2G Spectrum scam case dismissal – BJP and Congress governments responsible

The CBI Special Court has acquitted all the accused in the 2G spectrum scam case, including former Communications Minister A.Raja and DMK M.P.Kanimozhi. The judge has stated that the prosecution utterly and miserably failed to prove the charges.

There is nothing much to get surprised. The UPA government wanted to save its face and Prime Minister Manmohan Singh and went slow in the matter. BJP, which during the last general election utilised the scam effectively also went slow after winning the election.

The main reason? In addition to the political leaders there are many corporates and telecom companies in the list of accused. Besides Raja and Kanimozhi, there were other accused like Shahid Balwa, Vinod Goenka, Asif Balwa, Rajiv Aggarwal, Karim Morani, P. Amirtham, M.K. Dayalu Ammal and Sharad Kumar. The charge sheet filed by the ED had also named the following nine companies as accused- Kalaignar TV, STPL (now Etisalat DB Telecom (P) Ltd), Kusegaon Realty (P) Ltd, Cineyug Media & Entertainment (P) Ltd, Dynamix Realty, Eversmile Construction Company (P) Ltd, Conwood Construction & Developers (P) Ltd, DB Realty Ltd and Mystical Construction (P) Ltd (earlier known as Nihar Constructions (P) Ltd).

NDA government wants to tag in DMK. It also wants that no wrong message goes to the corporates that the government is against the interest of the corporates.

Hence even after 7 years of continuous sittings by the CBI court, three years under UPA and four years under NDA, no important evidence was presented by the CBI to ensure that the accused are punished. It is once again proved that corporates’ interests are more important than political interests.

2G Scam – Assets of about Rs. 28 crore by A.Raja, family & friends

According to the CBI, former Communications Minister A.Raja, his family and friends have amassed wealth of more than Rs. 28 crores during his tenure. The CBI had carried raids in 24 places and has confiscated 6 kg gold and 20 kg silver. It is also reported that the CBI has unearthed  transactions of about 200 properties in the name of the former Minister. It is alleged that these are all connected with the 2G scam.

CAG accuses private telecom operators for cartelisation

It is now open. The CAG Shri Vinod Rai has exposed the cartelisation of the private telecom companies to defeat the 2G, 3G auction process. The unions have already pointed out this fact.

The private companies cartelised and did not bid for the recent auctions of the air waves. It gave a chance for the government  to ridicule the calculation of the CAG in the loss of the 2G scam. Now the game play of the private telcos is exposed.

Almost all the private big business in telecom sector are in dock in the 2G scam. If anybody is not involved in the 2G scam, they are already involved in the earlier irregularities, violation of rules and regulations or getting undue advantage from the government. The corporate czars, Tata, Ambani and heads of almost all private telcos have already been summoned and examined by the CBI, PAC and other inquiry agencies. They may be called by the Joint Parliament Committee also.

The unholy nexus between the corporate houses, top politicians, bureaucrats, lobbyists, media persons – those who are powerful and rich are involved in looting the assets of the country. It has come to such an extent that during the last one year alone scams after scams involving lakhs and lakhs of crores have surfaced. The Manmohan Singh government has lost all authority to speak about ethics, morals, integrity and governance.

The liberalisation, privatisation and globalisation initiated by the Government since 1991 have its worse experience in the telecom sector, which is stated to be the biggest growing sector. The corruption, favouritism and irregularity all are also in the highest in telecom. But it is not alone. Even in the strategic and highly security area of defence and space organisation the corruption and favouritism are continuously happening as is seen in the Antrix-Devas agreement as also the Adarsh scam.

A clean up of the whole system is necessary. First of all, the crony capitalism being followed by the government has to be stopped forthwith. The people of this country has to fight unitedly for that.

2G – A.Raja, Behera, Chandolia and company heads chargesheeted

After a long wait and prodding by the Supreme Court, the CBI has filed the charge sheet in the 2G spectrum scam on 2nd April 2011 in the Special Court of Special Judge O.P.Saini formed for this purpose. The accused includes former communications Minister A.Raja, former Secretary, DOT Sidhartha Behura, former Personal Secretary to Minister R.K.Chandolia, Director of Swan Telecom (now Etisalat B) Shahid Usman Balwa, Managing Director of Unitech Limited Sanjay Chandra, Group MD Reliance Gautam Doshi, Senior Vice- President Reliance Hari Nair another Senior Vice-President Surendra Pipara and Director Swan Telecom Vinod Goenka.

They have been charged for cheating, forgery, criminal conspiracy etc. under provisions of IPC and Prevention of Corruption Act. The loss to the Government is estimated about Rs. 30,984 crore. The charge sheet is about 80,000 pages, includes 654 documents and has mentioned 125 witnesses. It is stated that the documents clearly establishes the charges.

Will the case will reach its logical conclusion. Let us wait and see.

2 G Scam – Accused Sadiq Batcha found dead

Sadiq Batcha, close of aide of A.Raja, and an accused in the 2G scam was found dead by hanging in his residence at Chennai. Batcha was questioned several times by the CBI in connection with the 2G scam. It is stated that he had full knowledge of many transactions in connection with the scam.

Is it suicide or some foul play? In such cases, it is not unusual that crucial witnesses / accused disappear from the scene so that further enquiries/questioning can not be conducted. CBI is already on the trail.

2G Scam -Whether Kanimozhi will be questioned?

After the payment of Rs. 240 crore to Kalaignar TV by Swan Promoter Shahid Balwa has been confirmed from the latter by the CBI, it is almost inevitable that Ms. Kanimozhi,M.P. and daughter of K.Karunanidhi, Chief Minister, T.Nadu and who have about 20% shares in the Kalaingar TV will be questioned. Kalaignar TV has stated that the Rs. 240 crore was a loan and has been returned, the evidences so far received by the CBI is pointing towards it as kick back for the grant of licence to Swan Telecom.

Anyway, within a few days it will be known how the CBI deal with this. Some media has reported that this was one issue which was clinched in the Congress DMK seat sharing discussion and agreement so that there will not be further embarassment for the Karunanidhi family.

2G Scam – CPI(M) demands recovery of loss and cancellation of licences

CPI(M) has reiterated its demand for cancellation of the licences of those private telcos who got the spectrum through the first come first served formula and recover the losses.

Com. Prakash Karat, General Secretary, CPI (M) in a statement said:” It is not enough to arrest a few persons. The Government should cancel these licences and auction the spectrum so that the revenue lost can be recovered.”

CPI(M) was the first to point out to this biggest scam in the country in 2008 itself. Its continuous exposal and also of the other opposition parties had compelled the Government to dismiss Communications Minister A.Raja and appointment of JPC to inquire in the matter.
