The first meeting between the union Labour Minister, Shri Narendra Singh Tomar with the central trade unions was held on 24th June 2014 at Shram Shakti Bhawan, New Delhi. The Minister of State for Labour, Shri Vishnudeo Sai along with Labour Secretary, Chief Labour Commissioner(central)Central Provident Fund Commissioner, Financial Commissioner, ESIC and other labour department officials were also present in the meeting.
Leadership of all the central trade unions spoke in one voice urging upon the Labour Minister for a directional change in approach and policy so that the legitimate interests of working people who produce wealth for the nation, resources for the exchequer and also profit for the employers are protected and taken care of and also the interests of the national economy and the national assets and resources are harnessed for the benefit of the majority of the populace. Trade unions conveyed their strong opposition to the policy of opening up all sectors to 100% FDI, reckless deregulation of strategic sectors and natural resources of the economy including the financial sector, aggressive disinvestment of PSUs and privatization of crucial public utility services etc. Resentment was also conveyed on the steep hike in railway fares and freight charges through executive order which would further aggravate the already rising prices of essential commodities. Central Trade Unions were represented by B N Rai and Shri Sharma (BMS), G Sanjeeva Reddy and Ashok Singh (INTUC), Amarjeet Kaur and D L Sachdeva (AITUC), Harbhajan Singh Sidhu and B D Nagpal (HMS), Tapan Sen and A K Padmanabhan (CITU), Krishna Chakraborty and R K Sharma (AIUTUC), S P Tewari (TUCC), Rajib Dimri and Santosh Roy (AICCTU), Abani Roy (UTUC), Monali (SEWA), S Shammugham (LPF) etc.
As opening comment, the Labour Secretary, Smt Gauri Kumar stressed upon strengthening tripartism as the most crucial instrument for addressing the problems of labour as well as maintaining industrial harmony and peace for facilitating productive growth of the economy on the path of employment generation. In response, the trade unions pointed out that for strengthening effective tripartism, the Govts, both at the centre and in the states must refrain from any kind of unilateralism and one-sided approach on matters involving and affecting the workers and employers must be made to implement all the labour laws in true spirit. Trade Unions pointed to the recent unilateral move by the state government in Rajasthan to amend vital labour laws in favour of the employers which was resolutely opposed by all the trade unions in the state. It was also pointed out that the central govt also has been taking hurried steps to push through major amendments to number of principal labour statutes viz., Factories Act, Minimum Wages Act and Child Labour Act etc affecting the workers.
The Central Trade Unions pointed out that if the spirit of tripartism is to be upheld and strengthened, then all the consensus recommendations of the highest tripartite forum in the country, the Indian Labour Conference must be implemented in letter and spirit. The successive sessions of Indian Labour Conference, viz., 42nd, 43rd, 44th and 45th sessions of ILC have drawn conclusions through consensus in respect of major issues pertaining the workers like upward revision of minimum wage, universal social security including pension, granting recognition as workers with attendant benefits of statutory wage and social security to the entire workforce in all central govt schemes viz., Anganwadi, mid-day-meal, ASHA, Sarv-siksha aviyan etc and same wage for same and similar work for contract
workers etc. But nothing has been done by the Govt in this regard. This Govt must implement those consensus recommendations.
The trade unions urged upon the Minister to take serious note of the most volatile situation emerging at the workplaces throughout the country owing to mass scale violation of all basic labour laws and most ineffective, rather indulgent role of the enforcement machinery in favour of the law-violating employers’ class. In fact the law enforcement machinery of the labour department both in centres and the states are being deliberately and continuously weakened with huge vacancies of inspectors, other officials and even judges in labour courts piling up, to create ground for such non-enforcement-all aimed at the benefits of the employers class. The incidence of Maruti-Suzuki at Manesar, Haryana, virtual closure of Nokia plant at Tamilnadu, closure of Hind Motor, Jessop and Duckback and shut-downs in number of Jute Mills in West Bengal are the examples of such indulgence by administration to violation of labour laws on the one hand and outcome of the faulty policies of the Govt on the other. It is the basic duty of any Govt in a civilized society to ensure rule of law in workplaces instead of indulging in anarchy by the employers, the trade unions asserted.
The trade unions reiterated before the Labour Minister their ten point demands on which they have been agitating since last five years in various ways including strikes and urged upon the Govt to expeditiously act in sorting out those bottom-line demands, on many of which there had already been consensus in tripartite ILC. The trade unions also demanded immediate action on increasing the minimum pension to Rs 1000/- under Employees’ Pension Scheme and raising the ceiling on provident Fund Scheme to Rs 15000/- on which decision had already been finalized by the previous government.
The Labour Minister while thanking the trade union representatives for the valuable inputs given by them on labour matters, assured that the Govt would accord due consideration to the demands of the trade unions. He also conveyed that on the issue of increase in minimum pension and also raising the ceiling on provident fund scheme to Rs 15000/-, decision will be taken by the Govt within two weeks time. Labour Minister also stated that his ministry’s priority will be to protect the interests of workers and he sought cooperation and help from all the central trade unions. (Courtesy: CITU)

National Convention by Central Trade Unions

The 11 Central Trade Unions have decided to hold a National Convention of Workers at Mavlankar Hall, New Delhi, on 6th August 2013 as part of its agitational programme on the 10 points demands already raised earlier and on which 48 hours strike was organised on 20-21 February this year. Though the Prime Minister Manmohan Singh has stated that the demands are ‘unexceptionable’, no action to settle the demands has been taken by the government. Unless the government is given a big jolt, it will not accept any demands of the workers, while it has no difficulty in favouring the MNCs and corporates with all their demands. Of course, it is becoming the ‘Government of the corporates’ instead of a government of the people.

Programmes of Action by Central TUs

 The Joint meeting of Central Trade Unions held on 8th July 2013 at BMS office, New Delhi has decided the following course of joint mobilization/agitations and activities

National Convention of Trade     Unions on 6th August 2013 at Mavalankar Hall, New Delhi

  1. State     level and district level rallies/agitations/demonstrations/jail bharo etc     during last week of September 2013
  2. March/demonstration     before Parliament in the month of December during Parliament session.
  3. In     various sectors like Coal, Telecom, Banks & Insurance, Transport,     Power, Port & Dock etc, joint struggles/strikes are being     planned/undertaken by the respective federations. All support should be     extended to those struggles. Central Trade Unions should also jointly endeavour     to develop sectoral struggles in various sectors.
  4. Dates and details of programmes in September and December will be finalized through joint consultation of Central Trade Unions and announced from the National Convention.

You are requested to please ensure participation of your organization in the National Convention of Trade Unions to be held on 6th August 2013 at Mavalankar Hall, New Delhi as on all previous occasions.

Central TUs write to Prime Minister on Minimum Wage and other Demands

The 11 Central trade Unions which called for the 48 hours strike focussing the 10 demands they have raised have written to the Prime Minister on 23rd May 2013 seeking his intervention for settling the issues raised by them.

The Group of Ministers (GoM) headed by Defence Minister A.K.Antony, met with the Central Trade Union leaders on 22nd May, in which the leaders focussed the main issues of the strike as also pointed out in the 45th Session of the Indian Labour Conference (ILC) in which the Prime Minister was also present.

In the letter to PM, the CTUs stated:

” On being urged by the Central Trade Unions for concrete response on some of the demands like Minimum Wages of not less than Rs. 10,000, universal social security cover to all workers, assured pension for the entire working population, same wage for same work as regular workers for the contract workers in the respective ministry/establishments, concrete programmes for implementation of labour laws etc. Chairman of the meeting conveyed on behalf of the Group of Ministers that some time is needed for internal discussion and hey will revert back to the trade unions shortly within a month’s time.

“We like to impress upon you that all Central Trade Unions  in the country have been jointly pressing for these demands in the last three years or so through numerous memorandums and various programmes observed jointly throughout the country.

“In the context of the step for bipartite discussion with the Central Trade Unions already initiated  by you, we urge upon your effective intervention so that these long pending just demands of the workers are sorted out through dialogue with the forum constituted by you within a month’s time as urged upon by the concerned GoM, in the interests of the working people and the nation.”

While the central government is very quick to resolve even the unjustified demands of the corporates by modifying the Tax rules, why it is taking so much time for settling the just demands of the working class raised by them and on which about 12crores workers have gone on strike for 48 hours?

NATIONAL CONVENTION OF WORKERS AT NEW DELHI

The National Convention of Workers organised under the auspices of the 11 Central Trade Unions at Talkatora Stadium, New Delhi on 4th September 2012 has chalked out agitational programmes including a two-days General Strike on 20th and 21st February 2013.

The Talkatora Stadium was filled up and was overflowing to outside the stadium by the massive participation of workers who have come from all the states, especially from the nearby  Haryana, Rajasthan, UP, Bihar, Punjab etc. More than 5,000 delegates must have attended. The entire compound and the outside of the stadium was decorated and there were large number of flags  and banners of the Central Trade Unions and the various Independent federations of workers in various sectors like Central-State governments, Postal, BSNL, Banks, Electricity, Coal, Transport, Insurance etc.

A big colourful banner was displayed in the back of the decorated stage with the name of the convention and of the Central Trade Unions. The Presidium consisting of the Presidents or senior leaders of each central trade union sat in the front row. It included Coms. A.K.Padmanabhan (CITU), Amarjit Kaur (AITUC) and others. The General Secretaries and other senior leaders sat in the second row.

The Convention was addressed by  Shri  Baidya Nath Rai, General Secretary, BMS, Dr. Sanjeeva Reddy, General Secretary, INTUC, Com. Gurudas Dasgupta, GS AITUC, Com. Tapan Sen, GS CITU and other leaders. All of them strongly opposed the anti-worker policies of the government and called upon the workers to continue the struggle against the neo-liberal policies which is causing more and more misery to the toiling masses. They impressed upon the workers the need for complete unity amongst the workers, not only at the leadership level but at all levels. Each speaker was enthusiastically applauded by the house by clapping of hands.

After the speeches were over, the Presidium moved the Resolution on programmes, which was already circulated to the delegates.  The Resolution cited the various agitational programme conducted earlier on the demands raised by the CTUs and the good support received from the workers at all levels. It was reported that more than 10 crore workers participated in the last one day strike organised on 28th February 2012.  The following demands were reiterated in the resolution:

Demands:

1)    Contract measures to contain price rise. 2). Concrete measures for employment generation. 3) Strict enforcement of Labour Laws. 4) Universal social security cover for organised and unorganised workers and creation of National Security Fund and 5) Stoppage of disinvestment in Central PSUs and undertakings.

On the above issues, the Convention demanded immediate action by the Government of India to ensure:

  • No Contractorisation of work of permanent /perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry / establishment.
  • Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs. 10,000 linked with cost price index.
  • Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.
  • Assured Pension for all.
  • Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions Nos. 87 and 98.

The National convention also adopted the following action programme to press for once again the above burning issues facing the working people:

1.     State/District/Sector level Joint Conventions during September, October and November 2012.

2.     Satyagraha, Jail Bharao/Court Arrest on 18th / 19th December 2012 in all states throughout the country.

3.     March to Parliament of 20th December 2012 ( mobilisation by the unions from the states adjoining Delhi)

4.     Countrywide Two Days General Strike on 20th and 21st February 2013.

 The resolution was supported/signed  by BMS, INTUC, AITUC, CITU, HMS, AIUTUC, TUCC, AICCTU, UTUC, LPF,  SEWA  and Independent Federations of Workers and Employees.

The programmes should be effectively organised and there should be maximum propaganda.

The National Convention was not only a show of strength and Unity but also one more historical milestone in the fight for the cause of the workers.
