BSNL Management arbitrarily changes the convention of nominating in Joint Committees .

It was a practice all these years that when any joint committee of Official Side and Staff Side is formed, almost equal number of members from both the Official Side and Staff Side are nominated. But in the Joint Committee for recommending the PLI for BSNL employees, while 5 GMs represent the Official Side, there are only two from the Staff Side. This is deviation from the existing practice and is arbitrary. The intention seems to be to put undue pressure on the Staff Side to agree with the official side.

The Management should change its unfair line and allow staff side to nominate equal number of members to the Joint Committees, as per the existing practice.

BSNL for Better Service – Utilise the Works Committee effectively

After much persuasion by BSNLEU, the BSNL Management has sent another directive to all the SSA heads to form the Work Committee and start functioning.
IT was BSNLEU which gave the suggestion some eight years back on the basis of which the Works Committees were formed. It was intended for discussion at the field level between the management and the unions for expansion, development and for giving a better service to the customers. It was to a certain extent beneficial also. But gradually the field level management in most SSAs according to their own wisdom.
When all are trying for revival of BSNL, the Works Committee has a big role to play. That is why BSNLEU and Forum demanded for restoring the Works Committee. Reminder has now been issued by the corporate office and it may start functioning again.
I would request all our comrades at the SSA level to utilise the committee effectively so that our service is got better and there growth and expansion and also profit.
Let us take this task as a challenge to make BSNL viable.

Odisha Govt. appreciates BSNL for service during Phailin

The government of Odisha, through its Chief Secretary, has conveyed its appreciation and thanks for the excellent service of BSNL during the Cyclone Phailin and also during the period of rehabilitation. BSNL service helped very much in keeping the government connected with the relief operations.
In the same way, the Utharakhand government had also thanked the BSNL for its excellent service during the massive landslide and floods which took away the lives of hundreds of people.

While the private companies close their services during such natural calamities to avoid loss of towers, equipments etc. BSNL, the government PSU is on the job of maintaining its services for the safety of the people at great risk. We are happy that it is being appreciated by the people and the government.
My Hearty congratulations to the BSNL workers and management!

Rs. 34 lakhs for a fancy landline BSNL Number!

It is a fantastic news! In Chennai, a cab operator has bid for a fancy telephone number 2000 2000 and paid Rs. 33.93 lakhs for getting it.
BSNL Chennai circle has offered the No. 2000 2000 to the highest bidder through e-auction. There was cut-throat competition and it was Ravi Travels, a company with about 2,000 cabs, that bagged the same in the highly hot bid.
The largest amount so far paid for such fancy number was in Kerala. Ravi Pillai, a businessman from Kerala paid Rs. 12.13 lakhs for getting a number with all zeros except the first digit.
Such news are welcome and will be a booster for BSNL!

BSNL reduces International Tariff, while Private Telcos increase

This is the difference between PSUs and private companies. While the private companies. While the private telecom companies have started increasing their tariffs, BSNL, though in loss is reducing the same, for the benefit of the customers. See the PTI report below:

New Delhi, Oct 18 (PTI) State-run BSNL has launched
special tariff vouchers (STVs) wherein its customers would get over 75 per cent cheaper rates for making international calls.

The public sector firm has launched STVs in the range for
Rs 23 to Rs 41 for prepaid customers whereas postpaid users
have to pay a fixed monthly charge (FMC) of Rs 20 to Rs 40 to
avail the cheaper rates.

The company has divided the countries into four groups.
“BSNL is providing its customers the cheapest international call rates. It has launched STVs, which are offering ISD calls rates similar to the normal calls,” the company said in a statement.

With a STV of Rs 41, prepaid customers can call USA,
Canada and Singapore for Rs 1.49 per minute whereas the normal rate is Rs 6 per minute. Users can call China at Rs 1.49 per minute against the normal tariff is Rs 10 per minute.

Postpaid customers too can avail the same rates with a
FMC of Rs 40. The SMS tariff has been reduced to Rs 3 from Rs
5 per SMS. For countries including France, Germany and UK, the rate has been reduced to Rs 4.49 per minute as against Rs 6 with a STV of Rs 38 for prepaid users and FMC of Rs 35 for postpaid customers.

BSNL customers can call Bangladesh, Malaysia, Hong Kong
and Thailand at Rs 2.99 per minute with STV of Rs 27 as
against a normal price of Rs 10. For calling Australia, the rate has been reduced to RS 6.49 per minute with Rs 23 STV and a FMC of Rs 23 while SMS can be send for Rs 3.

Recently some players have increased international
calling rates by up to 80 per cent mainly due to the impact of depreciation.

The V Membership Verification was held on 1st February 2011. BSNLEU (United Forum) got 46.57% of votes and was declared as recognized union. NFTE got 34.96% votes. The National Council was formed with Com. V.A.N.Namboodiri as leader and Com.P.Abhimanyu as Secretary Staff Side.
XXV Meeting of the National Council – 24th June 2011
CMD was present in the meeting. He welcomed all official side and staff side members.
Anomaly due to accrual of increment to junior earlier than senior after fixation of pay on the basis of wage revision w.e.f. 01-01-2007 – Management stated that they will verify with other PSUs how they sorted out the issue.
Chairman agreed to refer to DOT the case of Presidential orders for officials whose training started during DOT period but were appointed after formation of BSNL.
The settlement of the pay anomalies arisen at the time of CDA to IDA wage revision will be re-examined and settled.
Proposal for revision of out-door ceiling in respect of non-executives is under consideration.
The BSNL pensioners also will be allowed the enhancement of concession for Broadband Concession scheme.
Both the photos of Mahatma Gandhi and B.R.Ambedkar will be put together in the Conference Hall.
Proposal for SIM card with certain hours of ‘free talk-time’ is under consideration.
It was agreed to favourably consider allotment of vacant staff quarters to retired employees.
The Management did not agree to revise the TSM/Casual labour wages on IDA scales.
The management did not agree to set right the reduction in wages of post-2007 recruitees.
Discussed about procurement of equipments, development and expansion plans etc.
Staff side strongly protested against the denial of Child Care Leave to women employees of BSNL.
Immediate introduction of NE-12 pay scale w.e.f. 01-01-2007 – Issue will be decided on fast-track basis.
Implementation of E1A scale for non-executives – The case will be examined.
XXVI Meeting of NC – 27th February 2012
The issues connected with the utilization of the Telecom Factories were discussed in detail.
The recommendations of the committee on Restructure of Industrial cadres will be implemented.
Early finalization of Standing Orders for Industrial Workers will be done.
SC/ST /OBC back-log vacancies will be filled up.
Some clarifications on NEPP issued. Others will be examined.
Grant of HRA to staff posted in villages within 8 KM of city – referred to DOT
Presidential Orders for absorption for left out cases will pursued with DOT.
Change of Designations – further discussion will take place.
Conducting of TTA LICE- pre-qualifying test will be examined.
Pre-qualifying examination for TM will be examined.
Increase of increments to avoid stagnation – will be examined.
Regularisation of Casual Labour – matter still under examination.
Relaxation in qualifying standards for SC/ST employees – will be considered.
XXVII Meeting of NC – 7th August 2012
Wage Revision of Non-executives from 01-01-2012 – will be examined.
Merger of 50% DA with basic pay – will be examined on receipt of instructions from DOT/DPE
Revision of Allowances and Perks, Restoration of medical Allowance, LTC etc – will be reviewed subject to financial position of the company
Fixation of pay under Fr 22(i)(a)(ii) for upgradations after 01-01-2007 – agreed to examine the case
Modifications agreed for allotment of quarters for retired employees.
Counting of service paid from contingencies for pension and DCRG – will be examined
Committee will look in to the pay scale up gradation of official language cadres.
Provision of pre-paid SIM with talk-time of Rs 200/- to Non-Executives – union proposals will be examined.
XXVIII Meeting of the NC – 30th January 2013
Standing Committee Meetings will be held in two months
Implementation of Rs. 16,400 – 40,500 pay scale as promotion to NE-12 will be taken up with BSNL Board.
Another meeting of the Change of Designations Committee will be held.
Declaring of Hepatitis-C as chronic disease will be taken up with CGHS authorities
Compassionate Ground appointments – Unions may submit their suggestions.
Implementation of Ernakulam High Court judgment on Anomaly – Reports awaited from circles
Staff side suggestions on NEPP issues will be relooked in to by the management.
In-Service training to TTA on par with JTO/SDE will be done if felt appropriate.
Restructure of Civil Wing – Under active consideration of the management.
Child Care Leave – Implementation will be re-examined.
TSM service to be entered in the HR package – under consideration
The VI Membership Verification was conducted on 16th April 2013. BSNLEU which got 48.6% votes and NFTE BSNL which got 30.28% votes were granted recognition as Main Recognised Representative Union and Second Recognised Representative Union respectively as per the New Recognition Rules of recognizing two unions which get more than 15 % votes. The Staff Side will be constituted with 9 seats for BSNLEU and 5 seats for NFTE. The initiative for the New Recognition Rules was taken by BSNLEU, considering all aspects, which was accepted by other unions and the management. This will start a new stage in the negotiating machinery and settlement of issues.

Solarisation of telecom towers – BSNL will be entrusted

It is reported that the Committee constituted by the DOT to examine the matter has recommended to entrust BSNL the task of solarisation of the telecom towers in the rural areas of the country, which are lacking in electricity. The process will be funded by the USOF. In recommending, the Committee has considered the vast infrastructure network of the BSNL through out the country. Abou 3.5 lakh towers are the immediate target.
The USOF is having more than Rs.27,500 crore in its kitty and it is no great problem for it to release the fund.
BSNL Management should immediately try to get the order so that it can utilise its infrastructure for the benefit of the people.

The Second Membership Verification was held on 1st December 2004. Before the verification, as usual, a meeting of all the participating unions was held. Except NFTE, all unions wanted more than one union. But NFTE took a strong position that only one union can be recognized as per the Code of Discipline. Hence no change could be made. In the Verification, BSNLEU with the support of United Forum won with 49.5% of total votes. NFTE got the second position with 35.30%. Only BSNLEU was recognised.
VII Meeting of National Council – 25th January 2005
The First Meeting after verification (VII meeting of NC) was held on 25th January 2005. The Chairman was Sri S.K.Jain Director (HR). Shri Thomas John (FNTO) was Leader and Com. V.A.N.Namboodiri (BSNLEU), Secretary, Staff Side.
There are many items discussed in each meeting of the National Council for which detailed minutes are usually issued. A few selected important items are only mentioned below for brevity sake.
The Staff Side opposed the VRS agreed to by the earlier recognized union in the earlier NC meeting and demanded that it should be dropped. The Staff Side also proposed that a Souvenir of HMT watch be supplied to all employees considering the good work and consequent profit to the company, which was agreed to by the management. It was decided to form a joint Committee for the same.
The delay in finalizing perks to the employees was pointed out by the Staff Side. A Joint Committee was formed for the same.
The Staff Side pointed out the scant promotional prospects for the non-executive employees and demanded for 5 time bound promotions in service. The Management did not agree stating that there is an agreement in the NC earlier stating that the OTBP-BCR will continue till next wage revision. After detailed discussion, the management agreed to form a Joint Committee in this connection. Pay Anomaly issue was taken by the staff side. Management agreed to look in to the compassionate ground appointments.
Adjourned Meeting of VII NC – 25th February 2005.
The meeting was held in the background of the drastic Tsunami floods and high waves which resulted many deaths and destruction of house and properties. The Staff Side wanted immediate support to the workers in A&N Islands and other places where the employees have been badly affected. This was agreed to by the official side.
The Report of the Perks Committee was accepted by the NC. On the demand of the Staff Side a Joint Committee of Official Side and Staff Side was formed to recommend on the following issues:
1. Pay Scale of Sr.TOA 2. Pay Scale of TTA and grant of OTBP/BCR 3. Pay Scale of TM 4. Pay Scale of Drivers and Cable jointers and 5.Pay Scale of Grade IV.
It was agreed to approach the LIC for formulating the Group Insurance Scheme since the govt. did not agree to continue the same. It was decided that GPF will continue.
On the stiff opposition from the Staff Side, the proposed VRS was dropped by the management.
VIII Meeting of NC – 19th April 2005
During the period of NFTE it was decided that no Standing Committee is necessary. But the present Staff Side demanded that the Standing Committee should be formed to review the progress of the decisions etc. Hence the Standing Committee was formed with DDG(SR) as Chairman with members from both official side and staff side.
The anomaly in the 2000 wage revision from CDA to IDA, the seniors getting less than their juniors, was referred to the Promotion Committee already formed.
Orders were issued as per the recommendations of the Joint Perk Committee. The NC constituted another Joint Committee for negotiations with PSU Banks for providing loans to the BSNL employees. Medical Reimbursement issue discussed in detail.
IX Meeting of the National Council – 4th August 2005
Shri Niranjan Singh, presided as the Chairman of the National Council after being posted as the Director (HR).
With this meeting a new system was started by reporting about the expansion and developmental activities of the company. DDG(LTF) presented the same.
As per the suggestion of the Secretary, Staff Side earlier, a Compendium on Membership Verification, formation of Council etc. was prepared by the DDG(SR) and the same was released in this meeting and copies supplied to all members. This became a reference book for the ensuing verifications. This was also referred by the Railways’ Federations, when the Membership Verification started there after a few years.
Management accepted the proposal for a new transfer policy in view of the present situation where there is no recruitment and there is requirement for staff in the rural areas.
Special recruitment in NE-I & II, J&K, Assam, HP, Uttaranchal etc. will be examined as special case. Promotion of all qualified candidates to TM will be considered.
The Management also agreed to restore the HRA in the B-2 class, where the same have been granted earlier on special considerations, but not have the required number of population.
X Meeting of the NC – 8th February 2006
Payment of balance of 25% of Bonus approved by the Management Committee. Next Board meeting will take decision and issue orders.
Staff Side suggestions will be considered when framing Standing Orders.
Staff Side suggestions for cutting wasteful expenditure like vacating rented offices, reducing rented vehicles etc. accepted.
The demand of the staff side to restore the power of CGMs to create posts will be put to BSNL Board.
Suggestion of staff side for gift of watch to all employees accepted by management.
Merger of 50% IDA with pay will be decided after decision by the government.
XI Meeting of the NC – 27th April 2006
CMD BSNL attended this meeting on a special request by the Secretary, Staff Side.
The 25% balance of the Bonus due in 2004-05 was agreed to be paid by the management.
The Management agreed to pay air travel charges of the Staff Side members attending the NC meeting. 500 posts of JTO will be allotted to the qualified candidates.
Special Meeting under Chairmanship of Shri Niranjan Singh Director (HRD) with the Staff Side on the demands raised in the Strike Notice( for 17th August 2006) – 22nd July 2006
The following decisions were taken:
Uniform Committee will be reconstituted.
Anomaly Committee recommendations will be considered.
A Committee will be formed for framing Standing Orders
300 Earned leave and 2 RH for Industrial workers under consideration
RCGEGIS will be refunded
Free calls for BSNL employees in MTNL area and vice-versa settled. Agreement with MTNL is being made.
A committee for upgradation of Group ‘C’ & ‘D’ cadres in corporation office agreed.
Corporation office will be shifted from rented Statesman Building to BSNL new building by November 2006.
All the joint committees of staff side and official side will start discussion with out delay.
The regularization of the casual labour will be considered within the frame work of the Supreme Court judgment.
Promotion to Asst. Grade in C.O. will be favourably considered.
Holding of examinations to various cadres will be speeded up.
Circle Status council to corporate office will be considered.
XII Meeting of NC – 31st August 2006
CMD attended the meeting.
Supply of mobile /WLL phones will be supplied to out door staff.
PLI for 2005-06 will be paid before Puja.
Discussion will start for wage revision from 01-01-2007
XIII Meeting of NC – 4th December 2006
Management agreed to refer to DOT the demand of the staff side to increase minimum bonus to Rs. 10,000. (Rs.10,000 granted)
Counting of past service of casual labourers will be referred to DOT.
Date of effect of BCR scale on completed date of 26 years will be referred to DOT (accepted)
Restoration of creation of posts for Compassionate Ground appointments will be submitted to BSNL Board for approval.
Special Meeting with CMD BSNL after Notice for agitational programme including strike – 3days discussion and settlement.
Refund of CGEIS will be speeded up
Number of members in Staff Side at National Council increased to 15.
Formation of Works Committees agreed.
Management agreed to increase the number of office-bearers of the union.
Wage Negotiations will start.
Between the II and III Verification, 7 Council meetings ( one adjourned meeting also) and two special meetings with CMD/Director (HR) were held to discuss issues included in the strike notice.
The III Membership Verification was held in December 2006. The details in next write-up (continued )

National Councils (2003 – 2013) – A Review of the meetings – 1

The first meeting of the National Council in BSNL after the VI Membership Verification is yet to be held, though more than 5 months have elapsed after the result of the verification has been announced. Since the Council has been constituted and the items are going to be furnished by the Staff Side, it is expected that the same will be held shortly. It will be the XXIX Meeting of the National Council.
What has been the experience of the XXVIII meetings of the National Council held earlier? What are the items discussed and what are the results? A review of the same will be helpful in the future functioning of the Council effectively.
First Membership Verification and decisions
In the meeting held in February 2001 to finalise the Membership Verification, there was one important issue to be decided ; how the Verification is to be conducted. NFTE BSNL insisted that the Membership Verification should be through ‘Check Off’ system, ie. by getting signed forms from the members for the union they support and deduction of membership on that basis. BSNLEU and many other unions suggested that the verification should be conducted through voting through ‘Secret Ballot’ as in the case of Assembly and Parliament elections. Finally the decision arrived at was that the verification should be through secret ballot and as per the Code of Discipline accepted by the Central Trade Unions decades back. Another issue was that how many unions are to be recognised. The Chief Labour Commissioner, who was present, stated that it all the unions agree, more than one union can be recognised after approval by the Labour Ministry. Since one union, NFTE, opposed the proposal, decision could not be taken in the matter.
First Membership Verification
The First Membership Verification was held on 25th September 2002 and the result announced three days after on 28th September. NFTE got the first position with 35.25% votes and BSNLEU came second with 29.98%. Only one union, NFTE was recognised.
The National Council was formed and the Staff Side members were nominated by NFTE. In addition to its members, some of the members of FNTO were also nominated. Though BSNL Management did not accept those nominations first, after discussion they were also accepted, provided they give a certificate agreeing the nomination by NFTE.
First Meeting of National Council – 29th January 2003

The First Council Meeting was held on 29th January 2003. Com.M.B.Vichare was the Leader and Com. O.P.Gupta, the Secretary Staff Side. Interestingly a decision was taken in that meeting that Standing Committee is not required. (There is a provision for Standing Committee which will review the progress of action taken on the decisions of the NC). It is not understood why such a decision was taken.
Another decision was with regard to the 2000 wage revision stating that “ seniors getting less than juniors is not an anomaly”. It was agreed that Council offices at all levels, National, Circle and SSA levels, will be provided with service telephones. It was also decided to continue with GPF for the BSNL absorbed employees.
II Meeting of NC – 28th May 2003
This council meeting agreed to the demand of NFTE that members of other unions can be nominated to the council. Accordingly FNTO leaders Thomas John, K.Vallinayagam and Vasisht were made as members with the condition that they accept NFTE’s nomination.
The meeting decided that “OTBP/BCR Scheme will be continued as General Promotion Policy till next wage revision”. NFTE strongly opposed giving facilities to BSNLEU, the second union as per the Membership Verification.
III Meeting of NC – 20th October 2003
It was assured by the Management that Management Committee of BSNL Board will have discussion with union before arriving at any decision on the issues discussed in the NC.
IV Meeting of NC – 28th November 2003
In this meeting it was conveyed by the Official Side to the Staff Side that the latter should not have any apprehension regarding retrenchment of staff on account of being declared surplus and that no such proposal is under the consideration of the management. It was also decided that there will be no separate council for Civil Wing.
V Meeting of NC – 24th March 2004
It was decided to form a Joint Committee, which will discuss and give suggestions to the BSNL Management on the issue of Compulsory Retirement of BSNL Employees.
The above committee was also entrusted to discuss the issue VRS Scheme. The Staff Side opposed the VRS and wanted Voluntary Replacement Scheme. This will be discussed by the Committee.
VI Meeting of NC – 17th June 2004
It was agreed that a“ Scheme VRS/CRS may be introduced in to the system keeping in view overall objective under which the proposals have been worked out.”
Special Meeting with CMD on 14-07-2004
The decision of the Ministry of Finance to collect full cost of pension and its impact on BSNL was discussed in the meeting. The CMD informed the union that it was decided again to refer the issue to government. Another issue was with regard to GPF for the absorbed employees. The Management reiterated that it has no alternative but to go in for setting up a Provident Fund Trust for managing the GPF amount and requested the union to take an early action in this regard.
As stated above, there were six meetings of the National Council and a special meeting with CMD after a programme of agitation was given notice of. It can be seen in the minutes of these meetings that the Management was pushing through its agenda of VRS/CRS, retrenchment, issues on Pension etc. Though opposing at the initial stage, the staff side was gradually accepting the view point of the official side.
Another and more important was connected with the functioning of the Council and the Recognition itself. As in the DOT period, it was better to have two unions recognised, which will improve the position of the staff side with more % of support. In fact, the management had no objection for the same provided all unions accepted the condition. NFTE alone objected to the proposal and defeated it. This turned against NFTE itself in all verifications till Vth, resulting in denial of recognition to it. It could recognition in the VI Membership Verification in 2013, after the condition of two unions were accepted.
Secondly, as in the National Council for the Central Government Employees and in the Departmental Councils including that of DOT, the Chairman of the Council used to be the Cabinet Secretary in the former case and Secretary, DOT in the latter with all Members of the telecom Commission as members in the Departmental Council. This helped in implementing the decisions of the councils since those who are to take decisions are all present. In the same way, in BSNL, the Chairman of the Council should have been the CMD and all the Directors of Management Committee should have been members. Though NFTE requested that CMD should be Chairman of NC, it meekly agreed to the position of the Management and agreed that the Director (HR) can be the Chairman with Director (Finance) also present. Other Directors are not members of the NC. This has resulted in devaluing the position of the NC and many decisions taken in the council were either not implemented or got implemented with much delay.
It would have been possible to get favourable decisions on these two issues, if the Staff Side has taken a strong position, but it did not happen which resulted a lot of problems later. However, it was not the first time that NFTE compromised on basic issues, as is well known to telecom workers.
