Rejuvenation of BSNL, MTNL a must for the nation

The last two- three decades have seen how the central government, whether BJP or Congress,  has tried to destroy BSNL and MTNL, the government telecom companies in favour of the private companies. In this process huge corruption by the concerned ministers and government has been exposed. As  a senior politician has stated, there is not a single Communications Minister who can be stated clean in this matter.

Each and every opportunity was utilised by the rulers to support and favour the private companies and discriminate the PSUs, BSNL and MTNL. While almost all other PSUs were formed within the first three decades after Independence with the objective of creating a base of for the infrastructure for development, MTNL and BSNL was formed to privatise the communication sector and hand over the same completely to the corporates. It was only through the Tough resistance from the workers and their unions, that the privatisation move of BSNL and MTNL by the government could not succeed. While government managed to disinvest and impose VRS through clever moves in MTNL, it could not succeed in BSNL due to the heroic  struggles by the united workforce.

The General Elections are due within a few months. A charter on the issues of BSNL and MTNL workers are to be prepared and presented to the political parties for their support. It need not be limited to the telecom PSUs only. All the 240 or so central PSUs are facing similar attack and the CPSTU can focus the same. The General Strike for 48 hours (2 days) on 8th and 9th January 2019 has focussed the issue in the Charter of Demands. It has to be propagated effectively amongst the workers and the people.

Along with defending the PSUs, it should also be the target to improve the services. While fighting for their own rights, the workers have the responsibility to provide better service to the people, the customers. Much have improved, but but much more is to be done.

The ‘Do and Die’ should not only be on the demands of the workers, but also on for the service to be provided to the people. IT IS NOT ONLY TO GET THE SUPPORT OF THE PEOPLE, BUT IS PART OF THE DUTY OF THE WORKERS TO THE NATION.

Pensioners and outsiders as office bearers of workers’ Unions / Associations?

A question has been raised by some comrades/friends that what is the necessity of pensioners/outsiders being elected as office-bearers of workers’ unions and associations in central government establishments, PSUs etc.? Is it not against the interest of the workers? Is it not denying the workers their legitimate right to lead their own organisations? Some other connected questions are also being raised.

The principle that the workers themselves should be the leaders of their organisations is correct and not wrong. Then why, most of the unions/associations are having retirees/outsiders as leaders of the movement.

It has got historical and practical reasons. Take for example the case of central government employees. The first to be organised in India were the Railway as also Posts and Telegraph workers. The pioneers of the P and T trade union movement like Tarapada Mukherjee, Henry Barton, Dada Ghosh, K.G.Bose and others were all either removed / dismissed from service, jailed, punished for their trade union activities. V.G.Dalvi, who organised the Postmen in 1919 was an Advocate, who could not be departmentally punished for his trade union activities. Secondly electing office bearers from outside trade union leaders, including M.P.s, gave the benefit that the employees issues could be directly raised in the Parliament etc.Hence since 1946, and especially after 1954 when NFPTE was formed, NFPTE itself and most of its affiliated unions elected sitting M.P.s as their President and sometimes other office-bearers also. This gave much benefits to the workers in raising their demands with the government and fighting against victimisation after the 1960, 1968 strikes etc. when lakhs of workers were victimised and sent out of service. The marathon discussions in Parliament on the issues of the P and T workers, victimisation etc is a shining example. This was the case with Railway Unions also. In the NFPE and NFTE, this system continued till the 1990s, when the Central government issued new recognition rules under which no retired employee could function as office bearer of the service unions. Due to strict implementation of the rule, on retirement, the office-bearer became a non-office-bearer. The union had to elect a working employee to the post.

In the PSU unions, not only pensioners but outsiders are also allowed to be office-bearers. Outsiders can be elected to the extend of 33% of office-bearers. Pensioners are included in the category of workers and can be elected without any limit. In the private establishments, usually some of the leaders are from central trade unions only so that they are always in the mainstream of workers. They have full trade union rights, unlike government employees.

Retired leaders are elected as office bearers since the workers feel that their past experience in the trade union movement or service unions enable them to lead the movement better. Some are reelected even after retirement for respect for their past service. It is due to this that a small percentage of retired workers continue to lead the organisations.

Ultimately, it is the workers who decide that who are to be the office-bearers of the union. Nobody needs to have any grudge when the conferences democratically elect the retired employee or outsiders as office bearers. However, restricting the number to the minimum is always preferred since that will enable the workers themselves to lead their organisations and decide their own destiny.

A further question is raised by some friends. Whether any worker can be elected as office-bearer of the pensioners’ unions/associations? Personally I am for this idea that young and energetic workers can be elected as office-bearers who can help a lot. In fact, in most of the government departments and PSUs, the pensioner organisations have been formed with the help of the unions of workers. In BSNL, the workers organisation BSNLEU took initiative in forming the pensioners association, AIBDPA.

Sub: – Notice for General Strike on 8th and 9th January, 2019 – reg.

In accordance with the provisions of sub para (1) of section 22 of the Industrial Disputes Act, 1947, it is hereby notified
that the BSNL employees will join the General Strike, being organised on 8th and 9th January, 2019, on the following
charter of demands.

Demands:
1) Urgent measures for containing price-rise through universalisation of public distribution system and
banning speculative trade in commodity market.
2) Containing unemployment through concrete measures for employment generation.
3) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive
measures for violation of labour laws.
4) Universal social security cover for all workers.
5) Minimum wages of not less than Rs 18,000/- per month with provisions of indexation.
6) Assured enhanced pension not less than Rs.3,000/- p.m. for the entire working population.
7) Stoppage of disinvestment in Central/State PSUs and strategic sale.
8) Stoppage of contractorisation in permanent perennial work and payment of same wage and benefits for
contract workers as regular workers for same and similar work.
9) Removal of all ceilings on payment and eligibility of bonus, provident fund; increase the quantum of
gratuity.
10) Compulsory registration of trade unions within a period of 45 days from the date of submitting application;
and immediate ratification of ILO Conventions C 87 and C 98
11) Against Labour Law Amendments
12) Against FDI in Railways, Insurance and Defence

Resolution adopted in the 9th All India Conference of BSNLEU,
on Pension Revision for BSNL Retirees.

This 9th All India Conference of BSNL Employees Union held at Mysuru from 17th to 20th 2018 welcomes
the assurance given by the Honorable Minister for Communications, Sri Manoj Sinha, on 3.12.2018 in
the meeting held by him with AUAB (All Unions and Associations of BSNL), for delinking pension
revision for the BSNL pensioners from pay revision of serving employees . This Conference demands for
immediate approval for this delinking.
This Conference further demands that the pension revision be done for the BSNL Pensioners from
1.1.2017 as well as those retired after 1.1.2017, on the basis of 15% increase on basic pension plus
119.8% DA , on par with the IDA Pay Revision ordered by DPE on the basis of 3rd PRC
recommendation.
This Conference demands the DoT and Government of India for automatic revision of pension on the
basis the highest fitment benefit granted in IDA pay revision for executives in future also.

The govt. should issue orders without delay for pension contribution on actual pay.

One of the major item resulting in financial crisis for BSNL is the arbitrary decision of the government to collect pension contribution of the BSNL absorbed DOT employees on the basis of the maximum of the pay scale, instead of the actual pay. After the threat of strike by AUAB and discussion with the Communications Minister on 3rd December with the AUAB, it was agreed that decision will be taken to collect the pension contribution on the actual pay.

Almost 20 days are over after the agreement. The DOT should issue necessary orders without further delay. Further, the government should also take decision to refund the excess amount already collected till date. This will help in restoring the financial position of BSNL.

BSNL to raise loans of Rs.12,000 crore from PSUs

Financial Chronicle has reported that BSNL is preparing to take Rs. 12,000 crores from PSUs. The full report is given below:

“State run BSNL is in the process of raising Rs 12,000 crore as loans from few public sector banks including Bank of Baroda in tranches to fund its huge operational maintenance expenditure as its services revenues dry up and internal accruals are used for network expenses, sources said.

But most importantly, it will have to raise the money without the Department of Telecom’s Letter of Comfort (LoC) which usually is available to PSUs from their nodal ministries for bank loans to be able to raise the funds at a lower rate of interest. But without it, BSNL will have to pay the higher commercial market rate of interest for the loans after DoT declined its request for an LoC, said a source privy to the development.

Bank of Baroda is said to be one of the key banks with whom BSNL will be raising major part of the amount.

However, the BSNL management refused to reveal any information while BoB had not responded the queries till the paper went to press.

BSNL operates all over India mainly in hinterlands sans key metros of Delhi and Mumbai. The PSU reeling under huge wage bill, legacy networks and severe competition more so after 2016 September with Jio’s entry is awaiting 4G spectrum allocations from the government which it has sought through recapitalisation via equity route. The expenditure this 4G allocation will be of the tune of Rs 6,500 crore on the finance ministry. North Block is yet to approve of this 4G spectrum fund allocation and the process is stuck still in inter-ministerial consultations killing precious time for the PSU for survival.

But the sources explained that even though fund will be raised on the market rates, the loans may not burden its present debt level, which is at Rs 13,000 crore on a top line of around Rs 27,500 crore where as the other two top players — Airtel has a debt of Rs 94,000 crore and Vodafone-Idea has Rs 1.15 lakh crore. Even with this loan, still BSNL will be the least leveraged telco in the present competitive scenario. It meets its huge wage bill of Rs 16,000 crore a year through its internal revenue generation and other expenditures are also met by its own service revenues which though is witnessing a gradual decline and expected to shore up once it is given 4G spectrum.

The government has not given BSNL the 4G spectrum to match competition and at the same time we are surviving even in this hyper competition time without a key service (4G) in our portfolio as Jio goes on giving cheap services with its financial muscle. The amount of Rs 12,000 crore will be raised in tranches for meeting the operational maintenance and some amount could be raised by the end of this month for the same, said the sources.

In June this year, the PSU had decided to borrow Rs 4,300 crore in the current financial year to fund capital expenditure plans. The PSU is also seeking its dues amounting to Rs 2,400 crore from its services from BharatNet, LWE networks and NFS projects from DoT which if comes will also help the PSU meet some of its immediate expenditures.

BSNL which was declared along with MTNL as an ‘incipient sick unit’ by the DPE has seen some of the worst times recently particularly after Jio’s entry along with other telcos. Its loss has widened to Rs 7,992 crore in 2017-18 nearly doubling from a loss of Rs 4,793 crore in 2016-17.”

Organise massive rallies on 14th November 2018 – AUAB

Organise 14th November rallies massively, and as preparatory to the forthcoming strike.
As per the call of the AUAB, massive rallies are to be organised on 14.11.2018, demanding implementation of the assurances given by the Hon’ble Minister of State for Communications, in the meeting held with the AUAB on 24.02.2018, on the issues of 3rd pay revision, pension revision, allotment of 4G spectrum and payment of pension contribution on the actual basic pay. It must be specifically noted that, in the meeting held on 02.11.2018, between the AUAB and the Secretary, Telecom, not much progress was seen in the main demand of 3rd Pay Revision. In this connection, all leaders and comrades are requested to make note that, the AUAB has already informed the Secretary, Telecom, that, strike would be organised if the demands are not settled by 30.11.2018. Hence, all circle and district unions are requested to take every step to ensure the total participation of the Non-Executives and Executives, in the rallies to be held on 14.11.2018. It is also requested to display maximum number of banners, flex boards, etc., to attract the attention of the general public to our demands, most importantly issues related to allotment of 4G spectrum, the pro-private policies of the government, financial revival of BSNL, etc.

CEC BSNLEU calls for Struggle

Non-implementation of the assurances of the Hon’ble MoS(C) – CEC meeting of BSNLEU calls upon the employees to get prepared for strike action, including an indefinite strike.
Non-implementation of the assurances of the Hon’ble MoS(C), on wage revision, allotment of 4G spectrum, pension revision and payment of pension contribution on actual basic pay, was seriously discussed in the CEC meeting of BSNLEU, held at Ghaziabad on 22nd & 23rd October, 2018. Since Parliament elections are approaching fast, time left with us for the settlement of wage revision, is running out. In view of this the CEC meeting has called upon the BSNL employees to massively organise the agitational programme called on by the AUAB, and also prepare the employees for strike action, including an indefinite strike. 21st October 2018, the 9th Foundation anniversary of All India BSNL DOT Pensioners Association (AIBDPA), was celebrated all over the country with massive rallies, meetings, speeches etc. The achievements of the organisation for the pensioners, the present demands, the present situation where even the settled issues of pensioners are not being implemented, Pension Revision and other issues were discussed in the meetings. The rallies demanded the central government to order Pension Revision with out any further delay.

Staff in BSNL reduced from 3.5 lakhs in 2000 to 1.74 lakhs in 2018

Due to non-recruitment of required staff and non-filling up of vacancies, the staff strength has ben reduced from 3.5 lakhs in 2000 to 1,74,216 in 2018. More than 2 lakh employees have retired during this period, but only about 40,000 have been recruited. The recruitment has been mainly in the cadres of JTO and JEs.

The average age of the employees have gone more than 52% according to reports. Within 10 years, almost all the employees recruited in DOT will be retired. If no further regular recruitment takes place, the staff will be reduced to about 1.20 lakh by that time. Even now many works which were being done by the employees are outsourced spending much and getting little benefit and revenue. For improvement of services much more staff are required.

The BSNL management and the government as also the Unions/associations have to seriously ponder over the issue and take necessary decision to recruit more employees. The recruitment can be in 2 ways: 1) Regularise all the contract workers who have completed ten years service or so. The casual workers should be regulrised as before. 2) Direct recruitment. This will help the services.
