BSNLCCWF, Oneday strike

BSNL Casual Contract Workers Federation (BSNLCCWF), representing the thousands of TSM,Casual and Contract Labour engaged in BSNL has given Notice for One day Strike to the BSNL Management on the Charter of Demands submitted to it on months back as per the decision of the Bhubaneswar CEC Meeting.

SSA Level Dharnas, CGM Office March were organised followed by a Historic March to CMD Office on 15th October 2014. But still the issues remain as they are. Hence it was decided to call for strike on 27th November 2014.

The first demand is “Save BSNL – Save Nation”. The Casual and Contract Workers understand that their future depends upon the financial viability and better service of the company. They are putting full time or more time excellent and efficient work, which is fully aware to all. If BSNL fails, the workers lose their job. Hence it is necessary that BSNL is saved and flourishes. Of course other demands are also there.

BSNLCCWF seeks the support of all the regular workers in this fully justified strike.

Why Strike on 27th November by Casual and Contract Workers?

27th November, BSNLCCWF, One day strike

BSNLCCWF has called for a one day strike on 27th November 2014 by the casual and contract workers engaged in BSNL. What is the immediate provocation for a strike?

It is not at all an immediate provocation. The more than one lakh casual and contract workers in BSNL have been continuously requesting the BSNL Management from the corporate office level to the GM level to ensure that the casual contract workers are treated as human beings and whatever is eligible for them as per the labour laws, the government orders and orders endorsed by the BSNL Corporate Office should be implemented at the field level.

The BSNL Management at first refused even to discuss the issue of casual and contract labour with the union. After continued representation to the DOT, Minister, Chief Labour Commissioner and also Parliamentary Standing Committee on labour, the management has started discussion. BSNL C.O. also issued clear instructions on 5th November 2008 as also later on the implementation of the minimum wage, social security measures like EPF, ESI etc. But these are violated by the field officers and not implemented. This fact has been brought to the notice of the Corporate office with documents/proof, but the management sat silent blindly depending on the Compliance reports received from the CGMs. In fact, the top management is also very reluctant to take any action on the law-violating contractors or the concerned officers. Their mindset is that the casual contract workers are slaves and they should be satisfied with whatever pittance is given to them and if they protest they should be sent out of their job. This is a kind of mental illness, which it is difficult to cure. These officers/ contractors who are getting high salary/ big commissions are not concerned whether the minimum wage is paid or not to the toiling worker.

There are more than 4,000 casual labour including TSM, who are left out and not regularised, not because of lack of orders, but due to the complete neglect and delay of field management in forwarding their cases to the Corporate Office. About 9,000 such casual labour / TSM, who are much junior to them, have been regularised, because their cases were forwarded to C.O. On the plea of a Supreme Court order, these left out casual labour/TSM are denied regularisation, while such workers have been regularised as a one time measure by government departments such as Customs, Income tax etc, based on the orders of the DOP andT. Why BSNL, a fully owned government company, does not implement the same orders and regularise the left out casual labour/TSM? Again it is the same mentality which sees the workers as beggars and nothing more.

The casual and contract workers are very much concerned about the financial health of BSNL. The company is their bread and butter for which they have been working for 10 to twenty years and more. If BSNL collapses, their future is in peril. Naturally they are interested in the health of the company. They want that the government to change its anti-PSU policy and assist it to come up. The BSNL Management has also to do its duty efficiently.

These are the main issues on which the strike is called for. The Notice for strike will be issued shortly in which all the demands will be focused.

It is the immediate task to meet each and every worker, explain the demands and prepare him for the one day strike and future struggles. We have to ensure that the entire workers participate in the strike on 27 October.

Struggle for Unity, Unity for Struggle and Struggle and Unity for Progress!

BSNL C.O. seeks details on Casual / Contract Labour from Circles

BSNLCCWF, Standing Committee

Consequent to the meeting of the Parliamentary Standing Committee with the BSNLCCWF representatives and the BSNL Management, it has sought information with regard to the details of the casual and contract labour in BSNL as also the name of contractors, whether they are registered with EPF etc. from the BSNL Management.

BSNL Management has stated that 27 CGMs have given compliance certificates that all the labour laws, including payment of minimum wage, implementation of social security measures like EPF, ESI etc. When we stated that these are false reports, the management wanted us to give specific cases, where they are not implemented. BSNLCCWF written a large number of letters with specific instances of violation of labour laws in a large number of divisions, but they were never replied nor any remedial action taken. BSNL C.O. and for that matter CGMs, fully reiterated what the field officers have reported fully knowing that the reports are completely false. No action was taken against any contractor or officer for violation of the labour rules and brutal exploitation of the casual/contract labours who work for the BSNL through which they can maintain their poor families. But the contractors and sometimes the officers joined together for brutally exploiting the toiling labour.
Will their mindset be changed so that the exploitation can be stopped?

BSNLCCWF, March

The Bharat Sanchar Bhawan March of the BSNL Casual and Contract Workers at New Delhi, held today, 15th October 2014, was really historic. It was a determined declaration of their rights and also a warning to the Management and the contractors that they will not any more tolerate the brutal exploitation continuing for a long time. It was a declaration that the workers will fight to be treated as human beings and not wage slaves.

The Eastern Court were the rally was held was full of red banners and flag of the Federation and the circle unions affiliated to it. Wall posters with the demands were placed near the rally site. Delegates came from Kerala, T.Nadu, Karnataka, M.P., U.P., Odisha, Chhattisgarh, W.Bengal, Assam, North East, Uttarakhand, ALTTC and other states. Comrades from Haryana and Maharashtra could not attend due to the assembly elections being held to day. Comrades from A.P. could not come due to the natural disaster. The delegates was a cross section of India. Delegates raised slogans in various languages demanding settlement of the issues and also the need for joint struggles.

Com. A.K.Padmanabhan, President of CITU and one of the tallest leader of the TU movement, inaugurated the March. who spoke on the demands of the casual-contract workers, the struggles conducted by the CITU and other Central Trade Unions, the discussions held in the Tripartite Labour Conference on the Minimum Wage, the call for the observance of 5th December on the 10 point demands raised by the Central TUs etc. He also briefed about the discussion in the Parliament standing Committee on Labour about the issues of the BSNL Casual and Contract workers. He expressed the wholehearted support of the CITU to the casual contract workers and their struggle.
The Rally was presided by V.A.N.Namboodiri, President, BSNLCCWF and was addressed by Tapas Ghosh, Secretary General, BSNLCCWF, P.Abhimanyu, General Secretary BSNLEU, Animesh Mitra, Vice-President BSNLCCWF and others. The rally was converted in to a March to the BSNL Corporate Office. A Memorandum on the demands of the workers was presented to the CMD BSNL by the leaders.

The March continued through the streets rounding the telecom building complex and ended at the Eastern Court itself, where Com. Namboodiri, President briefed about the meeting with CMD and the future tasks. Comrades K.N.Balagopal, M.P., President of Kerala unit of BSNLCCWF and M.B.Rajesh, M.P. conveyed their Greetings to the rally, expressing their inability to attend.

The Rally and March to Bharat Sanchar Bhawan was historic on many counts. It was for the first time after many years that such a Rally and March was organised at the BSNL Head Quarters, and specially by the exploited casual and contract workers. It was also an indication of the rise of the downtrodden workers who are being exploited by the company as well as the contractors.

Hearty Congratulations and Greetings to the comrades who came from far and near to attend the March! Let us continue our struggle to ensure a better future.

The discussion took place on the basis of the letter furnished to the CPF Commissioner by BSNLCCWF. Com. Namboodiri explained in detail about the non-implementation of EPF for the contract workers in most of the states. He also pointed out that both for the Casual and contract labour wherever it has been implemented, the date was from 2011 or so. He demanded that the EPF should be implemented from the date they were engaged or at least from 01-10-2000, the date when BSNL was formed. CPF Commissioner appreciated our point of view. He also stated that wherever EPF is not implemented, it can be brought to the notice of the EPF Commissioner there, who will take necessary action for implementation. The BSNL representatives asked the CPF Commissioner about the interest, penalty etc. if the EPF is implemented w.e.f. 01-10-2000.

We hope that the CPF Commissioner and BSNL management will take necessary action in the matter.
