or any institution, the Leader/ Secretary is being elected by the concerned members. The undemocratic content in the New Recognition Rules should be changed.
Another point which has to be noted is that, in all committees to be formed with Staff Side, the proportionate representation is to be ensured as in the National Council, ie. 9:5 ( 2:1). IN the DOT period it was 10:4. The system is to be continued.
The Staff Side is now stronger with support of about 80% of the staff, compared to about 50% earlier (some times more than50% and sometimes less than 50%). This strength has to be used effectively. The Management also has to understand that the voice of the staff side has to be seriously heard and addressed to.
One weakness or rather draw-back of the management is its mindset that the unions need not be taken in to confidence on the issues of development, planning, implementation etc. Here, the management is completely wrong. By consulting the workers on these crucial issues and considering their suggestions will give good dividend. But unfortunately the experience is that the field officers are not even holding the meetings of the Works Committee, which has been mutually decided and orders issued by the management. There is immediate requirement that this unhealthy mindset should be changed, which will highly benefit the organisation and the services.
Another point has been raised that whether persons from unions other than the recognised unions can be nominated to the Councils. In all the earlier Councils, such nominations have been given and accepted. There need not be any doubt about the same. The recognised unions not only represent their union members, but represent all the workers in the BSNL. There cannot be any doubt on this issue.
The regularity of the meetings is to be ensured. Within a period of 2 years, considering that the council meetings are to be held once in three months, eight meetings can be held. Though at least 7 if not 8 meetings were held in the past, in the recent years the management has been violating this important point by holding three or four meetings only. This should change. Now that the verification period is increased to three years, at least 11 or 10 meetings could be held. Standing Committee meetings should be held every two months as per decision.
There should be seriousness and maximum effort on both sides to clinch the issues and take decisions. Prolonging the issues for years in the name of procedure etc. will demotivate the workers and create friction, which has to be avoided. ot
The first meeting is yet to be held. There has been delay in formation of the councils due to court case. Now that the court case is over, the formation as also holding of meetings should start early. The Staff Side has to meet and finalise the items and submit to the Official side, so that notice for the council meeting can be issued. This is required for the councils at all levels.
Let all of us make conscious effort to make the Councils a success and the staff issues settled.

After the historic National Convention of BSNL Employees on “Revival of BSNL” on 3rd August 2013, the Forum continues its work in right earnest. Kerala Circle has successfully conducted the Circle Convention at Trichur. U.P.(East) Circle has scheduled the Convention on 15th of October. Other circles are also planning to hold the same. The Forum of BSNL Unions/Associations, Circle units should take initiative.
As far as the National Forum is concerned, after the Convention, the Forum has met many Members of Parliament during the last session. Letters enclosing the copy of the Declaration adopted at the National Convention have been sent to about 100 prominent MPs of all parties, including many Ministers. Some of the M.P.s like Basudeb Acharya, Gurudas DasGupta, P.R.Natarajan Khagan Das, Dr. Sanjeeva Redddy and others have written to the Prime Minister / Finance Minister / Communications Minister forwarding our Memorandum / Declaration adopted in the Convention. We thank them all.
The Forum has written to all the Chief Ministers of the States forwarding the Declaration and requesting for support and also to ensure that all the state government Departments and state PSUs are mandated to use BSNL Services.
The Editors of Newspapers have been approached for giving wide publicity to our campaign for Revival of BSNL. The Convener personally met some of the Editors/Correspondents and requested for publishing supportive write ups.
The Forum Convener has also written to the All India Federations / Unions like Confederation of Central Govt. Employees and Workers, NFPE, AIIEA, AIDEF, BEFI, AISGEF etc. and requested for support and solidarity in our campaign.

The Group of Ministers have already taken some decisions on the points we also raised. It has recommended to the government to refund the Spectrum Charges both to BSNL and MTNL. More close co-ordination between BSNL and MTNL is being envisaged. The Secretary DOT and other top officers have mentioned well about our efforts.

The 13th Anniversary of the formation of BSNL falls on 1st October 2013. Let our campaign and effort be increased in the 14th year of BSNL. This financial year (2012-13) it is stated that the loss has come down a little. Our effort should ensure that in 2013-14, there is no loss.

If the 2.5 laklh employees, their organisations and the BSNL Management put all their effort for strengthening BSNL and pressurise the government to implement its assurances, it is sure that there will be good improvement in development and services. Let us make sustained effort towards this goal. BSNL is sure to survive and strengthened.

CLC Conciliation on the demands of Forum

The Chief Labour Commissioner has called both the Forum and the BSNL Management for conciliation on 29th August 2013 on the demands raised by the Forum on the proposed strike of 12th June ( which was withdrawn after settlement with management). The meeting will take place at 11.00 AM at Shram Shakti Bhawan.

Meeting of GoM on Revival of BSNL and MTNL

It is reported that the meeting of the GoM on Revival of BSNL and MTNL has discussed the following and consensus reached:
1. The pay scales of BSNL may be brought to the level of MTNL pay scale by the next wage revision of 2017.
2. The pension for MTNL absorbed staff will be paid by the Government on the basis of X + 1, in which the pension equivalent to the pay scale of BSNL will be paid by government and the pension for the balance will be paid by MTNL.
3. The opinion/suggestion of the MTNL Unions/associations will be sought and taken in to consideration.

The details of the proposals/ decisions are yet to be confirmed.

NATIONAL CONVENTION OF BSNL EMPLOYEES

New Delhi, August 3: A National Convention of BSNL Employees on “Revival of BSNL” was held on 3rd August 2013 at Mavlankar Hall, New Delhi, participated by more than 1,000 delegates from all over India. The Convention was organised under the auspices of the Forum of BSNL Unions/Associations, which is the umbrella organisation of the Unions/Associations of non-executives and executives in BSNL.

The Convention was presided over by C.Singh, President of the Forum. V.A.N.Namboodiri, Convener, Forum, presented the Declaration of the Convention on how to revive BSNL so that better service is provided to the consumers. S/Shri Gurudas Dasgupta, M.P., General Secretary, AITUC, B.N.Rai, General Secretary, BMS, Swadesh Dev Roy, Secretary, CITU, Dr. Udit Raj, Chairman, All India SC/ST employees Confederation, Thomas John, Org. Secretary, INTUC, Animesh Mitra, Dy. GS, BSNLEU, C.K.Mathivanan, Dy. GS, NFTE, K.Sebastin, SG, SNEA, Prahlad Rai, GS, AIBSNLEA, K.Jayaprakash, GS, FNTO, Suresh Kumar, GS, BSNLMS, R.Venkatraman, GS, TEPU & LPF, N.D.Ram, President, SEWA BSNL, S.V.S.Subrahmanyam, GS BTEU BSNL and R.P.Sharma, President BSNLOA addressed.

After discussion, the Declaration was unanimously adopted which demanded the government to honour and implement its assurances to the BSNL made at the time of corporatisation like reimbursement of licence fee, payment of ADC, liberal subsidy from USO Fund towards loss making connections in villages and rural areas as part of the social commitment of the government. It wanted an efficient management to run the organisation. It also called upon the workers to work with commitment and devotion so that a better service is provided.
The Convention also decided to organise circle and SSA level conventions to propagate the proposals and suggestions of the Forum for a better service. The Forum will decide further programmes later.

The Core Committee of BSNL Unions/Associations met today, 25th July and decided about the arrangements of the National Convention to be held at Mavlankar Hall on 3rd August. More than 1,000 delegates from all over India are expected. S/Shri Dr. Sanjeeva Reddy, M.P. President, INTUC, Gurudas Dasgupta, M.P.General Secretary AITUC, Swadesh Dev Roy, Secretary, CITU, B.N.Rai, General Secretary BMS and TKS Elangovan M.P. LPF and other leaders will address.

A Declaration on the Revival of BSNL will be adopted by the Convention.

The Forum of BSNL Unions/Associations have been meeting and pressing the DOT / USOF for early payment of the already approved Rs. 1,500 crore to BSNL in lieu of the ADC for the year 2011-12. The amount has now been paid to BSNL and the latter has utilised it towards payment of the loan taken earlier.

The Forum is now making efforts to get the Rs.1,250 crore which has been recommended by TRAI in lieu of ADC for the year 2012-13.

BSNL Loss – due to less revenue and not due to salary increase

BSNL, DOT and Government continuously propagate that the loss to BSNL is due to the excess staff and one lakh surplus workers should be reduced through VRS. What are the facts?

There was 3.97 lakh employees when BSNL was formed in October 2000. As on 31st March 2012, the strength of employees was only 2.58 lakhs. Within 12 years, 1.39 lakhs have been reduced by retirement etc.
What about the profit/loss? When there were 3.97 lakhs BSNL was having profit. All the first 9 years from 2000-2001 to 2008-2009, when there was much staff then at present, mostly above 3 lakhs, there were good profits. Thus the argument of the management that the loss is due to salary of employees is completely devoid of facts. The % of salary to revenue/expenditure has been increased only because the revenue has gone down during the last 4 financial years. Who is responsible for the revenue loss? It is not the workers. It is due to the anti-PSU policies of the government and the lethargic BSNL management which utterly failed in expanding and developing the services. The cut-throat competition is also another reason.

The BSNL Management is continuously mentioning that the salary of the workers is the reason for loss of the company is only to cover up their mismanagement which resulted in the loss of revenue and hence the loss.

BSNL for Better Service (9) – Mandate to be given for Govt. and PSUs to use BSNL/MTNL services

BSNL is a government owned company which implements the policy of the government for  providing universal service and communications all over the country.  It is not working on profit basis, but on service basis. BSNL mainly deals with other PSUs on many impotant issues. On the insistence of BSNLEU, the Group Insurance Scheme  and  EPF funds were entrusted with the LIC, Bank Loans Scheme was signed with  the PSU Banks, watches for employees were purchased from HMT  etc. In the case of Air India, government  have mandated  that all central government and PSUs should travel by Air India alone to ensure the viability of the company. In the same way, the government should issue instructions that all the government and PSUs should take BSNL connections, both mobile and landlines.

Of course, there is necessity to improve the services.  The management and the workers should take the responsibility for a better service. If the services are improved, naturally the subscribers will prefer a PSU instead of a private company.

The Forum demands the GoM  that a mandate as stated above should be given to all  government departments and PSUs which will have immediate impact on the workers and for efforts for a Better Service.
