Circle Executive Committee Meeting and Demonstration by Karnataka Non-Permanent Workers Union

The extended meeting of the Karnataka State  BSNL Non-Permanent Workers Union, affiliated to BSNLCCWF and CITU was held at Conference Hall at  Bengaluru on 08-11-2016. About 200 comrades including a good number of women participated. Com. C.K.Gundanna, Circle President, KNPW Union and Circle Secretary, BSNLEU presided. Comrade Mahantesh, General Secretary Non-Permanent Workers union welcomed all and explained the issues to be discussed. Com. Gundanna , President gave the guidelines for the discussion. In his inaugural speech Com.V.A.N.Namboodiri, All india President, BSNLCCWF, briefed the house about the decisions taken in the meeting of the Central Secretariat held on 26-10-2016, including the decision to organise a Parliament March on 22-02-2017 on the Charter of demands placed by the Federation. He congratulated the Karnataka workers for their struggles for ensuring minimum wage etc. Comrades M.C.Balakrishna, Org. Secretary BSNLEU, Balaji, Shanbag, CITU, Sudershan, Dist. Secretary BSNLEU, Girish, Cheluvaraj, Shabarish Kumar office-bearers BSNLCCWF addressed. The CEC decided to participate in the 22 February Parliament March as per quota allotted.

The leaders met the CGMT Shri Nagaraju and discussed about the problems of the casual and contract workers in the circle.

Meeting with Chief Labour Commissioner

Comrades V.A.N.Namboodiri, President and Animesh Mitra, Secretary General, BSNLCCWF met the Chief Labour Commissioner Shri Anil Kumar Nayak today, 27th October 2016, and presented  the issues of the casual and contract Labour in BSNL. The  representatives of the Federation brought to the notice of the CLC that neither minimum wages are being paid, nor EPF and ESI  implemented in many places, despite clear government and CMD BSNL orders in this respect. CLC stated that he had issued instructions to the State labour commissioners in this respect earlier and will also send a reminder to ensure that the labor laws are got implemented. The case of implementing the Group D pay scales for the casual labour was also pointed out. . The representatives submitted their memorandum on the Gazette Notification on Minimum wage which proposed Rs. 350 per day. BSNLCCWF demanded Rs.650 per day and also upgradation of categories considering the number of years etc. CLC gave a patient hearing to the representatives.

Variable DA for Minimum Wages revised for Contract Labour from 01-10-2016

The Chief Labour Commissioner (Central) has issued orders on 30-09-2016 revising the Variable DA for contract workers w.e.f. 01-10-2016. Accordingly, the unskilled contract worker in ‘C’Class cities will get Rs. 250 as daily wage. For the semi-skilled, skilled and highly skilled as also in B class and A class cities, the daily wages will be higher.

Meeting with GM(Restructuring) on Contract workers’ issues

Com.V.A.N.Namboodiri, President, BSNLCCWF met Shri A.M.Gupta, GM(Restg), BSNL C.O. and discussed about the non-settlement of issues of contract workers in many circles. He pointed out that the contract workers in Jharkhand are not being paid full wages. Instead of making payment through cheque or accounts as per orders of the CMD BSNL, they are being paid in cash to avoid scrutiny. In UP(East) Circle, despite bringing the non-payment of minimum wage and non-implementation of EPF and ESI to the notice of the corporate office, the issues remain still unsettled.

GM(Restructuring) stated that several instructions have been issued and that Corporate Office is monitoring the cases. He assured that necessary action will be taken to implement the orders at the field level. Comprehensive orders are also being issued.

The Brutal Exploitation of BSNL contract workers – How this black spot on the face of BSNL can be removed?

From the CMD to the lowest employee in the BSNL, everybody fully knows that the contract workers engaged by BSNL through contractors are brutally exploited. The government has fixed the minimum wage and Gazette Notification issued by the Chief Labour Commissioner (Central) and orders on Variable DA are issued every six months to be effective from 1st April and 1st October. Wages vary according to unskilled, semi-skilled, skilled and highly skilled as also on the basis of the classification of the city like A,B,C class.  According to the notification based on 01-04-2016, an unskilled worker in C Class city should get Rs. 246 as daily wage, which will come to more than Rs. 7,000 for a month. But in many SSAs/Circles far less is paid in some places even low as rs. 2,000. The fact is that BSNL is paying the contractor as per the minimum wage rate, but the worker does not get the same. In A, B class cities and for highly skilled, skilled and unskilled the rates are higher, but they are also paid less than the minimum wage for the unskilled. How can a worker maintain his family with a meager Rs.2,000 a month?

This is a sorry state of affairs. BSNL has got good officers, employees and strong unions/associations of ITS, Executives and Non-Executives. But most are turning their heads from the injustice being done to the contract workers, who are working in the same institution. Do we also belong to the creed of people who silently turn away their heads and walk away  when girls are being molested and children are being kidnapped?

My humble request as the All India President of the BSNL Casual Contract Workers Federation to all the ITS, Executives and Non-Executives and their organisations is to kindly think it over and help the hard working contract workers by ensuring that the minimum wage is got paid to the workers. Let us take a decision that we will not be part of this exploitation in anyway  and also will make our best efforts to stop this corruption and exploitation of the poor workers.

I would also request our comrades and colleagues to express their suggestions how this corruption and brutal exploitation can be put an end to and clean the black spot existing on the face of BSNL and its employees.

Meeting with CMD BSNL on Casual- Contract issues

Com. V.A.N.Namboodiri, President and Com. Animesh Mitra, Secretary General, BSNLCCWF met Shri Anupam Shrivastava, CMD BSNL on 06-09-2016 and discussed about the regularisation of  casual labour, implementation of minimum wage, EPF, ESI etc.as also implementation of gratuity. The union leaders also requested that necessary funds be allotted to Kerala Circle for making payment of arrears of the wages as per the recent agreement on the wages of contract labour. CMD agreed to look in to all the matters urgently.

Improvement of the services also was discussed. The necessity of immediate countering steps against the aggressive entry of Reliance Jio was also discussed. Better service and expansion is required.

Meeting with CGM UP(East) on Contract worker issues

V.A.N.Namboodiri, President, BSNLCCWF, K.R.Yadav, Vice-President BSNLEU, R.K.Mishra, Circle Prsident, BSNLCCWF and Circle Secretary BSNLCCWF, Jeetlal Maurya, Circle Secretary BSNLCCWF and Haridwar Yadav, BSNLCCWF met CGM UP(East) Shri T.N. Shukla on 19th August 2016 and discussed about the issues of the casual and contract workers. The union representatives pointed out that the CMD orders on Minimum wage, EPF, ESI etc are not being implemented in UP(East) Circle. Only about Rs. 1,500 / 2000 is paid which is only about one-fourth of the minimum wage. The direction of the CMD that the payment is to be made through cheque or to be put in accounts is being violated. EPF and ESI are not implemented. The Union representatives demanded that all these issues should be settled by implementation of the orders of the government and CMD BSNL. The CGM agreed to ensure that orders are got implemented.

BSNLCCWF has brought to the notice of Shri A.M.Gupta, GM(Restructing), BSNL Corporate Office, regarding the non-implementation of minimum wage, EPF and ESI for Contract workers in both UP(East) and Uttrakhanad circles and demanded that the government/BSNL orders in this respect are got implemented. The matter was brought to the notice of the GM on earlier occasion also.

Welcome Agreement on Minimum Wages for contract workers in Kerala.

After 5 months of militant struggle, in which leaders of BSNLEU and SNEA were suspended, transferred and charge-sheeted, the Kerala BSNL contract workers have won their demands for higher wages. As the orders issued on the basis of the agreement reached between the union and the circle Management,  the new rates are as follows:

  1. Unskilled Labour : Rs.318 ( Rs. 236 earlier)
  2. Semiskilled Labour: Rs. 343 (Rs. 258 earlier)
  3. Skilled Labour : Rs. 351 (Rs. 258 earlier)
  4. Out door workers will get Rs.17/- as transport allowance.
  5. Variable DA will be in addition.
  6. These rates will be implemented from 1st August 2015.
  7. These rates are based on the minimum wages for Kerala State.

We congratulate the BSNLEU, BSNLCCWF and SNEA leaders and workers who organised the struggle and fought to the end. Com.K.Mohanan, Circle Secretary BSNLEU and Circle President BSNLCCWF, N.R.Somasekharan Nair, CS, BSNLCCLU and George Verghese, then CS SNEA along with the other leaders in the circle led the militant struggle. Coms. V.A.N.Namboodiri, President, BSNLCCWF, P.Abhimanyu, GS BSNLEU and K.Sebastin, GS SNEA and other leaders from CHQ negotiated with the BSNL Management at each and every stage.

Congratulations for the casual contract workers of Kerala for their great victory!
