                We send herewith a copy of the NJCA Circular letter dated 27th May, 2016.  The same is self-explanatory.  You could see there-from that the  Government might not positively react to the demands placed by the NJCA over the recommendations of the 7th CPC.  Simply raising the minimum wage by a few rupees without any consequential change in the fitment formula or pay matrix will not bring about any tangible benefit. The revision of the minimum wage along would benefit only those who are likely to be recruited to the cadre of MTS in future.  As you are aware, the 7th CPC had not accepted any demand of the employees.  It is beset with dissenting notes in many chapters.  The fight between the personnel in the organized Group  A Services and all India Services had triggered such dissenting note on the part of the Member who retired from the IAS.  A significant section of the Secretaries to various Departments, we were told, were against any revision over the recommendations of the 7th CPC.  In any case, we are to await the outcome of the discussions at the NJCA meeting scheduled to be held on 3rd June, at New Delhi.
                 Coming to the issues pertaining to the Pensioners, we must recall that the 7th CPC had rejected almost all the demands unanimously placed before them by the Pensioners organizations. While tendering oral evidence the Staff Side had inter alia pressed for the parity for the past pensioners before the Commission, especially in the background of the granting of one rank one pension to the Defence Personnel.  It is ironic to note that the Defence Ministry which had piloted the demand of the Ex-service men for one rank one pension i.e.parity between the past and present pensioners has now taken a stand against such parity for civil servants.  No personnel either in the organized Group A services or All India Services would stand benefited by the present recommendation of the 7th CPC except a few as most of them were in receipt of almost time bound promotion in their career.  The modified parity one must recall has only benefited the upper echelons in the bureaucracy.  One can understand that the Govt. refusing to make improvements over the suggestion made by a Commission.  But it must be most intolerable when the Govt. refuses to implement a recommendation which was the outcome of a persistent presentation jointly by almost all the beneficiaries.  The plea advanced for non acceptance of the recommendation is the alleged impracticability due to the non availability of the relevant records.  Should the pensioner suffer for the reason that the concerned department of the Government has not kept the records properly? It is the most callous approach and must be resisted with all the force that we can command. We cannot afford to have this situation to develop. We are certain that most of the individual pensioners would be able to provide the requisite information needed to consider the first option in the pension fixation to the concerned department and most of the Departments would be able to verify the same with the available documents with them.  We must however await the decision of the NJCA in the matter.
                In the meantime, all affiliates will take such action needed to mobilize the pensioners and undertake a serious educational campaign.

Move of the Central Govt. to scrap Pensions Act

The proposal of the central government to scrap Pensions Act will deprive the right of the pensioners in ensuring their pension from attachment or seizure. The move of the Modi Government to scrap this 145 year old act is just like its move to amend or change many old acts. Some of the departments, it is reported, are against scraping since it will take away the right of pensioners.

We demand that the government retract from its bad move to scrap the Pensions Act.

Restoration of Medical Allowance for Pensioners – Meeting with CMD BSNL.

Com. V.A.N.Namboodiri, Advisor, AIBDPA met Shri Anupam Shrivastava, CMD BSNL on 29th April 2016 and pressed for early restoration of the medical allowance to the pensioners, which was withdrawn earlier on the plea of lack of funds.  The hardships being faced by the retired officials were brought to the notice of the CMD BSNL in detail. Com. Namboodiri stated that even the National Council, the priority of restoring it to pensioners has been demanded.

CMD stated that the matter will be considered.

Pension Act may not be scrapped

New Delhi: The Department of Personnel and Training (DoPT) has decided against scrapping a 145-year-old law, which exempts pension from being “attached or sequestered”, though a bill seeking its abrogation from statute book has already been passed by the Lok Sabha.

            Earlier, the DoPT had asked the Law Ministry to include the Pensions Act, 1871 in the repealing bill so it could be removed from the statute book. One of the key provisions of the law is that it exempts pension from attachment by any court. But later, it wrote to the Law Ministry to remove the Act from the repealing bill.

            After its passage in the Lok Sabha, the Repealing and Amending (Third) Bill, 2015 is pending in the Rajya Sabha.

            The Law Ministry is the nodal agency for repealing laws which have lost relevance today.

            A senior government functionary said that perhaps the realisation that there is no other law in the country which protects pensions led to decision against scrapping the Act. (Courtesy: Confederation News)

A Great Victory to Pre-2006 Pensioners!

After a long legal battle the Government conceeds 

another point to Pre-2006 Pensioners!

            After a long battle the pre-2006 pensioners got another issue sorted out with the Government conceding grant of full pension to pre-2006 pensioners with less than 33 years  as recommended by 6th CPC! This comes after the Govt deciding to extend the judgment given out by Supreme Court in the case of Inasu from Kerala.

            Now all those pre-2006 pensioners who got only proportionate pension for want of 33 years qualifying service, will get the refixation from 1.1.2006 and get arrears also.

BCPC Meeting held on 16-04-2016

The meeting of ‘main stake holders’ of BCPC convened on 16-04-2016 at Gurudwara Singh Sabha, Janakpuri, Delhi for revival of BCPC decided to hold a full fledged General Body Meeting according to constitutional provision during August/September, 2016 for election of office bearers. The meeting was presided over by Com.S.C.Maheswari, Chairman, BCPC and was addressed by Com.K.K.N.Kutty, Secretary General, NCCPA, Com.N.M.Sasthry, Advisor, BCPC, Com.V.A.N.Namboodiri, Advisor, K.G.Jayaraj General Secretary, AIBDPA  Com.K.Raghavendran, General Secretary, AIPRPA and others.

The meeting was called by the Chairman to revive the functioning of BCPC which had become almost defunct after the sad demise of Com.S.K.Vyas, Secretary General.

Coms. V.A.N.Nambbodiri and K.G.Jayaraj, General Secretary represented AIBDPA in the meeting.

78.2% IDA Pension Fixation – Secretary DOT assures early decision by government

Good News! Today, 12th April 2016, Com.V.A.N.Namboodiri, Advisor, AIBDPA and Patron BSNLEU met Shri J.S.Deepak, Secretary DOT and reminded him about the 78.2% IDA Pension fixation case. Secretary DOT told that he has gone through the file immediately after the issue was brought to his notice by us ( Com.VAN Namboodiri and K.G.Jayaraj – Advisor and GS of AIBDPA –  met Secretary DOT twice  on 02-03-2016 and 31-03-2016) and has already forwarded the same for Cabinet approval. He also expressed the  hope that the decision will be taken before the end of this month.

The continued efforts of AIBDPA and BSNLEU by meeting the Secretary DOT Shri J.S.Depak and Communications Minister Shri Ravi Shankar Prasad (on 09-03-2016) have borne results. The Cabinet note is now forwarded and as per the statement of the Secretary DOT, the decision is awaited before the end of this month. Let us hope that there is no further complication in the settlement.

We shall continue our sustained efforts for the settlement as was done in the case of Pension Revision from 01-01-2007 as also Pension Revision after the Wage revision from 01-10-2000.

AIBDPA meets Secretary, DOT on 78.2%

Com.V.A.N.Namboodiri, Advisor, AIBDPA, today, 31st March 2016, met Shri J.S.Deepak, Secretary DOT on the issue of 78.2% IDA Pension fixation for the pre- June 2013 BSNL pensioners. Com.Namboodiri pointed out the undue delay in submitting the case to the cabinet for approval. Secretary DOT assured that the the Cabinet Note is on his table and there will be no further delay in forwarding the same. Com.Namboodiri also demanded that the 60:40 condition for payment of pension should not be there which is creating difficulties in pension revision. He stressed the need for automatic pension revision, since pension revision is part of pension. He brought to the notice of the DOT the extra efforts made by the unions/associations in BSNL for improving the services which is showing results and the need for financial support from the government.

It is expected from the discussion that the file may be submitted to the Minister/Cabinet with out further delay. This is the second time that AIBDPA is meeting the Secretary DOT in this month, in addition to meeting the Minister Communications Shri Ravi Shankar Prasad on 09-03-2016, in which the entire issue was brought to his notice in detail for early decision.
