Meeting with Chief Labour Commissioner

Comrades V.A.N.Namboodiri, President and Animesh Mitra, Secretary General, BSNLCCWF met the Chief Labour Commissioner Shri Anil Kumar Nayak today, 27th October 2016, and presented  the issues of the casual and contract Labour in BSNL. The  representatives of the Federation brought to the notice of the CLC that neither minimum wages are being paid, nor EPF and ESI  implemented in many places, despite clear government and CMD BSNL orders in this respect. CLC stated that he had issued instructions to the State labour commissioners in this respect earlier and will also send a reminder to ensure that the labor laws are got implemented. The case of implementing the Group D pay scales for the casual labour was also pointed out. . The representatives submitted their memorandum on the Gazette Notification on Minimum wage which proposed Rs. 350 per day. BSNLCCWF demanded Rs.650 per day and also upgradation of categories considering the number of years etc. CLC gave a patient hearing to the representatives.

Parliament March BSNLCCWF

The Central Secretariat of the BSNL Casual and Contract Workers Federation held at New Delhi has decided to organise a Parliament March on 22nd February 2017 focusing on the major demands of the BSNL Casual Contract Workers. Thousands of workers are expected to participate. The Circle Secretaries of BSNLCCWF are requested to ensure maximum participation and as also directed by the CHQ. The demands include regularisation of casual contract workers, implementation of minimum wage and social security measures like EPF, ESI etc. The participants should bring flags, banners etc. Detailed circular is being sent by BSNLCCWF CHQ. BSNLEU Circle/District Secretaries are requested to give all assistance and leadership to the programme.

Kerala BSNLCCWF agitation – All transfers cancelled. Congratulations!

Good News ! All those transferred in connection with Contract Labour agitation Kerala, brought back to Circe Office.

All the comrades who were transferred from CGM Office to other offices in connection with BSNLCCWF agitation have been reposted to Circle Office. It is a great victory for BSNLEU & BSNLCCWF. All other transfers, suspensions, etc. had been cancelled earlier. Due to the agitation the daily wages of contract workers were raised by Rs.80 – 100, but union leaders were victimized.

Hearty Congratulations to BSNLEU & BSNLCCWF comrades of Kerala for the great victory !

Victory for BSNLCCWF Chhattisgarh – Rs.2.79 crore paid towards EPF by BSNL Management.

Victory for BSNLCCWF Chhattisgarh – Rs.2.79 crore paid towards EPF by BSNL Management.

The EPF Appellate Tribunal, New Delhi in it’s order dated 20.10.2016 has dismissed the appeal filed by CGM, Chhattisgarh circle against the decision of the Assistant Provident Commissioner, Chhattisgarh directing the CGM BSNL to remit Rs.2,79,19,404 towards EPF contribution of contract workers. The order will benefit the Contract Workers.

 

The apathy of the BSNL Circle Management can be understood from the fact that out of total 84 hearings since 2005 by Assistant Provident Commissioner, Raipur, only very few hearings were attended by BSNL representatives.

Com.V.A.N.Namboodiri, President, BSNLCCWF met Shri A.M.Gupta, GM(Restructuring) today, 18-10-2016, and discussed about the non-implementation of the labour laws in many circles. GM(Restg)  assured that he is monitoring the various circles in this respect and will ensure that the labour laws are got implemented.

Implementation of labour laws in UP(East) – Meeting with CMD BSNL

Com. V.A.N.Namboodiri, President, BSNLCCWF  met Shri Anupam Shrivastava, CMD BSNL today, 18th October 2016, and pointed out the extreme pitiable condition of the casual and contract workers in UP(East) Circle, where none of the labour laws and CMD orders with regards the Minimum Wages, EPF, ESI etc. are implemented despite many representation. He also handed over the hundreds of Post Cards / letters sent by individual casual contract workers from UP(East), which exposed the statement of the UP(East) management that all orders are being implemented. CMD assured that suitable actions, including cancellation of licence of the licences of the contractors will be done, if the labour laws and corporate office instructions are not implemented.

Com.Namboodiri handed over the new VDA orders dated 30-09-2016 and the Gazette Notification proposing increase of the daily wages to Rs. 350 for the unskilled at C Class cities and other rates at semi-skilled/skilled and for A,/B class cities. The final orders are expected to be issued by the CLC by first November. Com.Namboodiri requested that the orders when issued may be implemented with out any delay.

Winter Session of Parliament starts on 16th November 2016

It has been reported that the Winter Session of the Parliament will start from 16th November and will continue till 16th December 2016.

As usual, it will be a time of protests by various sections of people to focus the attention of the government to their plights. Confederation of Central Government Employees has already called for a Parliament march in November. BSNLCCWF will be organising a Parliament March in November to focus their issues, the date for which will be finalised in the meeting of the Secretariat to be held on 26th October 2016.

Variable DA for Minimum Wages revised for Contract Labour from 01-10-2016

The Chief Labour Commissioner (Central) has issued orders on 30-09-2016 revising the Variable DA for contract workers w.e.f. 01-10-2016. Accordingly, the unskilled contract worker in ‘C’Class cities will get Rs. 250 as daily wage. For the semi-skilled, skilled and highly skilled as also in B class and A class cities, the daily wages will be higher.

Gratuity to TSM/ Casual Labour and Contract Workers

As per government of India Orders and labour laws, TSM/Casual Labour and Contract Worker are eligible for payment of Gratuity. The issue was brought before the Parliament Standing Committee and the Management several times. After much persuasion, the Management Committee approved gratuity for TSM/Casual labours, but the BSNL Board is yet to approve the same. In this connection Com.V.A.N.Namboodiri, President and Com.Animesh Mitra, Secretary General BSNLCCWF had met the Management and demanded for early discussion. Com.V.A.N.Namboodiri met Shri N.Sivasailam, Additional Secretary DOT who is the DOT member in the BSNL Board and discussed the issue demanding for early decision. The issue is being pursued vigorously.

BSNL should pay bonus to contract workers

After much discussion and persuasion by BSNLEU and BSNLCCWF, orders have been issued for payment of bonus to regular employees and TSM/Casual labours on 07-10-2016. But no order has been issued for Bonus to contract workers engaged in BSNL. Contract workers are eligible for bonus as per labour laws. This has been brought to the notice of the BSNL Management several times.

We demand that BSNL management issue early orders for payment of bonus to the  contract workers also.
