BSNL Employees Union in it’s All India Conference at Ludhiana has taken a conscious decision to propagate and fight for the rights of the one lakh and odd casual and contract workers engaged in BSNL. They are being exploited in their wages, social security measures and what not? It is time to see that the injustices meted out to these hard toiling workers are rectified and justice given. It is only with the initiative and full support of the regular employees that they will be able achieve this.

The Ludhiana AIC has called upon all circle/SSA/Branch unions to organise 1st November 2012 as “Casual Contract Labour Demands day”, by holding meeting, giving wide publicity to the demands of the casual/contract workers like Regularisation of casual labour, equal wages and minimum wages, Social security measures like EPF, ESI etc. and also meeting the management for settlement of the demands etc. It is the coterie of the Management-Contractor nexus that is exploiting the low paid workers. Unless strong and sustained agitation takes place, it will be difficult to get justice for these workers.

Organise 1st November in a very effective and successful way.

BSNL CCWF in Karnataka marches ahead

The Circle Conference of BSNL Non Permanent Workers Union, affiliated to both CITU and BSNL Casual and Contract Workers Federation held at Belgaum on 21st October 2012 has shown that the union has passed its childhood and is advancing towards youth and vigour.

The Conference was held in the Telephone Bhawan premises in a pandal erected for the purpose. More than 500 delegates came from all the 13 districts where the union has been formed ( In the other 7 districts, it will be formed before December 2012). The host district, Belgaum, has already won many of their demands after a strike of 23 days was organised with the capable support of the BSNLEU led by Com. H.L.Berse, District Secretary. The young comrades were making all arrangements for the successful conduct of the Conference.

After the flag-hoisting, the National flag by me and the Union flag by the General Secretary of the union, Com. Mahantesh (CITU), the conference started at about 1100 hours presided by Com.B.P.Narayana, Circle President, BSNLEU Karnataka Circle. I was given the honour to inaugurate the conference. In my brief speech, I congratulated the Karnataka workers for their sincere efforts to form and strengthen the organisation. The formation of the Federation, the efforts already made to settle the issues of casual and contract workers and our future tasks were mentioned by me. Coms. Prasannakumar, General Secretary CITU Karnataka, C.K.Gundanna, Circle Secretary, BSNLEU, M.C.Balakrishna, Org. Secretary, BSNLEU CHQ, Mahantesh ,CITU, Meenakshi Sundaram CITU, C.A.Karade, CITU, Girish Shetty, H.L.Birse, District Secretary BSNLEU, Hijanamani, Dist. president, BSNLEU, Keshav, Circle treasurer, Vijay Belgaonkar, Dist. Secretary Goa, Patil, CHQ Org. secretary, AIBSNLEA and other leaders were in the dais and addressed. The opening session gave the message to the casual and contract workers that the CITU and BSNLEU is in complete support to the union and will fight for their cause unitedly.

The delegates session is going on while this report is being published.

How much Contract Labour are exploited BSNL!

Today some of the contract workers from Mathura and Sahranpur came to my residence. They reported what is happening there with regard to the payment of wages etc. to contract workers.

Out of the 150 contract workers in Mathura 125 are retrenched and only 25 are working at present. The existing contract workers are being paid only Rs. 2000 to Rs. 3000 monthly according to the job, whether in office, computer, line work etc. This is being paid by the Account Officer / SDE etc. There is no record of the payment, the name of the contract worker is not mentioned, no signature is taken from the employee, no EPF or ESI is deducted or remitted along with the contribution of the contractor/Principal Employer etc. This is completely against the govt of India orders, various Acts of Parliament as also instructions of the CMD. The Minimum wage is to be paid to the workers, ESI and EPF amount is to be deducted.

This inhuman exploitation has to end and the rules are implemented and workers should get their eligible benefit. BSNLCCWF and BSNLEU jointly has to take up the cases and ensure that justice is meted out to the downtrodden workers.

The Central Executive Committee meeting of BSNL Casual and Contract Workers Federation will be held at Dhanbad (Jharkhand) on 3rd and 4th November 2012. The CEC has a lot of issues to be discussed and decided. All the office-bearers and circle secretaries are requested to book their tickets immediately so that they can get the reservations. The arrival and departure may be intimated to Com. Tapas Ghosh Secretary General BSNLCCWF in advance to make all arrangements.

“BSNL Casual/Contract/Unrecorded Workers Day” on 1st Nov. 2012

The All India Conference of BSNLEU has taken a very important and historic decision to organise “BSNL Casual/Contract/Unrecorded Workers Day” on 1st November 2012. There are 3348 casual labours, as per government, in BSNL who are yet to be regularised due to administrative delay. Now the BSNL management is denying regularisation on the plea of a judgement in the Supreme Court. But based on the same judgment casual workers have been regularised in Central Govt. and other PSUs. There are about one lakh contract and unrecorded workers. These casual and contract workers are denied Minimum Wage, social security measures like EPF, ESI and in many cases their names are not even recorded. BSNLEU and the newly formed organisation of BSNL Casual and Contract Workers have been organising sustained agitations for getting the demands settled.

Now the Ludhiana AIC of BSNLEU has taken decision to strengthen the struggle and called upon  all its units to organise “BSNL Casual/Contract/Unrecorded Workers Day” on 1st November 2012 focussing the demands and organising demonstrations rallies etc. BSNLCCWF will be fully joining in the programme. BSNLEU deserves congratulations for organising a programme on the demands of the Casual/Contract/Unrecorded workers alone.

Let all make maximum efforts to make the programme a big success with massive participation. BSNL management can not avoid settlement of the justified right of the workers.

September 12 – Left organises Food Security Day

The Left parties viz. CPI(M), CPI, RSP and Forward Bloc,  today observed “Food Security Day” demanding supply of 35 kg food grain at Rs.2 to the people. The parties demanded that the BPL, APL categorisation, which denies the food grain to a large number of poor people, should be stopped and universal supply should be made.

Demonstrations and rallies are being organised all over India with massive participation.

Massive Dharna by Contract Workers in Mumbai

More than one thousand contract workers staged a massive dharna in front of the Maharashtra CGM Office at Mumbai on 1st September 2012 demanding payment of minimum wage, implementation of social security measures like EPF, ESI etc.  The workers reached the spot from different districts with the red flags and placards with the demands. The dharna was organised by the Maharashtra Circle union of BSNL Labour and Contract Labour Union, affiliated to CITU and BSNLCCWF.

The dharna was addressed by Com.V.A.N.Namboodiri, President BSNLEU and BSNLCCWF who congratulated the workers for the massive gathering and their determination to settle the issues. He spoke briefly about the position of the demands and what the BSNLCCWF and BSNLEU have done to settle the issues.  Com. K.L.Bajaj, All India Vice-President CITU, Dr. Vivek Monteiro, Secretary Maharashtra CITU, Com. G.Mathpati, President, Com.Nana Chavan, Secretary Maharashtra BSNL Labour and Contract Labour Union and other leaders.

The leaders later met Shri Jayaraman, Sr.GM(HR) Maharashtra Circle in the absence of the CGM and demanded that the orders of the government and BSNL corporate office with regard to the payment of minimum wage, implementation of social security measures etc. be implemented without delay. He assured the delegation that these will be implemented.

The massive dharna has given confidence to the workers and they are determined to strengthen the organisation with forming the union wherever it has not been formed so far.

Labour Commissioner, Mumbai and discuss about the non-implementation of labour laws and denial of minimum wages to the contract labour engaged in BSNL Maharashtra circle. He was sympathetic on the issue. Coms. G.Mathpati, President and Nana Chavan, Circle Secretary, BSNLCCWF, Maharashtra Circle were with me.

Casual and Contract Labour – Press Conference at Mumbai

A well attended Press Conference was organised in Mumbai Press Club on the issues of the casual and contract workers in BSNL. Coms. V.A.N.Namboodiri, President of both BSNLEU and BSNLCCWF explained about the inhuman exploitation of the casual/contract workers by the contractors and the BSNL management. He also briefed the press how the minimum wage is denied to them and that the social security measures like EPF, ESI etc. are denied to them. Casual labours are denied their due claim of  regularisation.

Com. G.Mathpati, Circle President and Com. Nana Chawan, General Secretary, Maharashtra Labour and BSNL Contract Labour Union were also present. They informed that a massive dharna will be organised tomorrow on the issues of the Contract workers.

Struggle inevitable for regularisation of casual labour in BSNL.

The Minister of State for Communications, Shri Milind Deora has replied to a question raised by Com.Tapan Sen, M.P., in the Parliament that there are 3,348 casual labour engaged in BSNL, and that they can not be regularised in view of the Supreme Court Judgement in Umadevi case against regularisation.

This is a distortion of facts. On the basis of the same judgement of the Supreme Court and as per the DOP&T orders referring to the judgment, hundreds of casual labours in many departments of the central government have been regularised. If BSNL was not formed, these casual labours who were actually engaged by the DOT before formation of BSNL, would have been regularised as in other departments. Formation of BSNL could not be used to deny the right of these casual labours who are continuously working for more than 15 years or so.

This denial of justice has to be fought not only by the casual workers, but by the entire BSNL workers. In fact the unions of the regular employees should organise the struggle to get their colleagues to be regularised. BSNL Employees Union and its leaders at various level have to take initiative for the agitation to get justice rendered to these maximum exploited section of workers.

The BSNL Management have the responsibility to regularise these workers.
