Casual and Contract Workers unity – Kolkatta shows the example

Kolkatta Circle have shown the example for the unity of the Casual and Contract workers. In a meeting held by all the casual and contract workers

unions in Kolkata, a co-ordinating committee has been formed for dealing with the workers’ issues. I am reproducing here a report on the matter :

Calcutta Telephones experienced unity among Thika Mazdoors.
The first ever experience in Kolkata Telephones is that the contractual workers  four  registered unions  have unitedly raised their voice in support of the ensuing 28th February strike. On 17th February 2012 in a big gathering  of  three thousand workers  Calcutta Telephones Thika Mazdoor Union, Calcutta Telephones Contractor Mazdoor Sangha, BSNL Nationalist Thika Workers Congress and National Union of Contractor Labour & Security Guard (FNTO)  in the banner of Calcutta Telephones United Forum  of Contract Casual Workers  hold a protest demonstration program  in front of  CGMT office at  Telephone Bhawan.  Com Tapas Banerjee Convenor of  CTUFCCW , Circle Secretary CTTMU, and  Chairman  Com Milav Halder, Circle Secretary , BSNLNTWC, Circle President of CTCMS Com Swapan Das, Deputy General Secretary of NUBSNLW- FNTO, Com Alok Nandi, Circle Secretary BSNLEU Com Saibal Sengupta   addressed the meeting. This  meeting urged upon CTD Management  to make an end of contractual labour system and strongly demanded for Departmentalisation of all  contractual workers working under BSNL, CTD.  CTUFCCW also expressed its concern that for the interest of the people of India  and on the other for the sake of national security survival of BSNL & MTNL is a must. Meeting expressed strong protest against any policy detrimental to the health of BSNL & MTNL. One memorandum in this regard had been handed over to the Chief General Manager.

PMO asks BSNL to send comments on BSNL Casual and Contract Workers.

The Prime Minister’s Office through the Communications Ministry vide 1-20/2012-SNG dated 8-02-2012 has asked the CMD BSNL to send the comments on the Memorandum submitted by V.A.N.Namboodiri, President, BSNL Casual and Contract Workers Federation urgently. The Memorandum was submitted to the Dr. Manmohan Singh, Prime Minister by BSNLCCWF on 30- 12-2011 focussing the major demands of the workers including regularisation of left out casual labour,  minimum wages of casual and contract labour , implementation of social security measures like EPF and ESI and also against retrenchment of workers requesting to intervene and ensure implementation.

Earlier, President BSNLCCWF, Com.V.A.N.Namboodiri, along with Comrade Basudev Acharya, M.P. and Leader of CPI(M) in Lok Sabha has met  Communications Minister Shri Kapil Sibal and brought to his notice the plight of the workers requesting to intervene and settle the issues.

Organise and Fight for the unorganised workers – Prakash Karat

BSNLEU and BSNL Casual and Contract Workers Federation are making all efforts to organise the casual and contract workers in India. In this connection I am reproducing some excerpts from the speech of Comrade Prakash Karat  in a seminar recently.
” In our country we have had economic growth for the last one-and-half to two decades after liberalisation. That economic growth has been of benefit to the big capitalists, the big corporates, the foreign multinationals and the urban and rural rich – only they have benefited.
So India can now boast of the highest rate of billionaires. Today there are 55 billionaires in India, and one billionaire means somebody having at least Rs. 5,000 crores of property. So you have 55 people in India owning one lakh crores or two lakh crores  in property and assets. So we can claim that we have increased the number of billionaires in India; that is one product of liberalisation.
On the other hand, class exploitation of the working people has increased. I have the latest figures, which show that in the 1980s, before liberalisation, the total share of profits as part of the net value added was lower than the share of wages. The total share of wages, which was there in the value produced was more than the share of profits, share of profit was only 20 % of the net value. In 1990, the first decade of liberalisation for the first time the share of profits was more than the share of wages; it went up to 30 %. And now, from 2001 to 2008, the profits share has gone up to 60 percent. From 20% in 1980s, it has now reached 60%. The share of wages has come down accordingly.
This is the rate of exploitation and this is a challenge we are facing. Neo-liberal policies, have created new types of exploitations and new differentiations among the working people. When we talk about the working class, today everybody knows 86 % of the working people are in the unorganised sector – either contractual, casual or self-employed people. The Arjun Sengupta Commission’s report gave those statistics.
Now this section which is not there in the organised sector, they are the most exploited by neo-liberal capitalism. Neo-liberal economics and capitalism creates a section of the working class which is outside the sphere of any protection, outside the sphere of any legislation or labour laws. They have no income security, no job security, no social security. Now this has become the bulk of your working class today and it is up to us to organise them.
This is the first challenge – under neo-liberal capitalism, to organise the working people, the bulk of whom are not in the organised sector, who are subject to the most ruthless exploitation. For them there is no question of protecting their social security benefits because they never had those benefits.
Organising them by trade unions, bringing them into the fold of the organisational movement – this is a big task before us. Because of the nature of this employment because it a scattered, because it is casual, because it is precarious – the jobs that they have – we have to find ways to organise them and bring them into the working class movement.
The earlier we do it, the more effectively we can fight these neo-liberal policies. We cannot do it with organising the workers in the organised sector alone. Of course we have to organise the working classes in the organised sector, but this large section of people who are today in various forms of contractual and casual work and who are not easily brought under the purview of the benefits are rights legally there for workers, how do we organise them? This is going to be the major issue for us in the coming days.
Here there are some positive developments. For the first time the central trade unions in our country, ranging from the INTUC to the BMS including the CITU, AITUC, Hind Mazdoor Sabha – all these trade unions have for the first time forged a joint platform. There was a general strike in September 2010, in which INTUC participated but BMS did not participate. Now we are going to have a strike in February 28 in which all trade unions have given the call jointly. One of the demands of that platform and that strike is exactly this demand to protect the rights of this contractual labour, to end this contractualisation of labour this process of casualisation of labour.
This is a movement not only in India, you go to any capitalist country in the world today, go to Japan, go to Germany, go to the United States – the working class is fighting against this major attack on its livelihood and their rights by this contractualisation and casualisation of labour. And this applies not only to industrial workers, it applies to all sections – service sector workers, etc.
This fight against neo-liberal policies and neo-liberal capitalism requires first of all this major urgent task of bringing into the organised movement all these sections of the working people.”
I think this is what we have to do for the Casual and Contract workers in BSNL.

Meeting with Chief Labour Commissioner on 31st January 2012

The conciliation meeting called by the Chief Labour Commissioner on the December 15 strike issues was held today, 31st January. Shri A.N.Rai, Director(HR), N.K.Narang (PGM SR) and other officers were present. From the JAC, Comrades V.A.N.Namboodiri, Convener, JAC, P.Abhimanyu, GS, BSNLEU and leaders from other unions were present. The meeting started and a detailed discussion took place on the Bonus issue. In the meantime CLC had to leave due to an urgent meeting of the ministry. Hence the meeting was adjourned and will probably held on 1st March. The exact date will be intimated by CLC.

During the meeting I had the opportunity to submit a detailed memorandum on the issues of the casual and contract labour with volumes of details of  many circles regarding the non-payment of minimum wage and non-implementation of EPF and ESI. A copy was handed over to the Director(HR) also. CLC  asked the Dir(HR) to look in to the matter. CLC assured that he will send the details to his Regional Labour Commissioners for taking necessary action in the matter. He also advised that similar cases can be directly sent to the RLCs.  The issue of regularisation of the casual labour was also discussed with Director (HR).

Casual Workers eligible for Maternity Leave – Madras High Court.

In a land-mark judgement, the Madras High Court has ordered that casual workers are also eligible for 3 months paid maternity leave.The order was given in a petition submitted by one woman casual worker who was denied paid maternity leave and also denied job when she tried to join returning after delivery.

The Court stated that even casual workers are eligible for paid maternity leave if they had worked for 80 days in 12 months preceding childbirth.

BSNL should implement Minimum wage and social security measures to Casual/Contract workers.

A lot of complaints are being received from many stations that the minimum wages decided by the Government/BSNL is not being paid to them. Mostly about 50% is only being paid. EPF, ESI are not implemented in most cases. It is a shame to the BSNL management that it is incapable of implementing its own orders and the exploitation of the low paid workers are continuing.

Today I had a serious discussion with the GM(Admn), Corporate office, who is dealing with the issue. He admitted that it is true that the orders are not implemented in many places, but assured that all efforts will be made to ensure that it is implemented. I gave him certain cases like Jabalpur, Mathura, Nainital etc. which he assured to look in to and action taken. Our comrade should come with correct information of non-implementation of minimum wage EPF ESI etc. so that these can be brought to the notice of the corporate office for reddressal.
