After much persual, the BSNL managment has fixed the next meeting of the National Council to be held on 27th February 2012. The last meeting was held in August last year. The items for the present meeting have been given sufficiently early, but on one pretext or other the meeting was not fixed. The items to be discussed are very important. The management as well as the staff side have to work out things so that favourable decisions could be taken on the issues.

BSNL publicity programme under CBI enquiry

It is reported in the media that the CBI is probing alleged irregularities in advertisement programmes worth crores of rupees carried out through ineligible firms by BSNL.  It is also reported that the Central Vigilance Commission (CVC) has referred the same to CBI alleging wrong doings in handling marketing and advertisement related in BSNL. This includes the unauthorised appointment of a part-time Director in the BSNL and assigning advertisement related job to a non-empanelled and ineligible agency. The case is also reported to have been forwarded to DOT.

If this is true, the BSNL management should explain the position. No corruption can be allowed.

CVC intervenes in the 3G roaming issue

The 3G roaming  provided by the private companies in circles where they did not have the licences was ordered to be cancelled by the DOT. But the private companies approached TDSAT and got it stayed. The TDSAT is dealing with the case. The argument of the DOT that TDSAT has no authority to deal with the case has been dismissed by TDSAT.

Now in a new development, the Central Vigilance Commissioner  has asked the DOT to forward all papers connected with the 3G Roaming issue to it for necessary examination.

It is very much necessary that the guilty should be punished

The Standing Committee of the National Council is going to be held on 24th January 2012 after a long time. It should have been held very much earlier. Only after continued insistence, it is being held. The management should understand that unnecessary delay on their part in settling  the issues will result in avoidable agitations by the workers. It is also necessary that the management side should come prepared to settle the genuine issues of the workers. It is the responsibility of the management not to antagonise the workers.

BSNL pleads for Rs.15,000 crore from government – ET report

NEW DELHI: State-owned BSNL, which is fast running out of cash to pay employee salaries, is looking to raise over Rs 12,000 crore long term loan, as it has depleted its reserves and desperately requires finding to meet upcoming capital and operating expenditures.
Executives in BSNL management admitted that the company was looking at banks to offer the PSU a lifeline, but denied reports that it had appointed SBI Capital Markets to arrange the loans.
ET had reported last month that BSNL, that was sitting on cash pile of over Rs 40,000 crore till March 2008, and was using its interest income to buttress its profits, may soon be forced to seek a government bailout to survive.
The telco is also learnt to have asked the government to fast track the process of refunding it about Rs 8,000 crore as the telecoms department had approved its plan to surrender its wireless broadband access spectrum in most circles. In the interim period, the telco wants a one-time grant equivalent to this amount to pay for its GSM tender for 14 million lines, expand its 3G offering and meet employee wage bills.
It had also sought about Rs 1,500 crore support from the Universal Service Obligation Fund to sustain its rural landline operations, a move that was turned down by the government.
BSNL had recorded a whopping loss of Rs 6,384 crore for the year-ended March 11, capping a series of dismal results in the last four years that saw the erstwhile monopoly being reduced to a bit player in the fast-growing market.
Once considered as jewel among the India’s state run companies, BSNL began the current financial year with reserves of just Rs 2500 crore. Off this, BSNL had a bank deposit of only Rs 840 crore while the rest is current account and being used for running its businesses.
But in March 2010, BSNL had cash reserves to the tune of Rs 30,343.40 crore.
“Our employee costs account fro 46.5% of the company’s total revenues. No company can survive if employee costs eats away a bulk of revenues,” BSNL’s chairman and managing director RK Upadhyay had told ET last month. On revenues of Rs 29,687 crore, the company has incurred employee cost of Rs 13,791 crore during the last fiscal, as per its balance sheet, a copy of which was reviewed by ET.
Upadhyay had further added that the telco’s cash reserves had collapsed as it paid out close to Rs 19,000 crore for 3G and wireless broadband access (BWA) spectrum in 2009. BSNL did not take part in the auctions, but was mandated to match the winning bid in all circles. This resulted in the telco paying up Rs 10,186.58 crore for 3G airwaves and a further Rs 8,314 crore for BWA airwaves.
BSNL also attempted to reduce its employee numbers by a third by offering about 100,000 employees a voluntary retirement scheme late last year, but the proposal failed to take off after severe opposition from its unions.
In 2009, a panel headed by Sam Pitroda, advisor to the prime minister on public information infrastructure and innovations, had advocated that loss-making BSNL take the VRS route to prune its near 2.77 lakh headcount by a third.
BSNL’s last order for mobile equipment was in 2006, when it issued a tender for 45 million lines, but this was eventually reduced to 22 million lines after former telecoms minister A Raja had intervened. In 2010,BSNL had cancelled its 93 million lines contract, the world’s largest for telecom equipment.
Following the junking of the 93 million lines contract, which had run into several controversies, including court cases and a probe by the Central Vigilance Commission, BSNL subsequently launched a tender for 5.5 million lines, which barred Chinese vendors initially, only to re-launch the bidding process to include the same, leading to protests from Western bidders resulting in the eventual cancellation of this tender.
After this, the telco had attempted a fresh tender for 15 million GSM lines, and Chinese participation in the bidding process has now raised fresh security concerns from the home ministry and the IB, forcing it to delay placing orders yet again.

JAC submits detailed note to CLC on the strike demands

The Joint Action Committee of BSNL Associations/Unions of Executives and Non-Executives has submitted a detailed note to the Chief Labour Commissioner (Central) who is chairing the conciliation proceedings in the matter. The next meeting of the conciliation is scheduled to be held on 31st January.  The JAC meeting held today decided to meet the CMD, before the date of conciliation.

DOT proposes new pricing for 2G spectrum

The DOT has proposed that the 2G spectrum should be auctioned in future. 2G spectrum is valued at 1.65 times of 3G price. Those who are having more than 6.2 Mhz will have to pay additional charges for the same.

Decision of the Communications Minister is required on these proposals.

USO Fund – Collections and disbursements

Universal Service Obligation Fund (USOF) is created for helping to provide universal service, especially in the rural areas and villages. The fund  collects from all telecom companies including BSNL @ 5% of the total revenues. First it was only for providing the landlines in the remote areas/villages which was mainly done by BSNL. In order to help the private companies , this was extended to the mobile service also by amending the India Telegraph Act of 1885. While the collections were to the extent of Rs.2000 to 3000 crore in the first few years, now it is about Rs.5000 to 6000.  BSNL was paid only about 20 to 25%, due to which the USOF has been accumulated to about Rs.24,000 now. The private companies are putting many suggestions, somehow to get these funds for their development. The collection and disbursement of the USOF year wise is given below:

The government should ensure that reasonable amount is allotted to BSNL for its loss making connections in the rural areas.

BSNL may lose Mini Ratna Status – HMT, Hindustan Papers and Hindustan Newsprint also.

The Department of Public Enterprises (DPE) is proposing to re-examine the Mini Ratna status of the PSUs which are not performing to the required level for the last three years.

BSNL may come on the radar. Though it was eligible for Nava Ratna Status on the basis of its performance earlier, the same was denied and only Mini Ratna was granted to it. But if the said proposal of the DPE is accepted, there is a chance that BSNL may lose its Mini Ratna status also, since its performance for the last two years have not been up to the mark. It is well known that BSNL has been posting losses mainly because of the anti-PSU policy of the government and the lack-lustre performance of the top management.  After the ‘Customer Delight Year’ project has been started by the JAC, the negative trend has changed for positive, but to what extent  is not known.  However, the DPE will have to think about this trend also before taking any action to downgrade BSNL. The BSNL Management and the unions should strongly demand not to demote the PSU.

HMT, Hindustan Papers and Hindustan Newsprint are also on the radar of the DPE for taking away the Mini Ratna stauts from them.

TDSAT cancels penalties on new entrants who did not roll out services

TDSAT has set aside the penalties imposed on the new telecom companies by the DOT for not rolling out services in time, as per the licence agreement. It also asked the DOT to refund the penalty amount collected from the companies. This order will benefit Sistema Shyam, Loop Telecom, Uninor, Etislat etc.

According to licence conditions the telecom companies have to cover 10% of the district headquarters  in a telecom circle within the first year after allotment of spectrum. If the roll out is not made even after one more year, the penalty can be imposed. The DOT had imposed the penalty and collected the same from these private telcos. Altogether an amount of Rs. 350 crore has been collected towards penalty.

As per the TDSAT order the licences can not be cancelled and the penalty already collected should be refunded to them.
