Kerala High Court observed that Sabarimala welcomed devotees from all faiths and was a symbol of communal harmony. While considering a petition seeking to restrict entry of non-Hindus in Sabarimala temple, the High Court of Kerala orally observed that Sabarimala belonged to all and not just Hindus.

The petition filed by T G Mohandas, Convenor of BJP State Intellectual Cell, contended that non-Hindus and non-idol worshippers cannot be permitted entry on the basis of SC judgment in Indian Young Lawyers’ Association case.

The Division Bench of Justice P R Ramachandra Menon and Justice Devan Ramachandran criticized the tone and tenor of the petition as tending to disrupt secular fabric of society.

The Court observed that Sabarimala welcomed devotees from all faiths and was a symbol of communal harmony. “Even persons without “irumudikettu”-the customary travel pouch carried by devotees containing offerings to Lord Ayyapa-could have “darshan”. The “irumudikkettu” was necessary only to enter temple through the holy 18 steps”, remarked the Court.(Press reports)

Who is Amit Shah to threaten Kerala Government ?

Amit Shah, BJP President, in his speech at Kannur on 27th instant has threatened that the Kerala government will be dismissed if it implements the Supreme Court order on Women’s (those who are above 10 and below 50 years) entry in to Sabarimala. He threatened the courts also stating that they should deliver only judgments which can be implemented.

These utterances are completely a challenge to the freedoms of the courts as also to the democratically elected state government. In the name of devotees, RSS and Sangh Parivar have been indulging in stone throwing, obstruction, attacking people as also attacking the government employees and police who are on duty there. Thousands of goonda elements have been brought to the Sabarimala Shrine premises to create trouble. Now the top leader of BJP has justified all these and is threatening the government, if it takes action against the culprits who destroyed KSRTC buses, other vehicles, attacked the houses of many women who came to visit the temple etc. This is strongly condemned. He has no right to threaten the Kerala government with dismissal.

The leaders of all political parties including Congress and BJP welcomed the Supreme Court  decision on the admission of women in the temple. RSS top leaders also supported. The court order was hailed as historic, restoring the right of the women to worship in the temple, thus restoring the same, which was which was in vogue till 1991 and was stopped as per a High Court order. The then Left Front Government implemented that order and now when the SC cancelled the High Court order, it is also being implemented. THE BJP-RSS-Sangh Parivar which hailed the judgment, are now trying to destabilize the government for implementation of the order of the 5 Constitutional Bench  of the SC. Except a few devotees, who are being misguided, the society as a whole is in support of implementation of the SC decision.

BJP and its president Amit Shah are attacking the highly praised social, secular fabric of the country. This is most condemnable. The people of Kerala will resist and defeat this attack. Seek support of all right minded people.

Delhi air pollution goes up to dangerous levels.

The air pollution in Delhi has gone up all earlier levels and has become very dangerous to the health of the people. People have been advised to reduce use of vehicle as also restrict walking in the mornings etc. A press report in the matter is given below which gives the details:

“New Delhi, Oct 27 :  Delhi’s air quality remained very poor for the fourth day Saturday with five areas of the national capital recording severe pollution levels, as authorities warned the situation may deteriorate further next week due to localised emissions during festival and stubble burning.

The Central Pollution Control Board recorded the overall  Air Quality Index of Delhi at 341. The highest AQI of this season was recorded on Friday at 361.

On Saturday,  five areas in Delhi recorded severe pollution levels. They are Anand Vihar, Dwarka Sector 8, Narela, Punjabi Bagh and Rohini. Punjabi Bagh recorded the highest pollution level in the national capital at 434.

An AQI between 0 and 50 is considered “good”, 51 and 100 “satisfactory”, 101 and 200 “moderate”, 201 and 300 “poor”, 301 and 400 “very poor”, and 401 and 500 “severe”.

According to the data by the Centre-run System of Air Quality Forecasting and Research, the overall air quality index of Delhi would deteriorate in a few days, remaining just points below the severe category.

The CPCB-led task force has recommended stringent measures from November 1 to 10, predicting further deterioration in the air quality ahead of Diwali.

Some of these recommendations include shut down of coal and biomass factories, intensification of inspection by transport department to check polluting vehicles and control traffic congestion in Delhi-NCR during November 1-10.

Authorities have issued an advisory, asking people to avoid outdoor strenuous activities and minimise use of private vehicles”.

China Builds the longest sea bridge in the world – India builds the biggest statue for the same amount.

Chinese President Xi Jinping on Tuesday officially opened the world’s longest sea bridge linking Hong Kong, Macau and mainland China, significantly cutting the travel time from between the three territories from three hours to just 30 minutes.

The 55-km-long crossing that cost a whopping USD 20 billion is dubbed as an engineering feat carrying economic and political significance at a time when Beijing is seen tightening its grip over its semi-autonomous territories.

It connects Asia’s financial hub, Hong Kong, with the southern mainland city of Zhuhai and the gambling enclave of Macau, across the waters of the Pearl River Estuary with a snaking road bridge and underwater tunnel.

It took nine years to complete the bridge due to delays, budget overruns, corruption prosecutions and the deaths of construction workers.

President Xi inaugurated the bridge at a special ceremony held in Zhuhai, in southern China’s Guangdong Province, attended by about 700 guests, including the leaders of Hong Kong and Macau.

Top CBI officers removed from posts – Opposition alleges foul play

We had earlier posted the news that CBI Director Alok Verma starting proceedings against CBI Special Director Rakesh Asthana on corruption charges. Now, in the midnight of yesterday the Prime Minister held an urgent meeting and removed Director Alok Verma from the post and posted Nageswar Rao as the new Director. Asthana has been asked to go on leave. The new Director had taken charge in the night itself and transferred the officer to Andaman and Nicobar Islands who was asked to enquire in to the corruption case of Asthana!

Modi Government is being severely criticised by opposition parties stating that these steps are taken to save Rakesh Asthana from the corruption charges. Asthana is an officer of the Gujarat cadre and is very close to Modi and BJP President Amit Shah.

Alok Verma has already approached the Supreme Court against his removal.

Journalist demand action against Minister M.J.Akbar on sexual harassment.

New Delhi, October 15 : We the undersigned journalist organisations have been deeply concerned over the overwhelming complaints of sexual harassment in the media. We recognize that sexual harassment at the workplace is a worrisome reality and that media organisations and managements have been unable to put the systems in place which would have ordinarily addressed complaints of sexual harassment.

We are also deeply disappointed at the statement issued by Mr M J Akbar, Minister of State in the Ministry of External Affairs. wherein he has threatened legal action against all those who have alleged they were harassed by him. Mr. Akbar is a senior functionary of the government and his response should reflect the responsibility that is thus bestowed on him. There can be no dispute about the need for an impartial probe into all the complaints without fear of threat or intimidation to the complainants – and this acquires particular significance if one of the accused is an influential minister in the government. In the interests of a fair probe, moral and public propriety, it would only be appropriate that the minister step down from his post till such time as the inquiry is completed. We are disappointed that Mr. Akbar did not choose to take this step instead of threatening the complainants with legal action.

An impartial probe should be conducted into all the complaints without fear of threat or intimidation to the complainants more so as the accused party is an influential minister in the present government. We also feel that in the interests of a fair probe, moral and public propriety, it is only proper and appropriate that the minister step down from his post till as such time the probe is completed.

Sexual harassment at the workplace is a pervasive phenomenon. It has continued with impunity despite the enactment of a tough law to prevent, prohibit and redress it, The inability of women to speak out about such harassment needs serious introspection and redress. We hope that employers in media organisations and the government will look into this with the seriousness it deserves and not treat the incidents as motivated complaints.

Tripura BJP government cheated the state employees.

During the state elections in Tripura, BJP promised that the VII Central Pay Commissions recommendations will be implemented for the state employees. But the new BJP government did not implement the same and cheated its own employees. The Tripura state employees also has learnt from their own experience that the BJP government is in the habit of not fulfilling their election promises. The four year period of the central government also is guilty of non-fulfilling of its election promises like 8 lakh job every year, support price for the kisans, Ganga cleaning, Beti bachao and many other issues. This government has broken all records in going back on its promises. Of course, people are waiting for the next election to give a suitable reply to the BJP.

GPF Interest Rate increased to 8 Percent from October 2018

GPF interest rate for last three quarters remained stationary at 7.6% and now it has been increased to 8% from October 2018 to December 2018. The Finance Minisry has issued orders to this effect.

India at 147 of 157 countries in commitment to reducing inequality – a shame indeed.

India fared poorly, ranking 147 out of 157 countries, in terms of its commitment to reducing inequality, while Denmark topped the list, a report said Tuesday.

According to the Commitment to Reducing Inequality Index developed by Oxfam and Development Finance International, Nigeria, Singapore, India and Argentina are among a group of governments that are fuelling inequality.

The index ranks 157 countries on their policies on social spending, tax, and labour rights.

As per the report, countries such as South Korea, Namibia and Uruguay are taking strong steps to reduce inequality. However, countries like India and Nigeria did very badly.

Among rich countries, USA showed a lack of commitment towards closing the inequality gap.

In terms of its ranking across specific pillars this year, India was placed 151st on the index for public spending for healthcare, education and social protection, 141st for labour rights and wages, and 50th on taxation policies.

Regionally, India ranks sixth among the eight South Asian nations. On public spending and on labour rights it ranks sixth, but India is placed on the top in terms of progressiveness of tax policy.

Other countries in the top ten include Germany (2nd), Finland (3rd), Austria (4th), Norway (5th), Belgium (6th), Sweden (7th), France (8th), Iceland (9th) and Luxembourg (10th). (A report from PTI)

INDIA PENSION SCANDAL – Article by Prabhat Patnaik

Incredible as it may seem, the union government of India provides a pension to the elderly which amounts to an absurd sum of Rs 200 each per month, and even for accessing this the beneficiary must belong to the BPL population which, as is well-known, is notoriously underestimated. True, the state governments add something to this amount, but, their resources being meagre, the additions cannot be large. What is more, this figure of Rs 200 has remained unchanged since 2006-07; even the elementary courtesy of indexing it to inflation has not been accorded to the elderly.

This is truly a scandalous state of affairs, not just because the sum is laughably paltry, the beneficiary list absurdly truncated, and even elementary protection against inflation missing, but above all because of what it reveals about the government’s attitude. This attitude sees the payment of pension as a largesse on the part of the State, an act of charity towards a set of mendicants. But an adequate old-age pension is actually a right. It is a right not just in an abstract “ought”-sense, but in the concrete sense of being an integral part of the social philosophy which underlay India’s anti-colonial struggle and upon which the Indian constitution is founded.

This philosophy which the Left has always espoused holds that the plight of an individual in society is determined by the social arrangement within which he or she lives. For instance unlike the colonialists of the pre-independence era who attributed the misery of the Indian people to their “laziness”, or lack of enterprise, or subservience to tradition, the anti-colonial struggle advanced the proposition that it was the colonial arrangement that caused the abject poverty afflicting India, whence it followed that this arrangement had to be altered by overthrowing colonial rule and erecting an alternative social arrangement that would guarantee a minimum standard of life to every Indian. The Karachi Congress Resolution in 1931, which outlined what free India would look like, held out this promise, among others. The mass participation in the freedom struggle that occurred in the 1930s was fired by this promise, which thus became a sort of “freedom charter”, upon which the new nation was founded. It acted as a precursor to the constitution.

Even though the constitution did not explicitly codify a set of fundamental economic rights, as it codified a set of fundamental political rights, the former cannot just be wished away, both because they form part of the “freedom charter” underlying the new nation, and also because the latter cannot be enjoyed without the citizen also enjoying a set of de facto economic rights. The assertion of one’s role as a citizen in a democracy cannot occur unless one enjoys a degree of economic security. Hence even though economic rights are not codified as such in the constitution, they are implicit and as fundamental as the explicitly-codified fundamental rights.

Adequate pension to the elderly is one such economic right. It is inherent in the promise underlying the constitution of free India which is visualised as a fraternity of equal citizens. Within this fraternity of equal citizens, nobody is doing anyone else a favour by accepting a legitimate demand for a minimum livelihood.

If adequate pension is an economic right, then it must be universal, like the fundamental political rights enjoyed by all. The pension scheme cannot be either contributory or means-related. It cannot be targeted, not just because any targeting invariably leaves out many deserving beneficiaries, but, more importantly, because it violates the principle of universality that must characterise all rights of citizens. To be sure, in fixing the amount of pension, the fact that a person is already drawing a pension from some other source must be taken into account; and once deduction is made on that score some will automatically get excluded or drop out, but that does not amount to an infringement on a person’s right. Likewise the pension paid by the State to every elderly person as a right must have nothing to do with any contribution from the person concerned. If someone is part of some other contributory pension scheme, he or she may opt out of the State-funded pension, or the pension amount may be suitably adjusted to prevent double benefits; but State-funded pension must be a right for every person, and it must be financed by budgetary sources, unrelated to any contribution from the beneficiary.

The provision of a laughable pittance as pension, as is the current state of affairs, is therefore a violation of the spirit of the Indian constitution, a throwback to feudal times when rulers occasionally showed kindness to the ruled by bestowing favours upon them, of the sort that our governments think they are doing in providing a pittance for a pension.

The Pension Parishad, a network of several groups, organised a dharna in Delhi on September 30 and October 1 to demand an adequate universal rights-based pension. The principle enunciated by the Pension Parishad is that the amount should be half the minimum wage, but in concrete terms the demand was for a pension of Rs 3000 per person per month. The Pension Parishad has organised a similar dharna in 2012 when the demand had been for a universal pension of Rs 2000 per month. Taking into account the price-rise in the interim, the current demand of Rs 3000 is roughly equivalent to the demand of Rs 2000 at that time.

The appropriateness of this figure can be seen from a different angle. Since poverty in India is defined in terms of a daily calorie-intake norm, namely 2100 calories per person per day in urban India and 2200 calories in rural India, the monthly per capita expenditure at which the calorie intake just met these norms could be taken as the pension amount. NSS data from quinquennial consumer expenditure surveys were used to determine these cut-off levels, and, expressed at prevailing prices, they came, in round numbers, as a weighted average between urban and rural areas, to Rs 2000 per month in 2012, which would work-out to around Rs 3000 today.

The number of potential beneficiaries was estimated by the Parishad in 2012 to be around 8 crores, which by now might have increased to about 10 crores. The annual amount required for providing old-age pensions at Rs 3000 per month to these beneficiaries would therefore come to Rs 3.6 lakh crores; allowing for a 5 percent deduction on account of voluntary drop-outs, what is required is just about 2 percent of the country’s current GDP for financing a universal rights-based pension plan.

The question often raised against such a plan is that the country cannot afford this amount. But 2 percent of GDP, it should be noted, is less than a third of the annual increment that occurs in GDP at present. The provision of this amount of pension, if it is financed through taxes paid out of incomes, would not imply any decline in the average post-tax income of the non-pensioners compared to the preceding year. On the contrary it would still mean that compared to the preceding year their per capita post-tax income would increase by about 3 percent. The payment of pensions on this scale therefore does not require any absolute sacrifice by the non-pensioners compared to the preceding year, only a smaller increase in income than would have occurred otherwise. Nobody in short needs to be squeezed in absolute terms for paying out pensions that provide a minimum living standard to the elderly.

We have assumed above that pensions would be paid out of taxes on incomes; but this is unnecessary. A Tobin Tax on currency transactions, or an increase in the existing tax-rate on stock market transactions, or a straightforward wealth tax would be a far more appropriate way of raising resources for pensions, since it would simultaneously serve other purposes such as curbing speculation or reducing wealth inequality. In fact if we assume, somewhat conservatively, that private wealth amounts to four times the GDP, and that the top 1 percent of households in India owns 62 percent of the total private wealth, then a mere 0.8 percent tax on the wealth of just the top 1 percent of households would be quite enough to finance a universal rights-based old-age pension scheme providing minimum benefits. India’s pension scandal can thus be ended quite easily; why it persists is not any shortage of resources but sheer class-antagonism, since the overwhelming bulk of potential beneficiaries are, or would have been, workers, artisans, craftsmen, peasants, and agricultural labourers.
