Sub: Complaint about non-payment of minimum Wage, non-implementation of EPF etc. to casual/contract workers engaged by BSNL in UP Circle.

Ref: Your letter No. A-7(01)/2014 dated 15-06-2015 addressed to GM BSNL Allahabad/Varanasi/Basti/Deoria/Gorakhpur with copy to Sri V.A.N.Namboodiri, President, BSNLCCWF.

Sir,

I am much thankful for the action being taken by the ALC(C), Allahabad on the complaint addressed to the Hon’ble Prime Minister by me. In this connection, I would like to kindly place before you the following for immediate action in the matter.

You have been kind enough to address the GMs BSNL, Allahabad, Varanasi, Basti, Deoria and Gorakhpur asking them to pay the minimum wage and implementation of the connected labour laws. Neither the minimum wage is being paid to the BSNL contract workers, nor EPF, ESI are implemented. It is the same case with the other SSAs in the Circle including Pratapghar, Mirjapur, Jaunpur, Balia, Rae-Bareilly and Sultanpur.

I would request you to kindly direct these GMs also to implement the minimum wage and other connected labour laws.

Relentless war on wage slavery should continue

The BSNL Casual Contract workers are brutally exploited. In fact, in many places. it is almost wage slavery. Not even one third of the eligible minimum wage is paid. They are compelled to work 10 to 12 hours or more for the pittance. The contractors and in some places the local managements connive together to deny the due minimum wage and pocket the balance.
This should change. The casual and contract workers should get what is their due. There can not be any compromise in the matter.
Sustained struggle is the only way if the contractor/management violates the law of the land and deny minimum wage, EPF etc.

PMO intervenes in the complaint of non-payment of wages, non-implementation of labour laws in BSNL.

Based on the complaint by Com.VAN Namboodiri, President, BSNLCCWF to Shri Narendra Modi, Prime Minister of India, on the brutal exploitation of the contract workers engaged by BSNL in UP, the Chief Labour Commissioner, Dy. Regional Commissioner Kanpur and Asst. Labour Commissioner Allahabad had asked the BSNL Management to strictly implement the minimum wage and the labour laws.

The ALC, Allahabad vide letter dated 15-06-2015 has addressed letters to the GMs BSNL, with copy to the Chief General Manager, UP(East) to ensure the implementation of labour laws and minimum wages, based on the complaint of BSNLCCWF, received from the PMO. It is to be mentioned here that the contract workers in UP are being paid only about Rs. 2,000- 3,000 per month. EPF, ESI are not implemented.

BSNLCCWF and BSNLEU Circle Secretaries are requested to immediately pursue the matter with the ALC with all the documents.

Brutal Exploitation of contract Workers in UP Circle, BSNL – PMO intervenes.

BSNLCCWF CHQ letter dated 21st May 2015 to Shri Narendra Modi, Prime Minister of India, about the brutal exploitation of contract workers in UP Circle, BSNL, had immediate effect. The PMO has asked the CLC ‘to take appropriate action  to redress the grievance of the complainant’. Now the Dy.CLC, Kanpur has directed the ALC(C), Allahabad through order dated 05-06-2015, to take appropriate action, with copy to Shri V.A.N.Namboodiri, President, BSNLCCWF, New Delhi.

CHQ has directed Circle Secretary BSNLCCWF UP(E) to meet the ALC(C) Allahabad and submit all the details of the case. We thank the PMO for the quick response.

Trade Unions Protest against government’s move on wages of Contract Workers

The Central Trade Unions have been strongly demanding for the last few years for equal wage and benefits for the contract workers just like regular workers. The NDA government had also moved in that direction. But now due to strong pressure from the employers and corporates, the government seem to be backtracking.

According to a survey about 55%in public sector and 45% in private sector jobs are got done by the contract workers. They are being exploited in wages as well as working conditions.

The Central Trade Unions have opposed the present move of the government and have warned that they will never agree to any such condition.

BSNL Bank Account frozen for not remitting EPF in Ranchi, Jharkhand

The EPF authorities has frozen the Bank Account of BSNL in Ranchi, Jharkhand, for not remitting the EPF dues of Rs. 3,47,43,928 (3.47 crore) to the contract workers. This is not the first time such thing has happened in Jharkhand. Despite clear instructions from the BSNL Corporate Office, many SSAs are ignoring the same, thus violating the EPF Act, passed by the Parliament. This is not only a violation of the labour law of the country, but such officers are bringing shame to the BSNL itself.

BSNLCCWF has taken such cases  with the the Parliamentary Standing Committee on Labour as also the  Central EPF Commissioner. Both have criticised the BSNL management. Consequently BSNL Management has given clear instructions to field officers. Still the violation continues and BSNL accounts are frozen.

BSNLCCWF units are requested to complain to the EPF authorities, wherever, the EPF is not implemented or the dues are not paid.

We congratulate the Jharkhand Circle leaders of both BSNLCCWF and BSNLEU  for their active interest and intervention in the matter.

A meeting of the BSNL Casual and Contract Workers is being arranged in Pune on 8th June 2015. CITU leaders, Com. Nalwade, CS BSNLEU and other leaders will be attending the meeting. Contract Workers (construction) on Strike from 1st June In Jammu and Kashmir

The construction workers of Jammu & Kashmir working in organized and unorganized sector will go on one day National Strike  on 1st June, 2015 on the call given by Construction Workers Federation Of India (CWFI) affiliated with CITU for the demands such as proper implementation of All India Building and Construction Workers Act in all states, Enroll all the Construction Workers, Brick kiln workers, quarry workers, and stone Crushing Workers, in state welfare Board, Ensure representation for CITU in Tripartite State Welfare Boards, Increase the existing welfare benefits substantially, No diversion of board funds to other purpose, increase pension to Rs. 2000/- per month and reduce age of pension eligibility for women to 55 years, allotment of more funds for infrastructure and development works by both the governments, do not liberalize FDI in construction sector, Govt. should take steps to reduce the prices of construction materials like cement, steel, paints etc., Ensure housing for construction workers, Implement RSBY and increase the limit of medical benefit from Rs. 30,000/-, All India Identity Cards (Smart Cards) to be issued to the migrant workers, Minimum wages for unskilled workers Rs. 15000/-, Registration of worker within a week, early disposal of all claims of registered workers, Stop corruption in welfare board. It was decided in a meeting of state committee of CITU presided over by Sham Prasad Kesar, Sr. Leader of CITU  held at 27-A Gandhi Nagar, Jammu, other attended the meeting were Om Prakash, General Secretary, Jagdish Sharma, Ramesh Chand, Raj Kumar etc.

J and K Casual, contract workers gherao state secretariat.

Hundreds of casual, contractual and daily wage employees gheraoed the J and K state secretariat today, 28th May, demanding regularisation and other important issues.

They were arrested and kept in custody by the police. The exploitation of these workers should end. They should be regularised. Justice should be meted out to them.

Meeting with CMD BSNL on Regularisation of Left Out Casual Labour.

Com. V.A.N.Namboodiri, President, BSNLCCWF met Shri Anupam Shrivastava, CMD BSNL, today, 26th May 2015 and discussed about the regularisation of the left out TSM/Casual labours, numbering about 3500. Com. Namboodiri pointed out the various decisions on the issue as also the fact that regularisation has taken in similar cases in the Central Government departments. He also gave a detailed letter in the subject to the CMD BSNL. CMD BSNL was sympathetic and agreed to look in to the matter.

Com.VAN also met Smt. Madhu Arora, GM(Estt.) and discussed the various issues of the casual and contract workers like regularisation, gratuity, pay scale of the casual labour etc. GM(Estt.) agreed to examine  all these matters.
