Disciplinary proceedings can not continue after retirement – Supreme Court

The Supreme Court in its judgment in Dev Prakash Vs UP Co-operative Institutional Service Board has stated that disciplinary proceedings against an employee after retirement can not be continued. The judgement was given by the Division Bench of justice T.S.Thakur and Justice C.Nagappan.
The judgement stated that once an employee retires from service, there was no authority vested in the employer to continue the disciplinary proceedings even for the purpose of imposing any deduction in the benefits payable after retirement to the delinquent employees.
Allowing the appeal filed by the above appellant the Division Bench quashed the disciplinary proceedings and also directed the respondent to pay arrears of salary and allowances payable to the appellant and also to pay him his post-retirement benefits.

This is a good judgement. There are several cases in BSNL, where the retired employees are put to many hardships by continuing disciplinary proceedings even after retirement. These cases have to be taken up with the BSNL Management. (Courtesy : Hindu dt. 13th July)

Agreement between BSNL and Reliance Jio on sharing of towers, BTS etc.

We are surprised to know that BSNL has made a Master Agreement on 2nd May 2014 with Reliance Jio Infocom Limited on Passive Infrastructure Sharing with the condition of sharing of Towers, BTS, Antenna, Feeder cable etc. the agreement is for 15 years with.
The rent for one month for Ground Tower is Rs. 38,700 and for the Roof Top Tower Rs. 24,900. For the first three years, there will be reduced rate.
The entire details of the agreement are not with us and hence it is not possible to comment of the details of the same. But, however, such a massive agreement involving about 60,000 towers, connected cables etc. is not a small matter. The unions/associations, who have got important stakes should have been consulted before taking any such action.
It is to be noted that the JAC/Forum of Unions and Associations have gone on strike and stopped unbundling and and sharing of towers in the past. We feel that this agreement is a calculated move to give the benefit of our towers cables etc. to the Reliance Jio which is one of the big corporate in the country owned by Mukesh Ambani.

5.65 lakh crore bad loan of PSU Banks

It is stated that the NPA (Bad loan) of the PSU Banks have reached 5.65 lakh crore. These are mainly the not-refunded loans taken by the corporates and big business. The banks write off thousands of crores of NPA every year with out taking any punitive action against the defaulting corporates and private companies.
It is time that the government and the bank managements take strong action and criminal cases against these big sharks eating the hard earned funds of the common people.

This is murder, murder of the women and children and common people. The people of Gaza City in Palestine is being bombed ruthlessly by the Zionist Israel and already more than 120 common people have been killed and many hundreds seriously wounded.
Despite condemnation by many countries, the attack still continues. But the UN, though expressing its unhappiness, is not condemning the attack and taking serious action.

Russian President Putin visits Castro – A good sign

Vladimir Putin, President of Russia met Veteran Communist leader and former President of Cuba Fidel Castro on 11th June at Havana during his visit of Cuba. This is an important meeting and may restore the close relations between the countries, which existed before the collapse of the Soviet Union ie. USSR.

Cuba was supported and helped by the USSR both economically and against the attack of the US. After the collapse of USSR, the relations could not continue as such. However the present visit of Putin to Cuba and discussion with the leaders of the country may be fruitful for both.

It is reported that Russia has decided to waive 90% of Cuba’s 35.2 billion dollars debt and the balance 10% will be restructured.

It is a good start. The relations should strengthen.

Massive Strike of employees in UK on 10th June.

The massive strike of lakhs of government employees in Britain, North Ireland and Wales on 10th June was a great shock to the government. The striking government employees, teachers and others organised huge demonstrations in front of Trafalgar Square and also before the British Parliament, at Cambridge and other places. In these demonstrations, members of the India Workers Association also participated.
Consequent to the recession and also to the capitalist form of economy where the corporates and MNCs are favoured, the workers have been completely neglected. No wage increase have been given since 2010. The real value of the wages has gone down more than 15% according to the trade unions. The prolonged discussion between the unions and the government did not reach anywhere and hence the strike.
The biggest Public Sector Union Unison, Public and commercial Service union, GMB United, Fire Brigade union and others organised the strike.
Our wholehearted support and solidarity to the striking workers of UK!

BSNL, MTNL to get Rs. 39,458 crores within 5 years.

In a statement in the Rajya Sabha, Communications Minister Ravi Shankar Prasad has stated that within the next 5 years, the BSNL and MTNL will get a fresh investment of Rs. 39,458 crores towards their revival. Both the PSUs under heavy financial strain and are in loss for the last 4 years.
The Communications Minister stated that the Government is quite serious about the revival of the two telecom PSUs and will invest for network expansion.
BSNL has a loan of Rs. 6,388 crore in June 2014 and MTNL about Rs. 14,760 crore. The Market share of BSNL is 11%, reduced from 15% in the last 5 years since 2009. The loss of BSNL for 2013-14 is Rs. 7,085 crore.
If the government decides, there is no doubt that both BSNL and MTNL can be made profitable. Its policy of favouring the private companies should go. Assistance should be given to the telecom PSUs to tide over the present crisis. Corruption has to be routed out. Efficient management is required. Special consideration is to be given to BSNL which is implementing the universal service obligation commitment of the government. Many important suggestions have been given by the Forum in this connection to the Minister. Let us hope that they will be considered and accepted to ensure revival of BSNL and MTNL

The General Council Meeting of CITU started at Bellary, Karnataka today and will continue for four days till 14th July. About 500 delegates are attending representing the more than 60 lakh members. Com.A.K.Padmanabhan, President CITU in his inaugural speech called upon the working class to be prepared for serious united struggles to defend the rights of the workers.
The General Council meeting is important since it will have to review its activities since the CITU All India Conference at Kannur in 2013 and plan the future in the present situation after the BJP has come in to power. The united struggle of the 11 Central Trade Unions on the 10 Point Charter of Demands they have placed before the government and the future programmes will also be discussed. The issues of Casual and Contract workers and unorganised workers is an important item in the agenda.
Com. P.Abhimanyu, General Secretary, BSNLEU, Com.M.Krishnan, Secretary General, Confederation of CG Employees and Workers are attending as Fraternal delegates to the General Council.

Protecting our people is part of the agenda of those who love peace and stability in the region is justice and peace for the world.

World Population Day 2014

According to a United Nations report, Delhi is the second most populous city in the world with 25 million population in 2014. Tokyo continues to be the number one with 38 million.
Delhi has almost doubled its population during the last 25 years since 1990. Mumbai is in the fourth position along with Mexico and Sao Paulo all with a population of 21 million in 2014.

According to the UN report the combined population of China, India, US, Brazil, Indonesia, Japan and Russia is more than half of the world population of 7.1 billion.

Today, 11th July, is the the World Population Day. Controlling the increasing population is an important task the world over.
