Casual/Contract workers - BSNL - Brutal exploitation

Reports are being received from many SSAs each day about the non-payment of minimum wage, non-implementation of social security measures etc. to the casual/contract labour who are engaged in BSNL.
There are many Acts of the Parliament like Minimum Wages Act, Contract Labour Act, EPF, ESI Act etc which are not implemented to these poorly paid workers. Brutal exploitation by the contractors and the management continues for years.
BSNLEU and BSNL Casual and Contract Workers Federation (BSNLCCWF) are putting maximum efforts to put an end to this exploitation and for implementation of the clear orders on wages etc. Agitations are going on in many SSAs. BSNL Corporate office is washing their hands stating that they have issued all instructions for implementation and that they are getting compliance reports from Circles/SSAs.
This situation has put the entire management in a very dark colour, exploiting or supporting exploitation. It is a shame on the top management, that while they receive very high salary from the BSNL, they refuse to pay/ refuse to ensure payment of even minimum wage fixed by the government to these poorly paid casual/contract workers.
Yes, the only way is struggle, the struggle for justice. Already through continued and sustained struggles, the workers in W.Bengal, Kolkata, T.Nadu and Kerala, to a certain extent, have achieved the demands. The struggle in other states are continuing.
Let us continue the struggle till the BSNL management opens its eye and ensure justice to the workers.Let us remove this black dot in the face of BSNL. BSNLEU and other organisations of non-executives and executives should come together to put an end to this brutal exploitation.

End the Exploitation of Casual and Contract Workers in BSNL

Exploitation of casual/contract labour in BSNL

Despite continuous representations and agitations on the issues of the casual and contract workers, the inhuman exploitation continues at field level. Whenever we meet the management, the sterotyped reply is that the CGMs have reported that in their circles, all rules are implemented including payment of minimum wage. implementation of EPPF / ESI etc. But the ground reality is completely different. Hence it has become necessary for the union to address the mangement with the details in each and every circle/SSA. The BSNL management has also submitted to the Parliament Standing Committee on Labour that all rules and regulations are implemented in the case of casual and contract workers. These utter lies of the management has got to be exposed and action taken to implement all orders. BSNLCCWF is meeting the BSNL C.O. officers continuously on these issues, but the results are meagre.
It is therefore necessary that District Secretaries of BSNLEU and BSNLCCWF together should collect the details and send it to the Parliamentary Standing Committee on Labour with covering letter. The following details are required:
1. Name of the casual contract workers
2. Minimum wage eligible according to Govt. notification
3. How much is actually paid.
4. Whether EPF / ESI amount is deducted and along with employers share is deposited in the EPF / ESI.
5. Whether any BSNL officer is present at the time of payment.
Any other important issue may also be included.

The address to which the memorandum is to be submitted is:
The Chairman,
Parliamentary Standing Committee on Labour,
Parliament Annexue
New Delhi – 110001
A copy should be sent to CHQ BSNLCCWF (Both to President at Delhi address and General Secretray at Kolkata address)

It is a shame to BSNL and even to the unions and employees tht such inhuman exploitation is taking place in BSNL, a prestigious PSU. We have to put an end to this exploitation. If all of us are deermined, there is no doubt that we can change it and changee it quickly. Let us start the campaign. Let us win.

2 days strike 20-21 February 2013

The BSNL Casual and Contract Workers Federation has called upon the casual and contract workers in BSNL to join the 2 days General Strike on 20-21 February along with the other workers in the country. The strike has been called by the 11 Central Trade Unions on the major demand of the people and the workers.

Many demands in the Charter are directly connected with the demands of the casual and contract workers including the minimum wage of Rs.10,000, implementtion of social security benefits, Recognition of Unions, Implementation of ILO resolutions by India etc. Already, the BSNLCCWF has started maximum propaganda to make the strike a complete success.

Casual labour appointed in BSNL eligible for Govt. Pension – CAT Ernakulam

Casual labour - Pension

The recent judgement of Central Administrative Tribunal Ernakulam in OA No. 289 of 2012, dated 11th December 2012 with regard to grant of Govt. Pension to casual labour regularised in BSNL is a remarkable one. The CAT has ordered that the casual labour who is regularised in BSNL as per the DOT order dated 29-09-2000 ‘is to be governed by the pension rule as it stood applicable in the Department of Telecommunication as on the date of absorption and not in the new scheme.’
As per this order the casual labour who are regularised in BSNL are eligible for Govt. pension. The BSNLEU has taken the issue several times with the BSNL Management and DOT, but the latter accepted the govt. pension only in case of TSM and not casual labour.
BSNLEU is taking up the matter with the BSNL management that the order is implemented to all casual labours.

BSNL Casual and Contract labour

BSNLEU and BSNLCCWF have been continuously making maximum effors to ensure that the thousands of Casual and Contract labour who are engaged by BSNL through contractors are saved from the inhuman exploitation and justice meted out to them. BSNL Management has been compelled to issue orders on the various demands like payment of minimum wage, implementation of social security measures like EPF, ESI etc. But unfortunately these are not implemented in the field level causing undue hardship and loss to the casual-contract workers.
I met Shri A.K.Sanghi, GM(Admn), BSNL yesterday and told about the inhuman exploitation despite the clear cut orders of the BSNL Corporate office. I gave details of some circles and also informed about the agitation going on in many circles. He agreed to go through the same and take remedial measures.

Rs.10,000 as Minimum Wage is fully Justified

02 Wednesday Jan 2013

000, Minimum Wage - Rs.10

Rs 10,000 as minimum wage, is a major demand for 20-21 February, 2013 nation-wide general strike of the workers. All Central Trade Unions and Industrial Federations, representing the entire working class of the country, raised this demand. It is important to note that the trade unions raised this demand for the first time in the national convention of the workers in New Delhi on 7 September 2011. Working Class Family Income & Expenditure Survey, 1999-2000, conducted by Labour Bureau, shows that on an average more than 4 persons in a family depend on income of 1 (one) worker. Therefore, the minimum wage of the worker shall take into consideration the expenses incurred by 4 members’ family unit of a worker. The Planning Commission itself had adopted an average of 2100 calorie in urban areas per person per day as minimum nutritional norms or the poverty line. Based on NSS Reports No.538 on Consumer Expenditure and No.540 on Nutritional Intake in 2009-2010 in urban areas, to meet the requirement of this 2100 calorie intake per person per day bench mark of Planning Commission itself would require Rs.2125 in 2009-2010. And for a family of four (4) would require Rs.8500 per month just to be on poverty line. With 12.5% inflation rate in next two years, based on the consumers price index for the working class, this amount of Rs.8,500 comes to Rs.10,758 per month in 2011-2012 and higher in the current 2012-2013 financial year.
But, Minimum Wage has to be higher than the poverty line expenditure. It is important to note the latest 66th round of National Sample Survey (NSS) report, which shows that health care and other minimum necessities gobble up major portion of the income of the workers. Such expenses combined with high rate of food inflation and spiralling price rise, forced the workers to cut their food expenses resulting in sharp drop in calorie intake of entire worker’s family. NSS report also shows that on the basis of Planning Commission’s 2100 calorie intake norms itself, 74% of urban people were living below it and almost all of them are unorganized labour to whom Minimum Wages Act applies. A state-wise study will show that in the current financial year, the maximum amount as minimum wage is fixed as Rs.6000. Whatever the minimum wages are fixed, those are also not being paid, under some pretext, pushing the vast majority of workers much below the poverty line struggling for survival and suffering from malnutrition. Therefore, working class is justified in urgently demanding Rs.10000 as Minimum Wage which needs to be adjusted with price rise and inflation. The Planning Commission was established for planned development for the people of the country. However, same Planning Commission, which fixed 2100 calories per day per person in urban areas as minimum nutritional norms; spent 30 lakhs for renovation of Yojna Bhavan toilets and CCTV for surveillance; and arbitrarily and ridiculously announces Rs.32 per day per person as poverty line in urban areas. ( Working Class – January 2013 issue)
