Supernumerary Benefits to the BSNL Recruited Retirees.

Officials were recruited after formation of BSNL who are not having government pension as per Rule 37(A) of the CCA (Pension) Rules 1972 as is being received by the BSNL absorbed DOT employees.

As per recommendations of the II Pay Revision Committee 2007 for PSU employees, those retiring are eligible for 30% of supernumerary benefits. But BSNL has only agreed for 25%  ( EPF- 12%, Gratuity – 4.8%, PRMB – 3.2% and pensionary benefit 5%) so far despite continued pressure by the unions. This is a big injustice to the BSNL recruitees.

BSNL Management should reconsider the matter and do justice to them by granting full 30% supernumerary benefits as recommended by the II PRC.

Sustained Struggles to save BSNL -22
Magnificent Strike – Magnificent Achievement.

Meeting with Secretary DOT

Shri P.J.Thomas, Secretary DOT held a meeting with the JCA leaders. While discussions were cordial, there was no clear decision or assurance.
Meeting with State Minister of Communications
The Minister of State, Communications, Shri Gurudas Kamath called for a meeting with the JAC leaders on 26th March 2010. The Minister heard the demands, but could not give any favourable decision. He only stated that appropriate action will be taken.
In preparation for the strike, the JAC issued press release and printed posters and circulated the same in large numbers. Detailed circular was issued calling upon the workers to fully and actively participate in the strike. State level conventions were organized in many centres. This resulted in massive propaganda amongst the workers and public.
A meeting with the Minister Communications, Shri A.Raja was held on 16-04-2010 on the strike demands including against the recommendations of the Sam Pitroda Committee. But there was no favourable decision.

Magnificent Strike – Magnificent Achievement

The strike on 20th April 2010 was magnificent on all counts. The strike which started at 0600 AM on 20th April saw hundreds of BSNL executives and Non-Executives gathering in front of BSNL Offices / Exchanges and demonstrating in support of their demands in the strike. By about 0900 hours almost all the workers had gathered in big cities like Kolkata, Chennai, Bangalore, Hyderabad Pune, Lucknow, Jaipur, Thiruvnanthapuram, Ahmedabad Patna, Bhuvneswar, Bhopal etc. and at circle and SSA headquarters and started demonstration. All offices, exchanges were deserted. So many offices stood closed, as there was nobody even to open them. The banners of Joint Action Committee and its constituent unions / associations were fluttering over the premises. The workers shouted slogans in support of the important demands. It was an exhibition of complete unity of all the executives and non-executives for a common cause. In many centres, leaders of Postal, Central government, State government, Insurance and other PSUs as also Pensioners Associations were present to convey their solidarity and support. The striking workers were addressed by Central trade Union leaders in many places.
Central trade Unions including INTUC, BMS, CITU, AITUC, HMS, TUCC, UTUC, AUTUC etc. had already adopted resolutions supporting the strike. CITU in its All India Conference at Chandigarh called upon all its units to extend full support to the strike. All India Insurance Employees Association called upon all its units to organize demonstrations in front of BSNL Offices in solidarity. AIBDPA and BSNLCCWF, Confederation and NFPE gave similar call. AISGEF extended its support. We received support from many PSU unions. We got so much support mainly due to the fact that the issues focused were issues of not only BSNL employees but they were general issues and against the anti-worker policies of the government. The complete unity of the JAC was another factor.

In the Rajya Sabha, Com.Tapan Sen, M.P. raised the issue in the presence of the Prime Minister. Com. Basudev Acharya M.P. raised the same in the Lok Sabha.
The management became panicky. The Minister of Communications Shri A.Raja immediately called for a meeting with the JAC along with Secretary DOT Shri P.J.Thomas, Member Services Shri S.C.Mishra, CMD BSNL Shri Kuldip Goyal, Director (HR) Shri Gopal Das and other senior officers.
The meeting started at 11.00 hours. Com. V.A.N.Namboodiri, Convener, JAC, conveyed to the Minister that we wanted concrete decisions on the issues raised and that we are not satisfied with vague assurances. All the issues raised in the strike notice were discussed which continued for more than two and half hours. Despite the fact that Parliament was in session, the Minister patiently heard our demands and viewpoints.

The main assurances from the minister were as follows:

1. A Cabinet Note will be prepared, referred to other concerned ministries and then sent for consideration of the Cabinet on ITS absorption issue. This will be done within 4 months. In the meanwhile BSNL will start the process of recruitment of DGMs and Management trainees. How many numbers will be recruited shall be decided by BSNL.
2. Considering the strong opposition of the unions, before taking final policy decision regarding disinvestment of BSNL, the unions will be consulted and taken in to confidence.
3. In the same way, in the case of VRS, Outsourcing as well as infrastructure sharing, the unions will be consulted before any final policy decision is taken.
4. The Unions impressed the urgency of at least minimum 36 million (3crores) mobile lines being procured for this year. CMD BSNL assured that 20 million lines are already available and 10 more millions lines will be obtained.
5. The JAC insisted that order for IDA Pension Revision for officials retired before 01.01.2007 should be issued without further delay. DOT and Management stated that this cannot be done without Cabinet approval since there are no rules at present in the matter. It was directed by the Minister that a Cabinet Note shall be finalized by the end of this month and after circulating to the concerned ministries, it should be submitted to cabinet within next three months for consideration.
6. When the delay for DOT approval for wage revision for BSNL non-executives was brought to his notice, the Minister directed DOT to resolve the issue expeditiously within 15 days.
7. The question of grant of 78.2% IDA instead of 68.8% IDA was brought to the notice of the Minister, who asked BSNL to discuss the issue with the unions.
After the draft minutes were received, the Joint Action Committee met and after discussion decided to call off the strike and the same was conveyed to the Minister and the final minutes of the meeting were issued. Accordingly, the magnificent strike which started in the morning was called off after 15.30 hours.
Impressive Achievement

The widespread strike has woken up the management, which was taking the strike in a casual way. Concrete decisions on time bound basis have been reached.
With regard to disinvestment, outsourcing, sharing of infrastructure as also VRS etc. the JAC has expressed its strong opposition and that the workers will never agree to any such proposals. Minister Shri A.Raja was fully sympathetic, but these are government policies. We have been able to stop them now. We have been assured that that the unions will be consulted before taking any final decision. The Telecom Commission which was to meet and take decision on BSNL IPO on 21st April 2010 postponed the meeting in view of the latest developments. The unions cannot be complacent and will have to be prepared for further struggles if the government proceeds with anti-worker decisions. This is the third time that JF / JAC is stopping disinvestment of BSNL during the last few years. Thus the strike has temporarily halted a major offensive of the government. (To be continued)

Respected Sir,

Sub: – Breach of assurance in the payment of ex-gratia to BSNL VRS Retirees and Revival of BSNL- reg.

We are constrained to bring to your kind notice the following issues of utmost importance for your kind consideration and favourable action.

VRS was declared for BSNL employees as part of the Revival Package of BSNL in October, 2019. There was an unprecedented response from the BSNL employees to the VRS, mainly due to the comparatively attractive ex-gratia. Accordingly, as many as 78,569 employees availed the VRS. It was assured by the government that the ex-gratia will be paid in two equal instalments, 1st in March and 2nd in June, 2020.
Many of the employees availed the VRS in the hope that they could utilise the ex-gratia amount for the marriage of their daughter, to purchase a house etc. But all these hopes stand shattered due to the breach of assurance in the payment of ex-gratia. Contrary to the assurance, the first instalment paid in March,2020 was only 31.3% instead of 50%. This Association, through a letter dated 08-06-2020 had brought this issue to the notice of Secretary, DoT and demanded the balance of 68.7% ex-gratia should be paid in June,2020. But to our dismay, only 22.5% is paid in June,2020, putting uncertainty in the payment of the balance 46.2% ex-gratia. This has naturally caused widespread disappointment and mental agony to the VRS retirees. Therefore, we request your kind intervention to cause necessary action for immediate payment of 46.2% ex-gratia to the BSNL VRS retirees.
Sir, we are equally concerned about the future of BSNL. Many people appreciated your personal efforts in bringing out a comprehensive Revival Package for BSNL and believed in early revival of BSNL. The main components of the Revival Package were; (1) Immediate grant of 4G spectrum to BSNL (2) Sovereign Bond of Rs.15,000 crore (3) Monetisation of BSNL assets and (4) VRS to the employees.
But the fact remains that the government and the top officers of DoT and BSNL were enthusiastic in implementing only the VRS to their full satisfaction. And the Revival of BSNL is put into the cold storage. The late initiative of BSNL for the 4G service has been stalled by the PMO on flimsy grounds, presumably at the behest of Reliance Jio. The intention of the government is exposed with awarding the work of installation of 51 towers in Ladakh to Reliance Jio, neglecting BSNL. The other components of the Revival Package also remain as nonstarter. The apprehension of a section of the people that the Revival Package is only a ploy to retrench the employees in the name of VRS is proved to be correct.
When the Revival Package was declared, BSNL was supported by oxygen cylinder and now, after 8 months, BSNL is on ventilator. Salary of employees are in arrears for two months, contract workers are not being paid their wages for the last two years, unable to provide the most attractive FTTH to the customers due to paucity of funds to procure necessary accessories etc.
Most importantly, BSNL Retirees are not being paid their medical bills, medical allowance since 2018. One time payment made to CGHS is also not being reimbursed. The abnormal delay in payment of medical bills and allowance is causing much difficulty and disarray to the Pensioners. This burning issue was brought to the notice of CMD, BSNL several times and also Hon’ble Prime Minister and your good self. We once again request you to do something to mitigate the sufferings of the poor Pensioners considering the Covid-19 pandemic situation.
We also make a fervent request to your good self to kindly do the needful for the Revival of BSNL in the best interest of the people and the country and to keep up the credibility and sincerity of the government.

Again Salary for BSNL employees delayed. No justification

It is reported that the June salary for the BSNL employees has not been paid, which is due by the last working day of the month. On the plea of lack of funds it was being delayed every month. At the time of launching of the Revival Plan, it was stated that the monthly salary bill will be drastically reduced after implementation of VRS. But even after implementation of VRS and saving of much more than Rs. 5,000 crore in salary bill, still the salaries of the employees are not paid in time. This is a cruel joke on the employees.

BSNL management should ensure that the salaries are paid on the due date itself.

VRS RETIREES SHOULD GIVE APPLICATION FOR COMMUTATION OF PENSION.

VRS retirees ,retired under BSNL VRS-2019, who have attained the age of 60 should give application for commutation of pension.

Application is to be submitted to the BA from where they retired in the prescribed form 1(a).

In case, pensioners submit their application after one year of attaining the age of 60, they should have to give the application in Form.2 along with medical certificate from a medical officer of grade as prescribed under Rule 22 of CCS Commutation Rules,1981.

The Head of BA shall verify the application of commutation and sign in the space provided in the form and forward the application to the concerned CCA.

It has been brought to our notice that a vast majority of the eligible VRS retirees who have attained the age of 60, have not submitted the application. So Circle/ District Secretaries may please take necessary action to bring it to the notice of VRS retirees and ensure that the applications are submitted early. (Courtesy: AIBDPA website)

REVALIDATION OF MEDICAL CARD – BSNL CORPORATE OFFICE AGREES TO AIBDPA DEMAND FOR EXTENSION UPTO 30- O9 2020.

BSNL Corporate office had extended the date for revalidation of medical card to 30-06-2020 vide office order dated 04-05-2020. There were many complaints from the circles that the date should be extended upto 30-09-2020, as in the case of option for outdoor medical facilities. So, CHQ took up the issue and wrote a letter to CMD, BSNL on 23-06-2020 urging for further extension upto 30-09-2020 ,considering the alarming situation prevailing in the country due to Covid-19 pandemic.

Today, 29th June, 2020, Corporate Office has issued the order in this regard fully accepting our demand and we thank the BSNL management for the same. (Cortey: AIBDPA website)

VRS retirees ,retired under BSNL VRS-2019, who have attained the age of 60 should give application for commutation of pension.

DOT Sanctions Rs. 3021 crore for payment of Ex-gratia to BSNL VRS retirees.

DoT has issued orders allotting Rs. 3,021 crores for the payment of ex-gratia to the BSNL VRS retirees. AIBDPA has been continuously pressing for the same and letters were sent to the Communications Minister and DOT. This order has been issued today, 26-06-2020. This amount should be paid to the retirees before 30th June 2020.
But this will be only about 50% of the requirement of Rs. 6,000 crores, which is necessary for payment of ex-gratia. The balance also should be allotted without any further delay.

BSNLEU CALLS FOR DHARNA ON 26-06-2020 ON MAJOR DEMANDS

BSNL Employees Union has called for organising dharnas on 26th July 2020 on the major demands of the employees including, immediate allotment of 4G Spectrum, implementation of assured Revival package, payment of wages to contract labour and no retrenchment of contract labour etc. The DOT and BSNL management have not implemented the assurances to BSNL, but is favouring the private companies. Contract workers are being retrenched and their wages not paid for about one year.

AIBDPA has extended its full support and solidarity to the action programme.

Sir,

Sub: – Revalidation of Medical card – extension of date and other issues – reg.

Ref: – (1) BSNL CO letter No.BSNL/Admin/2020/Medical dated 04-05-2020

(2) This Association letter No. AIBDPA/ BSNL MRS dated 13-06-2020

(3) BSNL CO Letter No BSNL/Admn-1/15/12/ dated 19-06-2020

First of all, we express our sincere gratitude to your goodself for issuing the clarification order mentioned (2) above in response to our letter dated 13-06-2020. This has addressed most of the issues. However, it is really heart breaking that the most burning issue of the Pensioners, Non-payment of medical bills both indoor and outdoor, one-time payment paid to CGHS and the medical allowance, continues to be neglected. A humanely approach is overdue on this vital issue and request you to kindly cause necessary action to allot sufficient funds for the same.

BSNL CO vide letter dated 04-05-2020 (referred 1 above) have extended the date of revalidation of Medical card upto 30-06-2020 or till further orders. But it has created some confusion at the lower level as some of the Circles insisting BSNL retirees to submit it before 30-06-2020 and some other Circles like Kerala and Chennai Telephones extending the date upto 30-09-2020 and 31-08-2020, respectively. Hence, we request your kind intervention so that a Pan India extension order upto 30-09-2020 is issued by the Corporate Office at the earliest as in the case of Option for outdoor medical facilities. This will have the advantage of fulfilling both by one go by the pensioners.

We also wish to bring to your kind notice the following genuine issues for your kind consideration and early favourable action.

Discrimination against Family Pensioners.

As per the existing rules, family pensioners are not eligible to submit option for outdoor medical facilities. The option submitted by his/ her spouse is absolute and final. This is a gross injustice and discrimination meted out to the family pensioners. So, a review is very much required in the changed situation.

In cases where both husband and wife are BSNL retirees, only one is eligible for medical allowance. This rule also is discriminatory as in some cases the couple are separated and in some other cases staying in different places. Therefore, a review on the issue is necessary so that both the couple are granted the medical allowance.
