The attitude of  India Inc is made clear in the editorial of the “Economic Times” dated 10th April. It has strongly supported the decision of the Central government is rejecting the proposal of the EPF Organisation to add the DA and other allowances for calculating the contribution to the EPF both by the employee and the employer.

The proposal of the EPFO will benefit  the employee by increase  in his EPF and also pension. What has irked  India Inc is that they will have to pay increased  contribution by the employers. In fact, the employers have converted a good part of the salary  in to allowances to deny contribution to the EPF.

We strongly condemn the decision of the government in rejecting the recommendation of the EPFO, which is only to favour the corporates etc. We demand the government to approve the decision of the EPFO to include the allowances also in calculating the contribution to the EPF.

CITU Writes to Minister of EPF Issue

Dear Shri Oscar Fernandes ji,

It is reported in the print media that Govt. of India has directed EPFO, to amend the circular of Central Provident Fund Commissioner, dated 30th November 2012 which relates to, inter alia, definition of wages for the purpose of PF contribution. I register my strongest protest over this decision of Govt. of India, which would reduce the PF related obligation of the employers at the huge cost of the workers- who are EPF subscribers.

After the circular was issued by the then CPFC Shri R.C. Mishra, it was put in abeyance. A tripartite working group was formed to “examine various aspects of the circular” which had CBT members representing employers and workers and also higher officials of EPFO. I was also a member of the working group. The unanimous decisions of the working group upholding the content of the EPFO Circular was finalized on 29th March 2013 and sent to Govt. Now after passage of more than one year the unanimous recommendation of the Working Group is nullified and the most important portion of this circular is being now done away with by the Govt to benefit the employers class at the cost of workers.

The most important part of the circular was on definition of wages. It has been our experience that wages are split in several heads to keep basic pay low to evade PF contributions, by the employers. The circular had clearly noted “the subterfuge of splitting wages to exclude PF liabilities”. To my knowledge, after the then CPFC Shri R.C. Mishra, two successor CPFCs had also endorsed the circular as was unanimously recommended by the working group.

I would also like to point out that this is happening in the background of two other important decisions – enhancing the minimum pension to Rs.1000 and increasing the wage ceiling for eligibility for PF enrolment to Rs.15,000 from Rs.6500 lying unimplemented, again to favour the same employers’ class at the cost of workers.

These decisions were taken by Central Board of Trustees under your Chairmanship only after the concurrence of the Finance Ministry. You and your colleagues had claimed that the Govt. wants to accept the long pending demands of workers. It was also reported widely that cabinet had approved these proposals.

Taken together, all these issues connected with the EPFO are being acted upon in such a way that legitimate dues to the workers are being denied while the employers being unduely favoured.

I urge upon you that the Circular of EPFO as unanimously upheld by the Working Group of CBT be implemented forthwith. I also demand that the decisions on enhancement of Minimum Pension under EPS, 1995 and enhancement of wage-ceiling be implemented with effect from 01-04-2014 as already announced and propagated by the Govt of India.

EPF Contribution restricted – One more anti-worker decision of Government

At present the contribution to the Employees Provident Fund is limited to 12% of the basic salary. Along with the contribution of the employee an equal amount is to be remitted by the employer. The Employees organisations have been demanding that the contribution to EPF should be calculated on the basis of the pay and allowances together so that there will more savings in the EPF.
The Employees Provident Fund Organisation (EPFO) also agreed to the same and recommended to the government for including the allowances for calculating the contribution. It had issued a circular stating that “All such allowances which are ordinarily, necessarily and uniformly paid to the employees are to be treated as the basic wages.”
But the Government refused to approve the recommendation. It has directed the EPFO not to count the allowances along with the basic pay for the calculation of contribution to Provident Fund. The justified benefit getting to the EPF subscribers have been denied by the government.
It is clear that the government has taken this measure on the pressure of the private corporates to avoid employer’s higher contribution to the EPF. It is well known that the UPA government was always in support of employers and against the interests of the workers.
It is also to be pointed out that the Government has so far not implemented its decision to increase the minimum pension to Rs.1,000 and maximum to Rs. 15,000 which was one of the demands of the Central trade Unions and which was accepted.
Even in the last moment when the General Elections are to start in a few days, the UPA government wants to favour the corporates instead of the workers.

Meeting with Com. N.O.Ananadan Master, Senior P and T Leader

There are many senior comrades of the P and T Movement, who are retired years back, but still continues to keep close connection with the workers and the union movement. Com. N.O.Anandan Master is such a comrade.
While at Kannur to attend the SSA Convention of BSNLEU and AIBDPA on 21st March 2014, I got the opportunity to meet him at his home.Before starting of the Convention, along with Coms. K.Mohanan, Circle Secretary BSNLEU Kerala, P.Manoharan, Circle Asst. Secretary,BSNLEU, C.R.Manoj BSNLEU Comrade and my wife Pankajam, I went to the home of Com.Anandan Master. He was very happy to receive us along with his wife Smt. Sita, daughter Com. Latha, who is working in BSNL and is a very active union leader and her husband Com.T. Chathukutty, working in SBI. We talked about the historic struggles, our common comrades like N.P.Padmanabhan, former Secretary, NFTE, T.M.Janardhanan (Janu Master ), who have let us. I shared my memories of Kannur when I worked there from 1959 to 1964 and about the historic 1960 strike. Of course, we had a tasty breakfast together.
I was happy to see that passed 85, Comrade Anandan Master is still keeping good health. He has kept a lot of old books and journals and also photos connected with the P and T Union movement.
When we departed to attend the convention, Anandan Master and family came up to the gate to see us off.
There are many such senior comrades all over the country who have sacrificed their entire lives for the workers and their movement. It is an inspiration to meet and discuss with them.

Times move so fast. It is difficult to think that it is 16 years since Com. EMS Namboodiripad, one of the great Communists the world has ever seen, has passed away. Yes, it was on 19th March 1998 that the veteran ideologue and all rounder in the fields of politics, culture, agitations and what not, left us forever.
Born in a rich landlord family, EMS, left all material assets to the Party to start the Party Journal Deshabhimani. At the time as a student in school/college itself he organised the young and fought for the liberation of the Brahmin women who were just like slaves in the interiors of home. He fought with other youngsters like him against the age old anarchic systems like untouchability.
While studying itself he jumped in to the struggle for the independence of the country. There was no looking back afterwards.
As a Congressman, Congress Socialist and then Communist, his contribution to the people and the country is well known. Just like any other communist leader, Com.EMS also faced all attacks, jail, underground etc. from the British first and then by the Congress government in free India.
He became the first Communist Chief Minister, when the Communist Party was elected in the first ever state elections in Kerala in 1957. All the reactionaries, vested interests,communal forces combined together under the leadership of Congress to oust the government, but could not, due to the strong and solid support of the people. In one of the most shameful acts of Prime Minister Jawaharlal Nehru, the EMS Government, which brought many progressive and beneficial acts like land reforms, Education etc. was dismissed.
Along with Com.A.K.Gopalan, the firebrand agitator and leader of the toiling masses, and other legends of the communist movement, Com. EMS strengthened the Communist and working class movement specially in kerala and generally all over the country. During his tenure as the General Secretary of the CPI(M), the party rose to great heights in organisation.
Comrade EMS has written continuously for more than half a century on all matters and the same have been published after his death in 100 big volumes by the Party.
I had the good fortune to meet him several times in connection with the organisation of the central government employees and P and T specially. His inaugural speech in the All india Conference of AITE Union Class III at Trivandrum on 1994, focussing the idea that both the intellectual and manual workers should jointly contribute for the growth of the industry and the working class movement is still in our memory. We have put in to practice by organising and conducting struggle of all the sections of workers in the Forum of BSNL Unions and Associations, in our own sphere. There are many other instances of his guidance and support to the P and T movement, which I am not mentioning here, for brevity’s sake.
On the 16th death anniversary of this great Communist and Working Class leader, we pay our respectful homage and pledge to follow the revolutionary path shown by him.

CITU denounces UPA Govt. for not issuing orders on Minimum Pension of Rs.1,000/-

While the Central Government has issued orders after orders just before the general elections were announced and even has gone to the President for issue of ordinances for the corporates and the big business, it did not find time to issue orders on the Rs. 1,000 Minimum Pension for the EPF Pensioners. The CITU has denounced this discrimination and complete neglect of the working class by the UPA government. The full text of the Press Statement is given below:

New Delhi, March 15: The Centre of Indian Trade Unions denounces the anti-worker bias of the UPA Government which has not yet notified the increase in minimum pension of Rs1000/- under EPF-Pension scheme and enhancement of the ceiling of contribution and coverage which has been unanimously recommended by Central Board of Trustees of Employees Provident Fund Organisation on 5th February 2014 and sent to Government for immediate action on the same.
Demanding enhancement of the minimum-guaranteed pension under EPF scheme, the trade union movement has been agitating since last five years or so. This demand was one of the ten-point demands on which all the Central Trade Unions and National Federations have been conducting countrywide agitations and strikes from 2009. The Government committed to the Central Trade Unions for an early decision on the same in May 2013. Sometimes in third week of January 2014, the Govt came out in public to announce its decision in making a minimum pension under EPF-Pension scheme Rs 1000/- and raising the eligibility wage ceiling to Rs 15000/-. On 5th February 2014, in an urgently called meeting of Central Board of Trustees, the matter was discussed and the CBT made an unanimous recommendation on the same including its date of effect from 1st April 2014. And well before the election was announced on 5th March 2014, the Union Cabinet has reportedly cleared the recommendation for augmenting the minimum pension amount to Rs1000/- and the eligibility wage ceiling to Rs 15000/- by the end of February itself and again announced the same in the media. But unfortunately, no official notification has yet been made and neither the EPF office nor the Labour Ministry could yet throw any light on the fate of that decision.
It is being noticed that the Congress leaders have been making election campaign taking credit on the augmentation of minimum pension. But at the same time it is noted the UPA Ministers are pursuing overtime the Election Commission on behalf of their corporate and Business House partners for allowing them to announce FDI in multi-brand retail trade or increasing the price of natural gas and other decisions of corporate-interests. But any initiative to issue notification on increase in minimum pension amount under EPF-Pension scheme which is going to benefit 27 lakh workers in the lowest strata in particular, is not yet visible exposing the brazen pro-rich bias of the UPA Government.
CITU denounces such an anti-worker bias of the UPA Government and demands upon them to immediately issue notification in that regard on which the decision has already been taken and announced well before the election was announced. CITU calls upon the workers to launch united protest against such anti-worker attitude of the Government.

Strike at L and T at Hazira (Gujarat) reaches three months

The strike by about 1,000 workers in the Hazira Factory (Gujarat) of the Larsen and Toubro, is continuing for 83 days. The main demand is that they should be given wage rise as has been given to the workers in the company’s plant at Powai(Maharashtra). The workers at Powai are getting more basic wages also, they say.

L and T is generally considered as a company with good labour relations. But the present strike has exposed the management’s claim of good labour relations.

Why Narendra Mody’s Government is not intervening in the strike and not getting the issue got settled? This incident once again confirms that the Mody Government is supporting the corporates against the workers.

Govt. considering 50%DA Merger of CG Employees

There are indications that the Central Government may approve merger of 50% DA with pay for the Central government employees. The VII CPC may consider this issue urgently. The V CPC has granted 50% Merger of DA, while the VI CPC maintained silence.
The Confederation of Central Govt. Employees and Workers has gone on strike on 12-13 February with demands including merger of DA with pay.
At present the DA for CGE is 90%. It is expected that another 10% will become due w.e.f. January 2014. In that case, the DA will reach 100%.
The government should consider merger of 100% DA itself.

IBM may cut 15,000 job globally

It seems that a move is starting by the corporates to reduce the manpower due to the recess. It is reported that IBM, a global giant, is proposing to reduce its staff by 15,000.
IBM has got 4 lakhs workers out of which one lakh is in India. The retrenchment may seriously affect the workers engaged in India. The details are yet to be known, including how much IBM proposes to reduce in India.

Central Govt. Employees on two days strike on 11-12 February 2014.

The Central Government Employees will go on a two days strike on 12-13 February 2014 demanding settlement of 15 point Charter of Demands including 50% DA Merger, Interim Relief, Inclusion of Gramin Dak Sevaks in VII CPC, Regularisation and Revision of wages of casual and contract labours, date of effect of VII CPC from 01-01-2014, rescind PFRDA Act etc.
The call has been given by the Confederation of Central Government Employees and Workers, which is the umbrella organisation of the Central Employees’ Unions.
The call for the strike has clearly exposed the central government’s propaganda decision to appoint the VII CPC, in view of the ensuing general elections.
We fully support and convey our solidarity to the central employees in their fully justified strike.
