The Supreme Court in its judgment in Dev Prakash Vs UP Co-operative Institutional Service Board has stated that disciplinary proceedings against an employee after retirement can not be continued. The judgement was given by the Division Bench of justice T.S.Thakur and Justice C.Nagappan.
The judgement stated that once an employee retires from service, there was no authority vested in the employer to continue the disciplinary proceedings even for the purpose of imposing any deduction in the benefits payable after retirement to the delinquent employees.
Allowing the appeal filed by the above appellant the Division Bench quashed the disciplinary proceedings and also directed the respondent to pay arrears of salary and allowances payable to the appellant and also to pay him his post-retirement benefits.

This is a good judgement. There are several cases in BSNL, where the retired employees are put to many hardships by continuing disciplinary proceedings even after retirement. These cases have to be taken up with the BSNL Management. (Courtesy : Hindu dt. 13th July)
