Central Trade Unions, Parliament March on 12th December 2013

One of the biggest Parliament March is going to take place tomorrow, 12th December 2013. The Parliament March has been called by the 11 Central Trade Unions including INTUC, BMS, HMS, CITU, AITUC, UTUC etc. About 40 All India federations, including BSNLEU are participating.The demands are the same viz. against price rise, issues of unorganised workers, against anti-workers policies etc.
By the evening of today itself, thousands of workers from all over the country has reached the capital to participate in the Parliament March.
Lakhs of workers are expected to participate. BSNL workers will start from the Eastern Court by 10.00 AM. Comrades are requested to reach there in time.
Let us make the Parliament March a Historic Demonstration of the Indian Working Class!

All India Women’s Democratic Association (AIDWA), one of the biggest women’s progressive association in India, has elected new office-bearers in its 15th National Conference held at Bodh Gaya in Bihar this week.
Coms. Malini Bhattacharya has been elected as President, Jagmati Sangwan as General Secretary and P.K.Sreemathi as Treasurer.

UP State Employees Strike continues for the 5th Day

The State Government Employees are continuing their strike for the 5th day, since no agreement could be reached so far. It seems that no meaningful discussion has taken place so far.
The union leaders have stated that they will continue and expand the strike by bringing even those sections of departments, where the strike was not decided first.
It is reported that more than 60% of the workers are on strike out of the total 18 lakh employees.
It is high time that the UP Government discussed the issues with the unions and come to an agreement.We fully support the strike of the UP state government employees.

Red salute to Punnapra – Vayalar Martyrs

Punnapra-Vayalar revolt

It was in October 1946 that the peasants and workers in Alappuzha area revolted against the dictatorial rule of Travancore Dewan Sir C.P.Ramaswamy Iyer and took to arms against the government’s forces. It is stated that more than 400 people were killed by the police. The first massacre took place in Punnapra on 24th October and the second at Vayalar on 27th October 1946. Some of the comrades who participated in the revolt are still alive like Comrades V.S.Achuthanandan, Chandranandan etc.
As usual every year, the anniversary of the revolt is observed with the participation of thousands of people this year also.

My Red Salute to the Martyrs who showed the path of revolt and resistance! Let their martyrship be our inspiration for the fight against imperialism and neo-liberalisation!

EPF may get higher than 8.5% interest in 2013-14

The continuous pressure by the central trade unions and the better performance may result in a slight increase of interest for the more than 5 crore EPF subscribers in 2013-14. Last year, the interest paid was 8.5%.

The interest will be announced after the meeting of the Central Board of trustees (CBT) chaired by the Central Labour Minister takes the decision.

Staging demonstration during lunch hour not misconduct: Madras High Court

Quashing the charge memo issued to two State Bank of India (SBI) officers alleging misconduct for holding lunch hour demonstration in August last year, the division bench of Madras high court on 5 August held that a mere peaceful demonstration, per se, inside the campus, could not be considered as misconduct under the rules. Earlier, a single bench of the high court had rejected the writ petitions on the ground that the court could not interfere at the stage of charge memo.The two officers – D. Thomas Franco Rajendra Dev, deputy manager and D. Suresh Kumar, chief manager of SBI in Chennai, were the general secretary and president of the All India State Bank of India Officers’ Association respectively. The association held a lunch hour demonstration on August 28, 2012 in front of the local head office and in all the administrative offices of the bank. For this they were issued charge memo for alleged misconduct under the bank’s officers’ service rules. (From: the Hindu/ Working Class)

Pension, Gratuity, Leave Encashment are Employees Properties: Supreme Court

In the absence of any provision in the pension rules, a state government could not withhold a part of pension and/or gratuity during the pendency of departmental/criminal proceedings, held by the Division Bench of Justices K.S. Radhakrishnan and A.S. Sikri stating, “It is an accepted position that gratuity and pension are not bounties. An employee earns these benefits by dint of his long, continuous, faithful and unblemished service. Right to receive pension was treated as right to property.”

“According to Article 300 A of the Constitution, no person shall be deprived of his property save by authority of law. A person cannot be deprived of his pension without the authority of law. It follows that the attempt of the appellant [in this case the Jharkhand government] to take away a part of pension or gratuity or even leave encashment without any statutory provision and under the umbrage of administrative instruction cannot be countenanced.”

“It hardly needs to be emphasised that the executive instructions do not have statutory character and, therefore, cannot be termed as ‘law’ within the meaning of Article 300A of the Constitution. On the basis of such a circular, which is not having force of law, the appellant cannot withhold — even a part of pension or gratuity. So far as statutory rules are concerned, there is no provision for withholding pension or gratuity in the given situation. Had there been any such provision in these rules, the position would have been different.” In the instant case, respondent Jitendra Kumar Srivastava was sanctioned 90 per cent provisional pension pending an enquiry. The remaining 10 per cent of his pension and salary was withheld. He was also not paid leave encashment and gratuity. The Jharkhand High Court directed the State government to release the withheld pension and salary and other benefits. The present appeals are directed against this judgment. Central Govt. Announces VII Central Pay Commission

The central Govt. today decided for formation of the VII Central Pay Commission which will recommend the new pay revision for the 85 and odd lakh central government employees and pensioners including the defence personnel. The recommendation of the CPC will be with effect from 1st January 2016. Probably this is the first time that the CPC has been constituted more than 2 years back. The Central govt. employees had demanded for pay revision with effect from 01-01-2011 after 5 years of the last CPC, the recommendations of which were implemented from 01-01-2006. The appointment of this CPC and the statement of Finance Minister P.Chidambaram that the recommendations of this CPC will be w.e.f. 01-01-2016 is against the demand of the Confederation of CGE and workers.

Now for the last 3 CPCs, the period has been 10 years each, but earlier the period was longer. The I CPC recommendations were implemented from 1946, II CPC from 01-01-1960, III CPC from 1974, IV from 1986, V from 01-01-1996 and the VI CPC from 01-01-2006. Now the present VII CPC will be effected from 01-01-2016.

The present announcement of the government is, of course, with an eye on the coming elections both in some states and the Parliament elections in 2014. Most of the states implement the CPC recommendations for their employees also.

Casual and Contract workers will participate in the Demonstration on 25th September called by Central Trade Unions.
BSNL Casual and Contract Workes Federation (BSNLCCWF) calls upon all its members to massively participate in the demonstration/meeting/rally being organised by the Central Trade Unions on 25th September on the major demands of the working class as decided by the National Convention of Workers held at Mavalankar hall New Delhi on 6th August 2013.
The demands include stopping of price-rise, No Disinvestment/Privatisation of PSUs, Rs. 10,000 as Minimum Wage to contract workers, Implementation of Social Security measures etc.
Organise the programmes jointly with BSNLEU and Central trade Unions.

10% DA increased for CG Employees w.e.f. July 2013

The Cabinet has decided to increase 10% DA to the central Government Employees and pensioners w.e.f. July 2013, as per the increase in the cost of living for the earlier six months. The Central Government Pensioners also will get the increase. Accordingly the DA will increase from the present 80% to 90%. From January 2013 onwards, the DA was increased by 8%, increasing from the earlier 72% to 80%.
It is estimated that Rs. 10,879 crore will be the additional expenditure for increasing the DA for the 50 lakh employees and 30 lakh pensioners.
