BSNL Employees to strike against Merger of BSNL and MTNL
Two lakh and fifty thousand workers of govt. telecom corporation, BSNL, will resort to Immediate Indefinite Strike if the government takes arbitrary decision on merger of BSNL and MTNL, and also on formation of a Tower company bifurcating BSNL. The Forum of BSNL Unions /Associations, which is the co-coordinating Committee of the Unions/Associations of Non-Executives and Executives in BSNL, in its meeting held today, 3rd March 2014, has strongly opposed the move to merge BSNL and MTNL and formation of a Tower company, bifurcating BSNL, which will seriously and adversely affect the future of BSNL and its workforce.
It was only government that divided the DOT services in to three companies, MTNL, VSNL and MTNL, which the workers had opposed at that time. The bifurcation has seriously and adversely affected the growth of the PSUs. During these decades many changes have taken place on issues like disinvestment (MTNL is disinvested to the tune of 46.5%, while BSNL is 100% govt. company), Salary ( MTNL salary is one step higher than BSNL), Perks etc. The proposal of the government now for Merger of the two companies BSNL and MTNL (VSNL already privatised) and at the same time bifurcating BSNL by forming a Tower Company without solving the above issues will further complicate the situation and will seriously and adversely affect the future of BSNL and its workers. Despite the fact that the Forum has already expressed its strong protest at these arbitrary actions and asked to be heard, the government has not discussed the issues with the workers and their unions, who are most important stakeholders. The BSNL workers have already expressed their strong protest by organising massive demonstrations on 3rd March, despite at short notice.
It is reported that the government is proposing to take decision on these matters urgently and hastily before the declaration of the general elections, even without giving the unions/associations a chance to be heard. The workers are, naturally, very much restive and agitated about their future as well as the future of BSNL, if any arbitrary decision is taken on the above matters. The Forum of BSNL Unions/Associations has taken a decision in its meeting on 03-03-2014, that if the government takes any decision for merger of BSNL and MTNL with out resolving the issues mentioned above, then the workers will resort to Immediate Indefinite Strike without further notice.
We demand the government not to precipitate the situation by taking any arbitrary decision on the merger of BSNL and MTNL as also in forming the Tower Company bifurcating BSNL.

BSNL Workers will go on Immediate Indefinite Strike, if government takes arbitrary decision to merge BSNL and MTNL with out resolving the Disinvestment, HR and other connected issues as also on Bifurcation of BSNL by formation of a Tower Company.

Dear Comrades,
The meeting of the Forum of BSNL Unions / Associations held at New Delhi today, 3rd March 2014, after detailed discussion and taking all factors in to consideration has decided to go on Immediate Indefinite Strike, if the government takes arbitrary decision for merger of BSNL and MTNL, with out resolving the Disinvestment, HR and other related issues as also on the formation of a Tower Company, bifurcating BSNL.
It was only government that divided the DOT services in to three companies, MTNL, VSNL and MTNL, which the workers had opposed at that time. The bifurcation has seriously and adversely affected the growth of the PSUs. The BSNL workers have already expressed their strong protest by organising massive demonstrations on 3rd March, despite at short notice.
While the government has sufficient time to meet the private companies/corporates and favourably consider their view points, there is no time to meet the workers and their unions/associations and also consider their views. The government is trying to take arbitrary decisions against the interests of BSNL and its workers just before the country goes to poll. Such hasty decisions will create havoc for both the telecom PSUs and their workers.
It is under such grave conditions that the Forum has taken decision to go on Immediate Indefinite Strike if the government takes decision on the merger of BSNL and MTNL and also on formation of Tower Company by bifurcating BSNL.
The Forum Calls upon each and every worker and all the unions/associations of non-executives and executives in BSNL to be ready for immediate action if the government takes its anti-BSNL decisions. The Immediate Indefinite Strike is to save BSNL and its workers from collapse and utter destruction.
Meet each and every worker and explain the grave situation and prepare for sustained struggle. Earlier we had stopped disinvestment, we have stopped VRS, through mighty struggles. Now it is our duty to wage another mighty struggle for the survival of BSNL. Wait for the Call from Forum.

The Forum of BSNL Unions/Associations will meet on 3 March 2014 to chalk out future programme of action protesting proposal for BSNL-MTNL merger, without first settling the HR, Wage, disinvestment issues etc. The Revival of BSNL and our task in the matter will also be discussed as usual.
The BSNL Management has proposed VRS, formation of a tower company etc, which are not in the best interests of the company and workers.These also will be discussed.

All BSNL Employees, DOT-BSNL Pensioners and BSNL Casual and Contract workers are requested to participate in the Lunch Hour demonstrations to day, 28 February given call by the Forum of BSNL Unions and Associations against merger of BSNL and MTNL and also against bifurcation of BSNL in to a Tower company, which will adversely affect BSNL and its growth. The future of BSNL and its employees as also the services to the subscribers are at peril. We have to protest strongly.

The Forum has already sent letters to the Prime Minister, all ministers in the EGoM and top officers of the DOT demanding that the proposal for merger be stopped till the conflicts and problems of the merger are resolved and the employees’ concerns are attended.

Send the reports of the demonstrations to the All India Unions and the Forum.

Sub: 30% Superannuation benefits for the employees recruited by BSNL
Even 13 years after formation of BSNL, the retirement benefits of the employees appointed by it, have not been finalised. The 2nd PRC recommended 30% superannuation benefit to all the direct recruit employees of BSNL and the Govt decided to implement this recommendation as a social security measure in all the CPSUs. As per DPE guidelines, an amount of 30% of the emoluments can be utislied towards retirement benefits, including GPF, Insurance etc. As per the agreement reached between the Forum of BSNL Unions/Associations and the BSNL Management on 12.06.2012, the Management agreed to review their earlier decision against implementation of 30% superannuation benefit. Now the BSNL Management is limiting it to about 20% without any justification, causing great loss to this section of employees.
The Forum demands that immediate action be taken to ensure 30% retirement benefits to the BSNL recruited employees as this is related to superannuation and social security.

Sub: Do not grant extension of service to Shri R.K. Upadhyay, CMD BSNL after his superannuation in June 2014 and filling up of vacant posts of Directors of BSNL Board.
Respected Sir,
The Forum of BSNL Unions/Associations is the Co-Ordination Committee of the Unions/Associations of Non-Executives and Executives functioning in BSNL. The Forum has been making sustained efforts for the revival and strengthening of BSNL and improving its services to the customers. Forum desires to make the following submissions to the Hon PM.

1. The present CMD BSNL, Shri R.K.Upadhyay, is due for superannuation in June 2014. It is learnt that there is a proposal to seek extension of his service. The Forum is opposed to any such extension of service after superannuation. Further, Shri Anupam Srivastava, Director(CM), BSNL Board, has already been selected for the post. Hence the Forum demands that the post of CMD should be filled up by the selected officer, after the superannuation of the present incumbent. Favorable action in the above matter will be in the best interests of the company.
2. At present two posts of Directors of the BSNL Board are vacant, since posting has not been made after retirement of the incumbent officers. These include the important posts of Director (Finance) and Director (HR). Decision making and expansion in BSNL are heavily suffering due to the non-posting of Directors to these significant posts. The Forum requests that these vacant posts be filled up at the earliest.

Sub: Proposed merger of BSNL and MTNL, formation of subsidiary companies and connected matters on the Revival of BSNL – Reg

Respected Sir,

The Forum of BSNL Unions/Associations is the Co-Ordination Committee of the Unions/Associations of Non-Executives and Executives functioning in BSNL. The Forum has been making sustained efforts for the revival and strengthening of BSNL and improving its services to the customers.
The Forum had submitted to the Prime Minister and to the Empowered Group of Ministers (EGoM) a ‘Declaration’ adopted in the National Convention of BSNL Workers held on 3rd August 2013 at New Delhi, with the proposals/suggestions/demands for the revival of BSNL (copy enclosed). In addition, the Forum has also submitted a detailed Memorandum to the EGoM (copy enclosed).
It is reliably learnt that certain decisions have been taken by the EGoM / DOT /BSNL Board which may adversely affect the BSNL and its future. At no level, the 2.5 lakh employees or their organisations have been consulted or taken in to confidence, before taking these decisions / proposals.
The meeting of the Forum of BSNL Unions/Associations held on 13th February 2014, after detailed discussions had decided to bring these issues to the notice of the Hon Prime Minister and the EGoM for immediate consideration and favourable decisions.
1. Merger of BSNL and MTNL.
The employees/unions were completely against the trifurcation of the Department of Telecom into three corporations viz. VSNL, MTNL and BSNL, which process was completed by 2000. VSNL is already privatised. MTNL is disinvested above 46% and due to the strong resistance by the employees and their unions/associations, BSNL was not disinvested. The market liability of MTNL is huge, to the tune of Rs.12,000 crore. Different pay scales exist in BSNL and MTNL. The transfer liability and other service conditions including pension differ.
The Forum is of the strong opinion that unless these problems, complications and differences are removed and resolved, any merger of BSNL and MTNL will be counterproductive. The bitter experience of the merger of Air India- Indian Airlines is before us, which has resulted in continued agitations and negative growth. Such a merger will be disastrous for both BSNL and MTNL.
2. Formation of subsidiary companies of BSNL.
The Forum strongly condemns the decision of the Government / DOT / BSNL Board on the formation of a subsidiary company from BSNL by hiving off the tower assets. BSNL has got more than 62,000 towers, which in one of its biggest assets, like Optical Fibre /Copper Cable network. Taking away these huge tower assets will weaken BSNL and its huge business prospects. Further, transferring of thousands of staff to the proposed company will result in innumerable problems including transfer liability and pension issues.
The Forum demands that this proposal/decision be rescinded immediately and the tower assets be retained with BSNL and monetized effectively.
3. Compensation for Loss on landlines for rural / remote area service.
One of the main reasons for the loss of BSNL is that it is providing rural land-line services, which are loss-making, but is part of the social commitment of the government for universal service. The private companies seldom provide services in these areas. Services in the naxal-affected and border areas of the country are fully provided by BSNL, which are loss making and risky. At the time of disasters like landslides in Uttarakhand or cyclone in Odissa/A.P., it was BSNL alone which restored its services immediately which was appreciated by all. The loss for BSNL for these rural services comes to about Rs.12,000 – 13,000 Crores.
The Forum demands that this loss caused to BSNL for implementing the social commitment of the government be fully compensated.
4. Soft Loan to BSNL for expansion and development.
BSNL has been posting loss for the last four financial years coming to a total of about Rs.25,000 crore. Till 2008-09, it was posting profits totaling to about Rs. 47,000 crores. The loss has resulted mainly due to the extreme delay of 6-7 years in grant of mobile licence to BSNL after the same was granted to the private companies and the withdrawal/reduction of the ADC, USO Fund, and License Fee Reimbursement etc. which was assured at the time of corporatisation. Another and most important reason was the cancellation of the tenders for both 45 million, 93 million and 5 million mobile equipments which resulted in a grave situation disabling BSNL from expansion and development of its services.
BSNL at present does not have the funds required for fast expansion and development. The market share of BSNL has gone down and may reach one digit level at any time.
Hence, the Forum demands that BSNL be granted adequate soft loan for expansion, development and modernisation of its networks.
5. Condition of mandatory purchase of equipments from ITI to be scrapped.
BSNL is mandated to purchase 30% of equipments from ITI. There is much delay in supply of equipment from ITI, which has resulted in extreme delay in the expansion of services in the Western part of the country and loss of revenue. ITI has failed to supply equipments in time. Further it is understood that ITI is functioning as an agent by purchase and supply of equipments, instead of a manufacturer, resulting in the present unhappy situation.
The Forum demands that the decision of mandatory purchase from ITI be rescinded to enable BSNL to purchase from open market according to requirement.
6. Spectrum Liberalisation and Trading.
According to Govt decisions, the telecom companies who have been allotted spectrum through auction after 2010 can liberalise as also trade its airwaves. BSNL was allotted spectrum before 2010 and without auction. Hence, BSNL cannot liberalise or trade its spectrum like the private operators without making payment. This is putting BSNL to a great disadvantage. Without spectrum liberalizaion, BSNL cannot start 4G services.
Considering the financial condition of BSNL and the Govt’s resolve to revive BSNL, the Forum demands that BSNL also be allowed to liberalise and trade its spectrum for upgrading its services and enhancing revenue without paying extra charges.
The Forum requests the Prime Minister and EGoM to favourably consider the above demands and issue necessary instructions, which will help the revival of BSNL and ensure a better service to the nation. It is also requested that the Forum may kindly be granted a meeting with the Prime minister to present our case.

Issues for Presentation by the Forum of BSNL Unions/Associations in the meeting with the CMD BSNL on 30th November 2013

(1) Procurement of equipment like Broadband Modem, Cables, Mobile lines etc.
While BSNL C.O. intimates that equipment like Modem, Cables, Mobile lines, Jointing kits, drop wires etc. are purchased and available, the heads of SSAs are stating that the same are not available with them. This contradictory position is untenable. Adequate equipment should reach field level to provide connections and maintain them effectively.

(2) Providing new landline connections.
The reports from field level indicate that although people apply for new landline and Broad band connections, they are discouraged by field level management stating that it is not feasible to provide the same due to lack of cable lines in that area. In some SSAs, the registration for new connection is made, but one or two months afterwards, the waiting list is wiped out stating that there is no feasibility.

This position is completely unacceptable. The responsibility of BSNL is to register and provide new connections and maintain them effectively. Whatever has to be done in this matter has got to be done.

(3) Providing new connections in new colonies/flats
In all the towns/cities, new colonies are coming with hundreds of houses/flats. They require telephone connections, landline/mobiles. The private telecom companies are maximum utilizing this opportunity by laying cables to these colonies/flats and immediately providing connections. BSNL is far behind in this respect.

BSNL should aggressively take up this issue, which will help in increasing connections and revenue in a big way.

(4) Fresh Recruitment of Staff.
While more than one lakh thirty thousand non-executives had retired since formation of BSNL, the recruitment, except in the cadre of TTA, has been almost nil. This has adversely affected the maintenance of the telephones and efficiency. Fresh blood is required in any organization to grow. The average age of the non-executives has already reached more than 50 years and one can not expect maximum efficiency, though they are well experienced.

Fresh recruitment in the non-executive cadres has to be taken on a fast-track basis.

(5) Discontinue Telephone Advisory Committees (TAC)
In the present circumstances when the telecom services are not monopoly of the government and many competitors are in the field, there is no necessity for the Telephone Advisory Committees, unnecessarily spending a lot of money. BSNL Management should take up the matter with government to get the TACs discontinued.

(6) Maintenance of Batteries etc.
It is reported from many SSAs that the batteries which are very important for the maintenance of the exchanges and BTSs, are in bad condition resulting in break-downs. This need to be attended on a fast track basis.

(7) Circulation/ Propagation of BSNL Plans for Subscribers.
Except in very few circles and SSAs, the new plans and projects of the BSNL are not given publicity and the people are unaware of the same. Even in front of the Customer Service Centres in many places, such information are missing. This has got to be done in an aggressive way.

(8) Meeting the subscribers at his/her premises.
There is urgent need of majority of the officers /employees to be in the field, instead of sitting inside the offices. BSNL should not wait the people to come to it, but instead should reach to the people. Meeting the subscribers at his/her premises and getting feed back from them will go a long way in better customer relations and for solving the problems their problems satisfactorily.

(9) One Window System for dealing with customers.
Now the subscribers/customers are feeling difficulty in conveying their grievances and issues and in many places, they are asked to meet several officials/counters for the same. The subscriber feels harassed. In all the customer service centres and offices, One Window System should be arranged for the customers’ issues.

(10) Roll –out Plans for LTE / 4G.
At present, the 2G services are completely unsatisfactory as per reports received from the field. There is a lot to be improved. In addition, the LTE/3G/4G have to be rolled out in a big way.

(11) BBNL and Role of BSNL.
As per the reports in the media, BBNL is going to become a full fledged telecom company. It is not clear what will be the role of BSNL in BBNL in the new situation and what will be the impact on BSNL. BSNL should get the priority status in BBNL, instead of being a silent partner.

(12) Works Committee at SSA level.
BSNL Corporate Office has already directed regular holding of Works Committees at SSA level as demanded by the unions. Despite reminders from C.O. , many SSAs have not yet started the process.

The Works Committee meeting is intended to discuss about the developmental programme, increasing efficiency etc. The field level staff with their experience will be able to give good suggestions on the above issues. The management can explain the actual requirement from the staff. Such discussion followed by concrete action will be effective both on expansion, maintenance and better customer relations.

The Works Committee has to be extended to circle level also, where a higher form of discussion, considering the entire circle, can take place.

Hold the Circle Conventions on ‘Revival of BSNL’

Circle Conventions on Revival of BSNL, Forum

The National Convention on ‘Revival of BSNL’ was held on 3rd August 2013 at Mavalankar Hall, New Delhi with massive participation of workers and addressed by Central Trade Union leaders as also the General Secretaries of the BSNL Unions/Associations. The National Convention adopted a Declaration with suggestions for improving the BSNL and its services to the customers. It was decided that similar conventions should be held at Circle levels also to give maximum publicity and propaganda on the issue of BSNL and the need to strengthen it.
So far, reports have been received about holding of successful conventions in Trichur (Kerala)and Lucknow (UP East). The Forum of BSNL Unions/Association meeting held on 27th November has decided that all the circle conventions should be held at the earliest.
I am sure that convener of the Circle Forum and all circle secretaries will take initiative for holding the Convention early in contact with the Convener Forum and the General Secretaries.
